They want to know why is your life in any greater danger than others. Meanwhile, the very same people NYPD is comparing your life's worth to, are victimized every flippin day in NYC. So, why is do I need a gun, versus the guy who got robbed at gunpoint yesterday? Why does my wife need a gun, versus the woman who was r*ped two days ago? Really?? Absolute Madness.

We are not allowed to carry firearms in public in my country.... I think being able to carry (and sometimes I would if I could) it is a huge responsibility and an exercise in self control. As an instructor I have taught many people to shoot pistols, rifles and shotguns and it changes them, always, Holding instant death in your hands is a sobering thing. De-escalation is indeed your friend.... :-)
As an American, who has a firearm with him almost every day, I agree - it IS a huge responsibility. I believe you should have the right to self defense and be allowed to do so, however if you do it is on you to make sure you’re responsible and safe along the way.

The best tip from my Dad and former cop was always "if you go to places thinking you need a gun maybe you need to rethink why your dumbass is going to places like that in the first place" holds true in all cases.
I go into shippers and consignees all the time to make pickups and deliveries, and then I have to go into truckstops to fuel. Drivers in cars have followed truck drivers into places to violently attack the truck driver because of the hate they have toward truckers. This is why truck drivers carry.

A small Kavita to the "don't shoot people running away" in some state you can shoot someone who is running away IF they pose a serious risk of death or great bodily harm IF they run away. Example 1: guy is breaking into your car in your driveway, you go outside he pulls a gun starts running and shooting at you as he run away. Example 2: you're walking on the street and a guy passes by you and either stabs you or attempts to stab you. Then starts running away.
I'll bet the DA will still try to pin you for shooting a guy if he stabs you and runs. They'll say he was no longer a threat since he turned his back to you.
The Best advice I've ever read over the years was from Massad Ayoob: "have your ID ready and hand it to the cops when they arrive at your place of residence, after you've shot an intruder, so they know you are the good guy, and not the bad guy pretending to be the homeowner." - Before the cops arrive, place your firearm away from you, with the slide locked open and magazine removed. And then, tell them this: "this is my home, I live here; I legally own that gun; I don't know this person who broke into my home; I felt my life was in danger and I defended myself with my firearm. I am willing to further cooperate with you thru my attorney." AND NOW STOP SPEAKING. Don't answer any questions. You've given the investigators and the first-arriving cops enough detail to establish what happened, and who you are, and who you are not. Now leave it up to the attorneys, the cops, forensics, and the investigators to work out the details, blame, culpability, and legalities. Remember, you have no obligation to incriminate yourself mistakenly or unwittingly; know your constitutional rights!
Thanks for reiterating these facts. Too many people lately seem to think having a gun is the way to control every situation, even when "Imminent fear of your life" is not involved. It's a little nerve racking to think people like that are carrying. I believe it also makes it less safe for us all. Too bad the people that need to see this type of info. won't.

That person has command authority so if they see a bad situation developing or one of the party is getting too frisky with their whiskey,he can order a departure.
I’m a part time police officer and license to carry. I’m also a retired US Army sergeant and I wear my Veteran cap indicating that I’m a retired soldier when in public. Most pugnacious people when they see a man wearing a veteran cap, they are less likely to pick a fight with the military veteran. Also, if a threat should happen e.g. a man is beating another man with a tire iron on a Walmart parking lot and suddenly he’s confronted with a military veteran with a pistol, the actor might get wise and cease his attack. .

Well, I would hope that after paying $48 a month for years, that my USCCA attorney would be there much sooner than 48 hours. And, if someone is breaking into your car, do not pull your weapon. Confront them from a distance and if they decide to attack you (especially with a weapon), then you are justified. Just make sure the distance is greater than the time it takes you to normally draw. Oh, and a second to handle that, "What the f* is happening?" moment.

One thing you missed. You had better tell the responding officer at the scene that you felt that your life was threatened and had to defend yourself. A Prosecutor will nail you on that if you didn't and say that at a later time you decided to call self defense. You do not have to give any details, but should let them know at the scene that you were defending your life. That is a very important thing to mention IMO.
No. IANAL. However, lawyers have put advice out there to shut up. Don't tell the officer anything other than you want your attorney. In fact that's covered in this video 3:15.
ATF= Alcohol, tobacco and firearms is the best mix, only play with guns when your drunk and have plenty of cigarettes. My best shooting is when I’m drunk with a Marlboro stuck to my lips. Moonshine, Marlboro and guns is my favorite mix. ATF favorite gun owner
Once someone threatens your life, no matter what they do, they are still a threat to your life. They can act however they want, do whatever they want, they are still a threat. Do NOT let your guard down. Stay alert and ready.
This "alcohol and firearms" do not mix mantra is not as cut and dried as our host makes it sound. Consider: You're in your home having a glass of wine with dinner, sidearm off your belt but holstered on the sideboard. Are you mixing alcohol and firearms? Or maybe this caution isn't broad enough. What if you're recovering from an injury and taking OTC pain meds, and you're running errands while carrying. Are you, in effect, armed while decision impaired? Or, you' just worked a triple shift due to a crisis at work. You're exhausted, and you're finally headed home for some much needed rest. Your sidearm is in the console. Are you armed while decision impaired? What if you just suffered the sudden loss of a dear family member, and you're struggling with grief. Are you decision impaired? If we start going through all the things in life that render a person judgement impaired, there aren't many times left when we aren't, to some degree. So should we carry at all? Will some gun-hating DA try to nail us for carrying while sad, angry, fatigued, or medicated?
Can't cover every single scenario and its exceptions in a 6 min video. Cases where someone breaks into your house, the alcohol is generally superseded by the fact that they've broken into your house, but there's going to be laws on the state level that define what that state thinks is "reasonable". Same for all your other examples; it's going to vary state to state by that state's laws and what actions you took while carrying. If you're found negligent due to impairment, it'll probably be an intensifier in sentencing. If you are found to have acted reasonably despite impairment, probably won't matter. Probably. As Kevin often says, check the laws for the state you're in.

I had a guy road ranging in SoCal a few weeks ago, he follows me through side streets for ten minutes smoking a cigarette and he had an NRA sticker on his car which is rare in a coastal town; I was afraid he had a gun and was out of his control of his emotions.
Another mistake is not knowing what is considered brandishing in your state example your state carrying on your hip not canceled is not considered brandishing but in another less gun friendly state it is considered brandishing and even in the most anti-gun states the slightest showing of your gun that is not even in your control as in you pick something off of the top shelf in the grocery store or you trip over something could or will be considered brandishing. Like it is very important to look up the laws around stuff like that for your state that you are in as again a lot of stuff differs
I respectfully would suggest a 7th mistake: posting boisterous stuff on social media, threatening violence. Example: "Any looter who enters my store is going to get blown away!" A savvy prosecutor will try to get such a post into evidence, almost guaranteed. Then you'll be stuck saying, "Aw, I was just blowing off steam - I wasn't serious!" Good luck with that.

It seems obvious not to drink and carry your gun, but what if you're at home and having a few and someone kicks in your door? Am I supposed to not shoot the home invader, because I have been drinking? Personally, I don't think I am going to hesitate to use deadly force if my door was kicked in and I am in fear for my life, just because I have had a few.
Of course you wouldn't. Protect yourself. And I would personally rather spend my life in jail with the possibility of repeal than be watching my funeral from afar. The problem arises when your thinking is impaired and the threat you perceive is not one.
Being at home is a different situation. You're not likely to bump into some random stranger that might have an attitude. That's why you shouldn't drink while carrying. If you're out in public and let's say you have been drinking. You wind up in a self defense situation where you had to use deadly force. Even if the use of deadly force was justifiable, the prosecutor will do everything possible to use the fact that you was intoxicated against you. Conversely, being intoxicated affects your decision making skills and you may make a wrong decision and use deadly force when it's not necessary. If you are in your home and someone kicks in your door, it is far more reasonable to feel your life is in danger. Even if you're intoxicated and that will likely be used against you in court. I don't think a jury would rule against you.
The video has said nothing about not defending yourself if you had been drinking. It was mentioning that in some states it is a crime to carry in public if you have been drinking. In other states, such as Texas, it is not a crime to carry unless “intoxicated” which is the same standard as DWI. None of that has anything to do with defending your life or your property against a home invader. You do not lose the right to self-defense because of intoxication or alchol in your system. You might lose the right to carry a gun in public if you’re intoxicated. There is a difference, a huge difference.
You say its a mistake to leave or lock your firearm inside your vehicle. Well ,what are you suppose to do when the place your going to shop at clearly states on the entrance ,"No firearms allowed " ?
...keep your weapon with you, at all times. Conceal it well...to where it is absolutely unnoticeable. Become comfortable carrying concealed. Of course, respect those areas that, by law, are 'Gun Free' zones (federal buildings, etcetera). The worst that could happen is the store ends up banning you from any further business. Otherwise, leave your gun in the car/truck...1) You are now unarmed...2) You take the risk of having your vehicle/gun stolen.
My brother in law is in some serious legal trouble right now because he did everything you said not to, short of shooting someone. He lost his rights to own a firearm.

My truck gun is pepper spray. I'd rather not blow out my hearing shooting inside a confined space & if two doses of OC spray doesn't stop the attack, I can always get out with my .357 or drive off with the would be car jacker hanging on the side of the vehicle.

Well, I would hope that after paying $48 a month for years, that my USCCA attorney would be there much sooner than 48 hours. And, if someone is breaking into your car, do not pull your weapon. Confront them from a distance and if they decide to attack you (especially with a weapon), then you are justified. Just make sure the distance is greater than the time it takes you to normally draw. Oh, and a second to handle that, "What the f* is happening?" moment.

Deadly force must be reasonable and necessary in response to an imminent threat of death and or serious bodily injury. Officers need to take his advise as well on the criminal side of a law enforcement deadly force event Of course officers will still have to cooperate with the internal investigation. Great advise in this video!

One thing you missed. You had better tell the responding officer at the scene that you felt that your life was threatened and had to defend yourself. A Prosecutor will nail you on that if you didn't and say that at a later time you decided to call self defense. You do not have to give any details, but should let them know at the scene that you were defending your life. That is a very important thing to mention IMO.
No. IANAL. However, lawyers have put advice out there to shut up. Don't tell the officer anything other than you want your attorney. In fact that's covered in this video 3:15.

Once someone threatens your life, no matter what they do, they are still a threat to your life. They can act however they want, do whatever they want, they are still a threat. Do NOT let your guard down. Stay alert and ready.

This "alcohol and firearms" do not mix mantra is not as cut and dried as our host makes it sound. Consider: You're in your home having a glass of wine with dinner, sidearm off your belt but holstered on the sideboard. Are you mixing alcohol and firearms?
Or maybe this caution isn't broad enough. What if you're recovering from an injury and taking OTC pain meds, and you're running errands while carrying. Are you, in effect, armed while decision impaired? Or, you' just worked a triple shift due to a crisis at work. You're exhausted, and you're finally headed home for some much needed rest. Your sidearm is in the console. Are you armed while decision impaired? What if you just suffered the sudden loss of a dear family member, and you're struggling with grief. Are you decision impaired?
If we start going through all the things in life that render a person judgement impaired, there aren't many times left when we aren't, to some degree. So should we carry at all? Will some gun-hating DA try to nail us for carrying while sad, angry, fatigued, or medicated?
Can't cover every single scenario and its exceptions in a 6 min video. Cases where someone breaks into your house, the alcohol is generally superseded by the fact that they've broken into your house, but there's going to be laws on the state level that define what that state thinks is "reasonable". Same for all your other examples; it's going to vary state to state by that state's laws and what actions you took while carrying. If you're found negligent due to impairment, it'll probably be an intensifier in sentencing. If you are found to have acted reasonably despite impairment, probably won't matter. Probably. As Kevin often says, check the laws for the state you're in.
@@GryphonBrokewing You're correct of course. I simply wanted to get these thought processes flowing. Many people don't consider other forms of impairment that can be far more detrimental than a couple of beers.

@@amytaylor5454 I actually just got back from northeast Texas. It's miserably cold 🥶 on the whole drive. Anything below 50°F I personally try to stay out of but really the days are in the 80s here recently and 50s in the morning.
I'm sorry the 115 plus temperatures here and low humidity is what I'm loving really everybody complains but not me. Currently 60°F with wind chills this evening

I had a guy road ranging in SoCal a few weeks ago, he follows me through side streets for ten minutes smoking a cigarette and he had an NRA sticker on his car which is rare in a coastal town; I was afraid he had a gun and was out of his control of his emotions.
Another mistake is not knowing what is considered brandishing in your state example your state carrying on your hip not canceled is not considered brandishing but in another less gun friendly state it is considered brandishing and even in the most anti-gun states the slightest showing of your gun that is not even in your control as in you pick something off of the top shelf in the grocery store or you trip over something could or will be considered brandishing. Like it is very important to look up the laws around stuff like that for your state that you are in as again a lot of stuff differs

I respectfully would suggest a 7th mistake: posting boisterous stuff on social media, threatening violence. Example: "Any looter who enters my store is going to get blown away!" A savvy prosecutor will try to get such a post into evidence, almost guaranteed. Then you'll be stuck saying, "Aw, I was just blowing off steam - I wasn't serious!" Good luck with that.

It seems obvious not to drink and carry your gun, but what if you're at home and having a few and someone kicks in your door? Am I supposed to not shoot the home invader, because I have been drinking? Personally, I don't think I am going to hesitate to use deadly force if my door was kicked in and I am in fear for my life, just because I have had a few.
Of course you wouldn't. Protect yourself. And I would personally rather spend my life in jail with the possibility of repeal than be watching my funeral from afar. The problem arises when your thinking is impaired and the threat you perceive is not one.
Being at home is a different situation. You're not likely to bump into some random stranger that might have an attitude. That's why you shouldn't drink while carrying. If you're out in public and let's say you have been drinking. You wind up in a self defense situation where you had to use deadly force. Even if the use of deadly force was justifiable, the prosecutor will do everything possible to use the fact that you was intoxicated against you. Conversely, being intoxicated affects your decision making skills and you may make a wrong decision and use deadly force when it's not necessary. If you are in your home and someone kicks in your door, it is far more reasonable to feel your life is in danger. Even if you're intoxicated and that will likely be used against you in court. I don't think a jury would rule against you.
If the issue of drinking alcohol at home is raised. I had a few shots of whiskey to settle my nerves while waiting for the police !
The video has said nothing about not defending yourself if you had been drinking.
It was mentioning that in some states it is a crime to carry in public if you have been drinking. In other states, such as Texas, it is not a crime to carry unless “intoxicated” which is the same standard as DWI.
None of that has anything to do with defending your life or your property against a home invader. You do not lose the right to self-defense because of intoxication or alchol in your system. You might lose the right to carry a gun in public if you’re intoxicated.
There is a difference, a huge difference.

You say its a mistake to leave or lock your firearm inside your vehicle. Well ,what are you suppose to do when the place your going to shop at clearly states on the entrance ,"No firearms allowed " ?
...keep your weapon with you, at all times. Conceal it well...to where it is absolutely unnoticeable. Become comfortable carrying concealed. Of course, respect those areas that, by law, are 'Gun Free' zones (federal buildings, etcetera). The worst that could happen is the store ends up banning you from any further business. Otherwise, leave your gun in the car/truck...1) You are now unarmed...2) You take the risk of having your vehicle/gun stolen.

My brother in law is in some serious legal trouble right now because he did everything you said not to, short of shooting someone. He lost his rights to own a firearm.

My truck gun is pepper spray.
I'd rather not blow out my hearing shooting inside a confined space & if two doses of OC spray doesn't stop the attack, I can always get out with my .357 or drive off with the would be car jacker hanging on the side of the vehicle.
@@doughesson You seem to misinterpret what I say about why I carry a can of oc Spray as a less than lethal option because you're more likely to be in a fist fight than a gun fight

That's why I carry pepper spray too. I would hate to have to shoot a dog.

@@hollyfoxThe I am not on a farm, but in a city of 100K, with leash laws. Depending on which dog I am walking, one wants to fight stray dogs, one wants to play with them. Either way, vet bills are expensive! I was close to spicing up a German Shepherd once, until the owner ran out and started chasing it with a broom. Not everyone should own dogs.
@@704ab And that is where pepper spray comes in. At least the owner wasn't coming after you. Yes, some people should not own dogs. But what are we going to do? Have red flag laws on dog ownership. Preemptive attempts to solve crime are useless and violate due process.
Also add being attacked by a dog when you are on your property, in public or in the woods.
