    Thanx for the interview w/Mr. Goldman. As time passes, we are seeing added revelations re the foulness of the Trump admin & his criminal conduct as national leader. Further, we learn of the enabling of this behavior by members of Congress. They must be held accountable too.

    Double jeopardy in no way applies. Even leaving aside the plain English of Article 1,section 3:
    If someone in a company (even the CEO) is found to have embezzled money, they may or may not be removed from their position depending on the opinions of the company’s board.
    Regardless, they are still subject to any and all civil liability and criminal prosecution resulting from their crime.

      I wish he wasn't on that stock market list however. They really need to get rid of that and include the immediate family.
      Even though they're all guilty of it pretty much or enough of them so that they don't want to stop it, it's that insider trading that is just god-awful. I mean what if someone in your family desperately needs some surgery that isn't covered and I mean there's just too many temptations that have nothing to do with greed, but need.. what if a family member is defending a legal case and just running up legal bills that only a millionaire could pay... Even rich people can go broke facing something like that.
      But if there are clear laws in place or if they just invoke a ceiling. I know for one thing for sure that transparency with anything like that is absolutely mandatory. To quote Nixon which I can't think I've ever done, and it's about the most ironic thing Nixon probably ever said, and I'm sure when he was alive he kicked himself around the block forever having said it, ... 'the American people want to know if their president is a crook"
      Well you can replace the word president with congressperson or governor, etc.

    If we could look at Trump's troublesome behaviors as beneficial in some way, it might be that all of us are becoming more knowledgeable in the workings of our courts and our Constitution. History-making reviews of this kind are typically unavailable to avg ppl.

    One way to think about the difference between impeachment and criminal charges under the justice system is to look at the situation of lawyers, who may be disbarred by their professional association for having committed behavior, which is so egregious that it does not meet the associations are of ethical lawyering. In that same situation, a lawyer may be found to be responsible for such behavior, and be disbarred by his bar association or not however, at the same time the justice system may press charges for anything in that lawyers behaviour that mounted to a crime under the criminal statutes. A disarmed hearing an impeachment hearing are held by your peers in your profession to determine if you meet the bar, the profession sets for the type of work, your profession does lawyering or politicking the justice system establishes behaviour beyond whether or not it was professional is criminal, and therefore you should answer to in a court of law and be judged, or not on the evidence of that crime. It will be a very twisted decision by Scotus if they do not come to that conclusion.

    The notion of "Originalism" - that we can't interpret laws differently than they did nearly 250 years ago - is absurd on its face. It's a baseless religion. The Constitution, like the scientific method, was a child of the enlightenment. And like a scientific theory, the Constitution was MADE to be revised and updated based on new facts and understanding. So, ironically, Originalism itself flies in the face of what the founding fathers had in mind.

      Exactly right. Originalism is absurd on its face. As you point out, the Constitution was designed to be a living, breathing instrument, amenable to change to fit society's needs. If you follow originalism to its logical conclusion, then slavery is legal, women can't vote, drive, or serve in the military, and all you 18 year olds can't vote or drink for a few more years yet.

    Impeachment isn't a legal process, it's a political process only.
    It's similar in concept to a Board of Directors of a major corporation discovering their CEO is pilfering profits, & then having to decide whether to vote that CEO out of the company.
    The Board doesn't have the power to imprison the CEO, nor to order restitution or community service; it can remove the CEO from his/her position. In essence, the Board can say "you're fired." 😏
    However, depending on the nature & extent of harm caused by the CEO's wrongful actions, the BOD may also decide to report the CEO to a law enforcement agency (whichever branch of law determines whether the CEO's actions rose to a degree requiring further judicial/court involvement & related punishments...ie, local police, fbi, etc).
    Just because the Senate failed to immediately remove Trump from office (ie, they didn't fire him) doesn't mean Trump can't be held liable in a court of law. Period.
    Just ask Mitch McConnell.

    Impeachment is a mechanism for vacating an office of someone that has given Congress reason to hold them as untrustworthy. ("Incompetent" is not the proper word.) It is not in the penal codes as a penalty or punishment for crime. Hence, no double jeopardy in indicting/convicting, then impeaching, nor in impeaching, then indicting/convicting.

    A Third House, composed of experts in various fields of endeavour, appointed (or elected) by their peers in those fields would be an excellent idea, and could be an independent resource for the Supreme Court and the both the Senate and Congress to use as an advisory body on matters that become too contentious politically or legally and in danger of becoming 'footballs' for either Party to score points with. An Advisory Body that can cool things down, get to the heart of a problem, provide solutions that can be adopted without either side taking credit and be in the interest of the People and the Country would be a boon I think.
