      You touched on something regarding Microsoft, and I think that you can actually push a bit further on them. For example, all the file extensions they use on windows, they have basically monopolized the OS space alongside Apple by making it near impossible for other OS developers to make anything that could be supported and used without outside help (ie, steam proton).

      this is so complex. google is not a monopoly when it comes to app store installation because of the ability to download apks or other store fronts while apple does not making them kind of a monopoly by locking the competition out. this is where its tricky because while they dont have a case against google. They do have a case against apple because they lock out apks preventing you from getting other app stores. thats where things become an issue for apple. It means that because no other app stores are allowed they do have a monopoly and since iphone is one of the biggest providers and the store has no competitors on that device. They had no chance in hell with google but with apple their flaw is the fact they lock out apks making it apple store only making it a technical monopoly. personally i think this is just epic grand standing on their pretentiousness but they do have a case which unless apple allows apks they do have a chance of winning.

      @@Wix92 after all those statements about ‘fighting for all developers’ and all those prepared statements and propaganda video entailing Apple as an evil entity, they should be ashamed of assuming a higher moral ground since it turns out that they might be only wanting the opportunity to negotiate a better deal at the end (which is a compromise, but utterly damaging and humiliating for Epic)

    I don't know whether to feel shocked that Epics practices were so bad, amused at Ubi getting hosed, mad that epic violated their contract, or disappointed that I didn't get in line in time to take a drink from the fraud faucet.

That and it’s all in contradiction of these companies trying to claim to be moral, which is something no-one should be surprised by, and makes it clear that Epic has been talking out of they metaphorical rear-end.

      As an interesting thing to note, Apple actually have a new clause where if the yearly revenue made by a company is below 1 Million they'll only take 15 percent instead.
      So like, It seems like the little guy has actually gotten a minor help from this massive lawsuit shining light on these practices.

      I don't give a shit about Epic, but I really want Apple to be forced to open their devices for anyone to distribute for. Even if the decision comes down to allowing bootcamp on iPhone (iOS remains locked down, but installing Android, Linux, Windows, or even EpicOS would be a huge win in my book!)
      Imagine if we have a whole bunch of competing iDevice OSs by Valve, Epic, the Linux community, and more, that would completely demolish monopolies where it counts.

      It does in terms of individual video game distribution rights. However, it seems like they're arguing about storefronts right now, which is different. On the PC, you do have a choice of different storefronts right now whereas that is not the case for Playstation or Xbox.

      ​@@chrisll3438 I didn't say anything about a "monopoly", I said specifically that I'm not sure you can call it much of a "choice" if one of Epic's biggest selling points are making exclusivity deals with products that are in high demand. This filters customers directly to their store front since you can't get the "exclusive" product anyplace else. It's also not like when Valve has an exclusive title, because that's typically Valve making it or an extension of a Valve product. Epic does exclusivity deals with games that aren't even produced in-house or based on their in-house properties.
      It's not hard to see what they're doing.

      Tencent own 48.5% of Epic - more importantly they have 2 seats on their Board of Directors (in perpetuity). And yes, Timmy's actions are clearly dictated by the CCP who are using litigation to try and get their own stores onto western devices, without paying anything to the platform holders.       Epic doesn't own PC or Windows as a platform and doesn't restrict you in any way from installing apps from outside of their store, or installing alternative stores in the way Apple does on iOS.

    Epic has a walled garden storefront. They could be sued for not letting every dog and pony scam game on their storefront. What's to stop local farmers from forcing their way into the grocery stores directly?

      The epic store has competition. You can get the same or competing products (games) from other sources (competition)
      Apples app store does not have competition. You cannot get apps of any kind from anywhere else without having to acquire completely new hardware. This is a monopoly.
      If Walmart was the only seller of bread, it would be a monopoly. If only game stop sold video games, it would be a monopoly.
      You are, intentionally or not, conflating a product and a market. Game exclusivity affects a single product, that single product has competition, that competition makes up the market.

      @IzoPacifist no the app store does not have competition. Apple has an absolute monopoly on the $50,000,000,000 a year market that is app distribution on ios. Not only do they have this monopoly, but they use their monopoly to crush competition to their services by banning competing apps, like game streaming service apps (Xbox, Shadow, Stsdia, etc.) gaming, in a complete not coincidence, makes up 72% of the revenue on apples app store.
      The iPhone has competition. The apple app store does not.

There's a quote going around about a lawyer asking Sweeney at the trial if Epic would've backed down if they got special treatment from Apple, like Amazon seemingly has, and Sweeney promptly answered "yes". Don't know if it's true or taken out of context, I heard it on a Bellular News video and have yet to check this.

      They're playing the long game though. People with existing Steam libraries will not switch to Epic that easily, but when Epic's done with this there's probably a new generation of gamers out there who own most of their games on EGS. It's a sad future, but probably realistic...

      There is a distinct difference. I would consider locked down hardware a monopoly because the barrier to switching requires buying a whole new device at full price. To switch between EGS and steam, you just need to install another app.
      A lose-lose for both companies would be if Apple can continue to keep iOS as is, but require a legit way to unlock the device and install a third party operating system with full support for all hardware features. Epic doesn't get EGS on iOS, but Apple can no longer dictate what users do with their iPhones or iPads if they install a third party OS.

      We're talking about a phone here: The main purpose is making phoncalls. Any other gadget on it is a bonus but not important.
      If you pick a system for the gadgets, deal with the shortcommings or buy another system.
      The OS is what makes the device working as it is and as guaranteed. Third party OS? Fine, but no more warranty.

Whether it's a kid that was given a device as a gift, and wants to learn computer science, or a person in a developing country that can only afford whatever people are tossing out, for a lot of people buying a new device is simply not an option. Also the buy a new device solution is one reason why there's so much e-waste.

      You sold lots of iPhones but you don't allow users to install whatever crap they want on them, including mine. I get to have users be able to install my apps without you deciding what users can put or not on their phones.
      If you try to make an app for an iPhone you will soon see who owns every iPhone, and it's not the consumer.
      Still, best solution is to not buy an iPhone if you dislike not owning your phone. If you don't care or like it, then that's it. If no one ported their games to iPhone to not deal with their restrictions... but that's not what happens.
      Imagine if the one that built your house gets to decide what you can install on your home and who's allowed inside. And also gets a cut of 30% of everything you buy, the fridge, chairs, everything, plus you must buy through him, you can't buy directly to a seller that makes the products.

    I know it's not 1-to-1 but I find it a bit hilarious how on one hand Epic is "forcing" people to adopt their storefront if they want to play certain games that Epic has exclusivity to but on the other hand they are trying to fight against an exclusive storefront.
    Personally I have the Epic launcher but due to Unreal Engine. I do mostly get the free games but to this day I have not played any of them.

    For Honor has a ton of DLC packs that Ubisoft was banking on new players purchasing, which is why they absolutely didn't mind taking a small price from Epic for the base game.

    The big tech companies are being sued because their stores represent "vertically integrated monopolies".
    Back in the day, movie studios had their own cinemas. If you wanted to watch a Universal movie you had to go to a Universal theater. If you wanted to see an MGM movie you had to go to an MGM theater, and so on. The US courts decided that these were vertically integrated monopolies and broke up the old studio system. Nowadays, you can go to potentially any cinema to watch a movie from whatever movie studio.
    It is about time the law stepped in to regulate these damn tech giants.
    All games should be available on all platforms! Don't listen to the lie that these companies are entitled to their own storefronts! I am dead serious!

That means you have to actively choose to go to the one that advertises itself as restricted.       chronoss chiron your the only one that is wrong here. If this goes through their will be no steam. No digital stores at all because everyone would want that digital storefront without paying rent and if no one pays rent the storefront cannot stand. So every single publisher will demand the own place to sell their products. And none of them will offer a discount in the slightest because they'll make more money selling full price and remain competitive with other stores. Epic store games are not cheaper than steam games for that very reason.

    It is kind like if you buy yourself a piece of land, there you build a big house from scratch and once it is finally done, you let people stay at place as long as they pay $30 to you from time to time - rent, basically. This scheme works great for years, but eventually comes an asshole guest and say that you have a monopoly IN YOUR HOUSE IN YOUR OWN PIECE OF LAND, and sue you for that because he/she does not want to pay rent to you... Google and Apple find their ways up the tech market (land), there they build their systems (houses) and let developers publish their games (guests). Them Epic comes along (the asshole guest) and starts to give them sh!t because it have to pay up to use their services. What the actual f*.

      We've already gotten some information about this since Epic opened its store. For starters, we've seen the licensing cost of tools to develop video games go up while storefronts have started charging less per unit the more that is being sold. Many game engines for example, no longer offer perpetual licenses and instead use subscription based models or revenue sharing. In the long term, we may see a shorter life cycle of games where they get pulled off digital storefronts in 5 years or less instead of the current 10. This is seriously the first time in a long time where game development costs are actually going to up despite the past lies that companies like EA have been feeding us. EA on the other hand has Frostbite, so this actually won't affect them as much.
      As consumers, we're starting to see a new era of console wars that are restricting content on some platforms and a price increase as well. In the last 10 years, the PC market has been thoroughly neglected, which is why we often get games released several months if not years later at a reduced price. But with the actions of Epic, we're starting to see a new kind of exclusive war where new games are only going to be on one platform and sales are going to be a lot rarer for those games due to the lack of competition between digital storefronts. Microsoft for example, has been delaying its releases on PC by at least three months and they tend to release at full price. Sony has been doing something similar except taking it one step further by restricting DLC content too. However, their exclusivity deal periods are measured in years. Epic also has a hand in restricting PC access to games too with Kingdom Hearts, which is why they've been allowed to charge 4x the price ($170) for a game that is 2 years old at this point. For reference, they're charging almost full price for each game and then compare it to the PS4 Kingdom Hearts All-in-One package ($40).
      New storefronts will also not be able to compete with Epic pricing out the competition. They've essentially bought up exclusive rights to major titles like how EA has bought up the rights to all the sports games. Then, they hand out free copies of games they can't get exclusive rights to so that people won't buy from other stores. Unless you have massive money to burn like Epic does, you can't compete with that. And is this kind of model takes hold over what Steam does, we're going to see an overall decline in the quality of games as well without cross compatibility, cloud saves, forums, and other things to support these games on the PC.
      So yeah, the damage is already there. But if Epic wins, we're going to see this taken up to the next level, which is going to be the scary part. Epic can afford to operate at a loss because of the Unreal Engine's dominance in the market provide them with a continuous stream of revenue. They're going to be able to use their deals to restrict access to games exclusively to their store and keep the prices of games high while others won't be able to do the same unless all other PC storefronts shut down. It's going to make it harder for other digital storefronts to compete with them while ensuring that the quality of service from said storefront takes a massive hit. It's going to be a major loss for consumers as a whole before the lawsuits of other platforms even matter. It won't affect Epic by much even if they host other games on their store because they don't provide the same services that these other platforms do.

      ​@@ImarBenIsrael You are correct that no one is the good guy, but there's a better guy. Epic in this case is the worst guy. Why? Their store offers no services.
      Their store is minimalist and it feels like individual developers/publishers are developing the store features instead of Epic (I cannot confirm this, but this feels like the only reason why all their features are so inconsistently implemented), which is why support for pre-installs and cloud saves are spotty at best. It's because Epic seems to host little or nothing at all on their servers, which is why they can take a lower cut. Other stores cannot because of the services they provide.
      If Epic wins, they'll essentially gain access to these services for free and so will everyone else. At that point, why would they provide those services anymore? We may see the Playstation Store drop all of its servers and just force the developer/publisher to do it. Costs for the developer would increase even further. Essentially, all platforms would be encouraged to provide the bare minimum like Epic. It would harm developers and publishers across the board.

    To be fair, with Apple, there is no way to use an app without their store. With Android you can direct download an app .apk file and install it from anywhere, so they don't have an iron fist on what you install on your phone. Apple does. This is the a high chance this changes things to open up apple's OS if they lose. I think letting unapproved apps be installed is the easier option than giving up their storefront. If Epic are stupid they will push the storefront issue rather than the app install issue.

    This is something I've been wondering about in regards to the obligation a company may or may not have to other entities. I mean, what is my obligation to any other company if I make a gizmo that runs my own OS? Do I have to allow other people to develop and distribute for it? It's sounds odd. This issue has been brought to courts over Microsoft before with their browser 'monopoly' on Windows, but what is the defining trait that got them there, is it simply the popularity of the OS? If my gizmo has a 1% world market share, will it be the same for courts as a gizmo that has 80% of the market share?
    I'm not a big fan of Apple and having had to work with some of their enterprise/development tools has not left particularly good impressions though I've been out of it for about a year now. Even so, if they made the hardware or at least paid for it, they make and maintain the OS, they publish apps for their own benefit and user retention but what type of legal obligation would they have to open it up to competing companies. Epic suggests Apple would STILL have to develop and maintain their APIs and tools for the safety and optimization of apps made for iOS but that in return, see 0% revenue for it since those apps would be published by a competing store operation on the same OS they keep maintaining. Sounds to me like Epic thinks it's telling an intern to 'do it for the exposure'.
    Further more, Epic agreed to Apple's conditions when they started developing for iOS and got their developer account. No private user ever reads the TOS but companies have lawyers on retainer for this exact purpose.

      @@JAN0L Of course it's sustainable but don't think MS aren't working in that direction. Windows S mode operating systems only works with apps from their own store. Microsoft just know that it's too late in the lifetime of a successful operating system to start restricting it now. S mode is already used to lock down education and enterprise machines to only use MS store software. Eventually that change will expand to home or even Professional systems, depending on how much they invest in their own store, so that users don't instantly feel locked out of the software they want to have.
      Microsoft have such a gigantic market that they can't stay out of governmental inspection with their actions, but if they were the size of Apple in the mid 2000's, they would have done the same thing.
      Besides, their largest source of income in the OS is companies and OEMs. Companies use a lot of proprietary software so restricting them is a challenge, but I assure you low level employees get the locked down S mode machine bought with bulk licenses by their firm from MS.

      If Epic Wins, it'll set a precedent that'll ripple throughout the console gaming space. The law won't care that "phones and consoles are different", all it'll see is that Sony's store is the only store that can install games onto PS5, just like how App Store is the only way to install apps onto iPhones. You're gonna say "But physical games", which are still highly controlled by Sony, and you can install apps via iTunes also.
      So if Epic Wins, it opens up Microsoft, Sony and Nintendo for being sued the exact same way. If that's the future you want, then by all means...

    Wow! I'm amazed at this stuff getting out into the public domain! I never trusted Epic from the get-go and have never subscribed to their store. Their lack of moral fiber is extraordinary. I have gone without games I really wanted to play at launch, rather than give them any of my money. All those UA-camrs like Upper Echelon, Jeremy from The Quartering and Az from Heelvsbabyface, who warned us about Epic at the very start, were so, so right.

      no its like walmart is only store on earth and for you to put an item in it is 30%
      in kaing your item to go there epic charges 5% after the 1st million you make
      or in there own store 12% and waves the above ...so you get a payment processor and store with many others in it.

    The problem with the epic-apple lawsuit isn't that epic wants to use Apple's platform for free, is that Apple isn't allowing any alternative, you can't even install applications from other sources without rooting the device (jailbreaking on iphone).
    On android it's possible and there are many other sources, even FOSS sources (like fdroid).

      That's because Android is Open Source and iOS isn't, it's not illegal and the Governments haven't seen any reason to regulate this practise because there is no need to since people aren't being scammed or having their details stolen.

    Outside of Epic interests, the fact that widespread hardware can only get new software via the manufacturer is a problem, and I think having the choice of alternative stores on consoles and otherwise would be a net benefit for the consumer. On Xbox it's not that strong of an issue since you have the affordable developer mode instead of an expensive development kit, but still, an alternative to the Microsoft Store would be a good thing imho.

    The word "monopoly" has a bad reputation, but there is nothing negative about monopolies that form organically. Megacorporations using laws to keep themselves as the top is corrupt, but companies that are effectively monopolies rising to the top due of consumer choice is perfectly acceptable.

      The main reason why is because they pretty much never form organically. It's kind of hard to conceptualise a product that has an objectively best version.
      Burgers, as a simple example, can be made a number of different ways. Are the cheap, shithouse burgers you get at McDonalds the 'best' a burger can be? Certainly if I want a burger for a couple bucks, but not everyone is so concerned about that. Are the burgers with unusual ingredients, from hole-in-the-wall places, 'best'? I certainly love goat or llama, but not everyone does. Are high-end burgers with wagyu beef the 'best'? Certainly if you have the money to spare, but 30 bucks for a single burger that isn't even a full meal is a rare treat that not everyone can afford.
      Pretty much the only times monopolies form organically is when one business discovers a method that makes their products far and away better than their competitors without increasing price. If McDonalds figured out how to serve wagyu for a couple bucks, they'd start to form a monopoly. But, that'd only last as long as the patent. It pretty much always does.

    I can't say I agree regarding Apple be Microsoft/Sony example. The iPhone is a communications device that you can play games on... The store is a result of the device being very flexible and contains a bunch of different stuff...
    XBox and Play Station are both purpose built gaming machines with a system to distribute games built in...

      A case study you can use is the separation of VISA from Bank of America.
      Epic reaaally have a good ground with that one.

    Apple should not be allowed to prevent me from installing whatever I want on MY devices, and to some extent, I believe Microsoft, Sony, and Nintendo, should let me do whatever I want with the consoles I buy too.

      While it may look like this, that may not necessary. The argument is over access to the storefront, not access to the game. That is a big distinction here.

    I would consider locked down hardware a monopoly because the barrier to switching requires buying a whole new device at full price. To switch between EGS and steam, you just need to install another app.
    A lose-lose for both companies would be if Apple can continue to keep iOS as is, but require a legit way to unlock the device and install a third party operating system with full support for all hardware features. Epic doesn't get EGS on iOS, but Apple can no longer dictate what users do with their iPhones or iPads if they install a third party OS.

    I believe that a monopoly could be considered a company that owns a specific percentage of a local, national, or international marketplace. Depending on the person, this percentage could vary. Personally, i find 35% or moor to be monopolistic.
