    Can a person do criminal breach of trust of his own property ? (1) yes. (2) no. (3) it will depend upon fact of the case. (4) it will depend upon discretion of the court

    Can someone explain why that illustration is not a criminal breach of trust but Theft?
    I think it is also fulfilling the ingredients of Criminal Breach of Trust

      The accused didn't misappropriate or convert the property so 2 essential was not fulfilled.
      For theft - accused take the movable property out of owners possession, with dishonest intention without the consent of owner.
      I think that's the reason it was theft and not CBT.
      Correct me if I am wrong...!!

    Criminal breach of trust has now been included in The Bharatiye Nyaya Sanhita, 2023 under section 316.😅😅

    I think it not criminal liability it should b a civil litigation damages can be awarded rahter than punishment
