As much as I myself get your frustration (They took over the City of Pomona too), there wasn’t much Burrtec could really do to keep their contract. Municipal contracts like these often times come with extensions of up to 2 or 3 contract extensions, lasting up from 2-5 years each extension. The amount of extensions and times is negotiated by the city to prevent contract favoritism. Their contract with the City of Riverside was extended multiple times, something the contract allowed to happen until they officially ran out of extensions. That left the city no choice but to put it up for bidding. These municipal contracts are made by choosing the lowest bidder of the list, and a bidder that can offer more service variety and of course give more money to the city for their contract. Athens was number 1 in the list so they won their contract. And there’s no need to worry, Athens will also run out of contract extensions at some point.

Every private company, no matter who it is has to legally go by a municipal contract. That contract is there to allow the hauler to operate in the city. Burrtec in this case lost its contract to Athens because the contract could no longer be renewed or extended, there is no way to do so. Since that was the only option, the city had 180 days prior to the contract ending to notify Burrtec of its intent to put out an RFP (Request For Proposals) which they did. After that notice is given out, there’s nothing Burrtec can do at that point. In a municipalities view, they want what is best for residents which means they want the lowest bid with best offers and services. After the numbers are crunched up, the bidders or haulers are put in a list from lowest to highest. You need not understand, haulers don’t have a say if they will get the contract or not. That’s decided by the city council or ward or whatever they like to call it. Their decision will always land them into the 1st bidder or whoever has a best proposal for services. Athens proposed a much lower bid then any other bidder and offered more services so that being said, the city chose Athens to be the new hauler based off the RFP. WM doesn’t get many contracts because of their higher bids and very little external services provided to residents. They are actually much higher in their bids then Republic Services. The bottom line here is, you cannot fight the legal process back. Haulers know that they will not always get what they want, but there’s nothing that can be done. Bidder List for Riverside: 1. As with any municipal contract, the city looks for lowest bidders first. Athens knows how to play the take over game by being lower in their rates.
