    I'm totally with the plaintiff on this one.
    I think the neighbors are whacko, especially if they are constantly invading his privacy recording him. That would drive anyone nuts. And they had agreed on discussing & sharing the cost of a new fence. Who the F would want a plywood eyesore as a fence.The feud between these people is just getting started...

    The defendant told the building department that the plywood fencing was temporary so that's why they didn't do anything against him, but I bet the defendant never puts up a proper permanent fence...

    WHAT? the judge is wrong. The defendants trespassed many times, to cut the branches, to take photos and to film him. They had no right to cut the branches and just leave stumps and the judge is wrong, branches don't grow back from stumps, they might grow back from the base, but with big tree stumps like those were, there isn't a lot that can grow from that. And just because he danced for the camera and half pulled his trousers down, is not a crime, as he was in his own back garden...

      I agree. In the interest of justice, one would think a judge would want to be clear with all parties, and answer questions that could provide clarity. I see the Judge do that quite a bit when she appears to be fed up, but I don't see how that helps the situation when the litigants are unable to ask questions. If she deems them to be nonsensical after the question is asked then say no, but an arbitrary no is frustrating.

    The neighbor is beyond nosy and irritating. $500 for those trees is ludicrous, he should have been rewarded more to teach the neighbor a lesson.

    There isn't a problem mooning the neighbours especially when they are harassing him and video taping him. I'd do that to. The judge goes over board.

    She was wrong on this one. The defendants don't comprehend boundaries. They consistently trespass on his property and constantly record him and she just gets pissed because he had enough and flashed them. While they were on HIS property, recording.

      yeah that kinda rubbed me the wrong way as well. the plaintiff is CLEARLY a nice guy....marilyn doesn't get it sometimes. her status allows her to avoid the basic folk and so she has never had to deal with idiots. if she has had to deal with idiots, well she is a lawyer and a judge, so no one would have the balls to mess with her, and rightfully so.

    The defendants are clearly trash people. The sheer entitlement required to do what they did is disgusting. But a grown mans' compulsion to strip and/or expose himself doesn't sit right at all.

    Well second time ima say the judge did not handle that well lol if the defendant is constantly walking onto the plaintiff property recording,and cutting trees and all that....yea I would be acting the same way as the plaintiff. I sometimes think the judge lives such a perfect life that cases like this is too crazy for her to understand the how's and the why's of people doing certain actions and things

      You can cut trees limbs that overhang your property. Even if the base of the tree, isn't on your property.

      The first home I owned, the foliage grew on both sides of the property line. We had a chain link fence that divided the properties and the bushes and vines grew on and through the fence. It was beautiful. When it came time for trimming or cutting, even tho the bush was on our side of the property, since we shared the bush and fence and vines, we always communicated with our neighbors what we were doing as a courtesy. We didnt have to, by law, but its the neighboutly thing to do. They were good neighbors. I miss that house so much 🥹

      For cutting off a branch? $500 is decent. If they had killed the trees then perhaps the damages would be in the thousands

      @@redapol5678 yeah I happen to be an attorney and it doesn’t matter mate, it’s always replacement value. What was the value of the object at the time of the loss. To replace trees of that size would cost tens of thousands of dollars…. And yea, if someone damages your property you are entitled to be made whole, and here that means full, adult trees. I’ve heard of people winning over 100k in damages over trees being cut. It’s serious stuff lol

    She was wrong here, she attacked the plaintiff when it’s the other people that are annoying as hell. I wouldn’t want them as neighbors.

      She wasn’t wrong at all. She awarded damages for the defendants cutting the trees over the property line and scolded them both for acting like children which is completely correct.

    “I don’t understand how he changed like that.” Those are my exact words about my neighbour. After living next to him for four years and barely hearing a sound from his house, he inexplicably changed into a vampire. 10pm and he begins to blast music like it is a night club. Sometimes until 4am. I wish I could afford to live in my own gated mansion.

    JM got ahead of herself with being annoyed. The man has every right to sue and get even more than he sued for against them for harassment chopping his trees (lawyers have gotten 10K and up for someone chopping their trees) and the fence issue. It’s a bit ridiculous to me that she only gave $500!

I don't know why the judge thought that the plaintiff didn't have a right to be mad when this guy keeps going on his property and then hacked off his trees and put up that tacky ratchet plywood. Did you see how nice the plaintiffs fence looked and then he's got to look at that crap. Then the dude has the nerve to try to ask him for $300😂😂

    Judge is not right IMO. I also hate when ppl do the "you both are adults..." thing in situations where clearly there is a person who repeatedly does wrong /disrespectful actions. This "just move" solution is careless and sounds like a lil privilage because not everyone can "just move."

    Do you know my neighbor who is a couple years ago? He was an old man he’s dead now I told him I’m going to trim the property line of your oak tree. I mean the nuts that fall just destroy my yard. Anyways I start getting it done he comes out, screaming and yelling and won’t let the people cut the tree even though it’s on my hanging mostly on my property And that’s all I wanted property line cut, and the tree cutter stopped because they were afraid he was so old that he would have a heart attack so you know what I did besides being angry, I waited for the day he passed away, and I cut the trees and it’s been three years and I still don’t have the damn thing hanging over because I cut it severely back and now the new owners and came out and took out like five of the trees on his property that old man is probably rolling in his grave

    Unfortunately you can have a really bad, and annoying neighbor that people don’t see that way because they act differently around other people. I wouldn’t be able to tolerate someone recording me, and damaging my property, or even going on my land. That’s why I live in the country. 😁

    I usually agree with judge Milian but she screwed this one up. I would be incredibly annoyed if my neighbors took a fence down and put up some plywood eyesore, too. And so would she if it were her property.

    I love living in highly regulated subdivisions with strict HOA you’re less likely to have these issues because of the fines. I’ve never seen so many “you cut my tree” cases

    I know a lot of people don't agree with the judge but I do. He won something, there's no way to prove the trees are GOING to die but that Defendant is WAY wrong for altering the tree's on the Plaintiffs property. Both litigates are acting juvenile.

    Milian is wrong AGAIN.
    If you cut a branch to the trunk it will NOT grow again.
    Also, a tree or bush does not magically spawns branches out of the trunk after grown. They fked up those bushes and he shoukd have gotten replacement value regardless if he replaced them or not.
    And lets not talk about the defendant's tresspassing or installing a non exterior wood like plywood for a fence (temporary my ass).

    Doug to the plaintiff, "calm down, peace" - I hope he takes Doug's advice! I do believe him about the defendants, but pulling his pants down wasn't the best way to handle a neighbor dispute - and hurt his credibility.

      I think it’s hilarious and I’m an attorney. It’s his own private property - he has every right in the world to pull down his pants in his own backyard. The defendants look like perverts for continuing to film. It’s no different then filming a woman bathing topless in her own yard.

      @@pisto30 again, no I’m an attorney. Harassment requires the element of FEAR. It’s not enough that conduct is considered harassing… it has to rise to the level that the person being “harassed” fears for their person.
      Good luck convincing a prosecutor to land a harassment charge with “I keep filming my neighbors backyard, and he moons me in return, I feel unsafe!” So Karen like.

    The plaintiff reported the defendant to the building department. lol He escalated the craziness, and then kept it going. Nothing the defendant would do would ever make him happy, he just disliked the guy. The defendant is clueless, but harmless(tell him what he can/can't do and he'll do it). The plaintiff is the villain in this story.

    If an evergreen is cut to the trunk you need to do your research it will not grow back it is not like a fruitless mulberry tree where they just grow new leaves as you cut them
