    Is Brett Kavanaugh ready for the Supreme Court? John Yoo, Yale Law alumnus and Hoover Institution visiting fellow, breaks down Kavanaugh’s law career in the U.S. Court of Appeals. Yoo argues that the United States has concentrated too much power in the Supreme Court since the New Deal era legislation and that the Supreme Court is now more powerful than Congress and the President. Based off of Kavanaugh’s past career, Yoo predicts that Kavanaugh will help reign in the power of the Supreme Court and give it back to the states.
    Yoo argues that based off of the Constitution, power to decide social issues should reside with states rather than the court. According to Yoo, prior to the New Deal era, the Supreme Court focused on regulatory issues rather than social issues. He argues that momentous social legal decisions like Roe v. Wade and Obergefell v. Hodges are meant to be left to the individual states to decide.
    Yoo analyzes the records of the current conservative justices and predicts that Kavanaugh will side more often with Justice Thomas and Justice Gorsuch, interpreting the Constitution as it was written by the founders, rather than by the changing will of the people.

    John Yoo is a visiting fellow at the Hoover Institution, a visiting scholar at the American Enterprise Institute, and a professor of law at the University of California Berkeley school of Law.

      @@Sphere723 The older I get the more I see the need for "enhanced interrogation techniques" lol, even though I protested GWB like a flaming liberal. Truly, it if wasn't for Trump and how triggered the communists got I would never know the extent to which the liberals have been infiltrated so I'm glad for that, and proud to call myself not only a libertarian as always, but a conservative (albeit a non-religious one)

    I'm opposing the nomimation of Brett Kavanaugh because he is not conservative enough. He sounds like he will, like Kennedy, be the swing vote on the Court.

    If Trump gets to appoint another judge, especially to replace a flaming liberal now on the court, I'll dance the happy dance. If he gets to appoint 2, I don't think I'll be able to stop screaming to the sky lords looking like a liberal on the day after election, but in elation as opposed to pain :)

    I believe that Judge Kavanaugh is a great pick up for his Supreme Court Justice position. Although I never thought about that Supreme Court Justice has anything to do with right or left side of things, but I believe they make judgement by the principles, honesty, fairness and decency by the judge’s role of the nature to suit for their positions. Also he is young enough to concentrate, review and judge by principles and other concerns together. Together again for America’s greatness and unity by principles, learning experiences from mistakes.

    Its easy to walk around a college campus and get students and faculty to sign a petition. One observance that is clear. Not everyone approached will sign a petition. A university has a large student population and to get a couple of hundred students to sign a petition is easy and can be done in a day.

    The "Founders", Federalists, Anti-Federalists, persons of diverse opinion, were not "Originalists" under any understanding. Ergo, this is a "living" move. Not to say persons who construe Orginalist, as does Scalia, to mean the wild view that what the "People" understood the Constitution to mean at the time of the Framing was "Law". The People were Represented, and Article Three understood "saying what the law is" in no way corresponding to Scalia's post-Hart Fuller world view. Cf. James Wilson's writings. Yoo is memorably awesome as ever, but radically in need of revision and shallow in his knowledge. The dimension under this, founding the above statement, is philosophic, concerning the Positive Law and the Natural Law in the transformation of Modernity out of the Classical world in which the Founders still moved at the edge of Enlightenment Reason, not Steven Pinker pseudo-Enlightenment Science = "Fact" and Scalia "Value", cf. the work of Leo Strauss. The Founders knew nothing of "value judgments" of which Scalia constantly spoke. dixi
