Depends a lot on the enemy. I might not do it next to a Eyrie who opened with Charismatic or Warlord like this example but other enemies it's probably fine. Setting up this way also implies that you are ahead of them in turn order so at least you have your turn to preempt what they do. Also don't forget about Cats starting buff where they get 2 warriors in each homeland so their keep isn't as fragile as it is in standard setup.
In Root, you are not required to forward check things. Think about how with the Eyrie you may have to do a battle in a fox clearing because of a card in the decree. You are not forced to move onto a fox clearing to complete the decree if you would rather turmoil now. Because the instructions on the cat's card don't say your homelands need to be far away, you can place them near another homeland and now that they're set, you can place your keep in one of them. You don't need to forward check that your keep will be spaced away.

However, you can plan a way to discard it intentionally by taking the forced move in such a way that you then have nobody that you can battle, which would then force the discard. You have to take the move if able, but you aren't forced to take the move in such a way that it sets up a battle, even if it's possible for you to do so ;)
Hmm. Maybe that "if able" clause was intended when you play with many more factions with homelands. Or other maps. Well, this will probably get patched out in a 4th revision.
It's not really a problem at all so no need for a patch. If the map is sufficiently packed with enemies and homelands, you get to set up closer to enemies. It's not going to break the game, just crowd it.

interesting insight, i thought if this was happened, it would mean that you cannot use those 3 clearings as starter clearings and need to change it

For optimal keep position. The fact that cats come with extra warriors i ADSET means the keep isn't so vulnerable anymore, hehe.
