    I believe what happened is one of their mechanics installed the sleeves, and when they failed that person blamed your shop to cover up the shoddy workmanship!

      Where my money is at also. Bet if they checked with stores/parts and see who signed them out and when, all will be apparent. Obvs they’ll never share that info.

      there is literally no other way it could happen, unless someone stole the head, installed the sleeves and sneaked it back or swapped it for a different one. without anyone noticing

    Im a sparks, when i buy eletrical accessories or light fittings, its my responsibility to install them correctly not my supplier. The law says i have to use reasonable skill and due diligence, and the diligence means i check the parts over and skill means i know what I'm doing. Your customer failed on both accounts, point that out to them , i sure the judge would throw there case out of court

    It’s up to the other shop to prove you are in the wrong, so let them proceed with any legal action they see fit. By paying you now for the work you did, demonstrates they accept that work. For evidence, it would be worth your while to obtain an affidavit from your supplier stating they do not supply injector sleeves with the head. Your threat to take them to court seems to have worked, so now they are trying the same tactic on you. Call their bluff and don’t pay them! Good luck.

      He already has the affidavit from the supplier since he contacted them to confirm when the issue arose. Not that he needed to as he knew they didn't due to past jobs

    when you get the court papers come to you. put together your statement of the case , then file it with an n244 requesting the case be struck out due to no case. ie CPR 3.4(2)(a) (where a statement of case discloses no reasonable grounds for bringing)
    also file an Form EX160 along with it so you end up paying no fees

    Main dealers really piss me off. They charge gold money for pig iron, a lot of the "technicians" are fresh out of college because they are cheap, and those that are experienced sometimes tend to get blinkered by working on the same shit day in day out! There is a lot to be said for Daves place under the arches....

      I completely agree, I don’t trust one word that comes out of the mouths of reception staff behind a service counter - they are there to fob you off and rack up the bill. Find a good time served fitter who knows what he is doing and works for himself, and stick with him.

    Really good to see you are taking a stand with this one Lee, too often people can get away with murder by threatening court action in the hope the other person will give in due to the hassle even when they aren't in the wrong, so good luck to you and can't wait until the 24th comes round now!

    If possible, when your supplying heads etc for customers/main dealers etc. Take pictures of the unit top/ bottom / all sides and include these pictures aswell as a letter saying what is not included with the head. Keep the pictures on microsoft onedrive/ google drive or dropbox so then if they come back and say what this main dealer has done, you can just forward them the pictures in an email and tell them to shove it where the sun don't shine and good luck in court.

    Isaac should watch M539’s restorations videos, latest on rebuilding a V12 from an E31 is a good one, really good tips on sealing on reassembly to prevent oil leaks and risk of sealant debris in the oil. Loctite MR 5923 is a product worth investigating further.

    Simples.
    They asked you to supply a new head and fit the valves.
    You did that, so they owe you the agreed price.
    By now that should be paid for.
    They then rebuilt the engine, assuming without checking either with you or for themselves that the head had injector sleeves.
    As you say, that work is entirely down to them.
    They now want you to put right their negligence!!
    Let them sue you - but for what??
    The original contract was completed.
    They can't send you an invoice because you didn’t ask them to do anything for you!

    you did say the injector sleeve only available from main dealer so you would have a invoice,
    they would have a parts trace in there system and a job sheet for that vehicle, including hours of labour,

    If nothing else this dealership is predictable: we called out weeks ago that he would try and charge you the same amount of money that he owed you.
    I'm just not quite sure what alternate universe he must be living in to think that he could try calling two separate companies, liars, when it came to fitting the valve sleeves.
    Did he pay you for fitting the valve sleeves?
    Did you invoice him for fitting the valve sleeves🙄.
    ...... They are clearly not on this planet 🤣

    I used to own a few bouncy castles that I hired out to a main dealer once.
    It took me near 18 months for them to pay up. They tried everything to get out of paying, they even said I'd bought the wrong size bouncy castle. They ended up paying the day before it went to the county court. I vowed then never to do business with another large corporation.

    Happy you got the payment, if it goes to court claim damages as it's also your reputation on the line (I know you already have a great one) and if your supplier wants to add their bit so good.

    With the dealership... I can imagine some service manager saying, "fine pay his bill, if he doesn't pay ours we won't use him again" Whilst knowing full well they're blaming you for their mistake. It won't go to court, and you won't get any more work from them until that service manager leaves. That's life in the big city.

    I’m in the hvac business. Had a large customer refuse the pay the bill for a repair on an out of warranty unit then threatened to not use us anymore if we continue to pursue the bill …… um why would we do more work when you have outstanding bills can’t weight for it to get warm.

    I used to do work for a Ford dealership, they used to pay their invoices fairly timeously until they didn't pay one invoice.
    We repeatedly sent them reminders with interest accrued, and they still didn't pay their invoice. Eventually I went to see the financial director, they kept saying it would be sorted out..... Never was.
    To take it to court was not financially prudent as it can stretch out longer than it should.
    A simple vetting procedure should be done on potential customers before any work is done for them, you'd be surprised what big dealerships get up to........

    The dealer must've reused the injector sleeves from the scrap head, I'd like to see their customer's invoice to see if they charged for new ones, maybe their fitter thought the old ones were ok and purloined the new to sell for a bit of a 'bonus', it certainly goes on.

    Remember that the dealer didn't make a warranty claim. They can't make their own "warranty" repairs.

    With that main dealer situation, stand by what you have said i.e. no more emails from you, ignore their invoice and see where it goes. You have made your position perfectly clear and the supplier of the head to you and other customers you have done this for can confirm in writing what the normal arrangement is.
    You said early on that one of their techs phoned you to ask a question about the injector seals, they have (supposedly) lost the original cylinder head and therefore any evidence about whether they even fitted any seals, you have a paper trail saying exactly what you did do.

    I'd stop talking about this now till after any proceedings are finished. In fact I wouldn't talk publicly about any potential legal issues (whether from you or towards you) till after they are concluded.

    They were greedy and selfish…..
    Scrooges eager for money!!!
    I DO respect wisdom and education…. and also being a smart businessman is realy ok.
    But from time to time one gets to meet people that seem to think that “claiming anything you might get” equals running a business properly….
    Regardless decency, humanity, respect and other ‘soft’ (-hence human??) considerations.

    Legal Action - get all your ducks in a row and a sworn statement from your supplier regarding the head - you should also look at putting a notice on your invoice regarding the installers obligation to check the supplied parts to ensure fitness for purpose - that way its in black and white and they cant argue

    If the head you rebuilt had the old sleeves in it, could they have assumed new sleeves were installed as part of the rebuild? Does your scope or any of the paperwork include language that spells out the sleeves weren’t replaced? Unfortunately, just because industry norm doesn’t include replacement of the sleeves, that doesn’t always protect us from people that don’t know that if we don’t tell them. That’s why there are warnings on ladders.

    It's not a new head that's been ordered incorrectly been partly assembled ie injector sleeves then been exchanged for correct one but injector sleeves left in, then sent out to you without being checked at suppliers.Probably something you wouldn't notice because your not fitting the injector sleeves.

    SOLUTION: No more work for that dealer. Send them a simple email saying that you dispute their invoice, as you are not liable for any additional or subsequent work done by their service department.

    If it goes to court, stick to what you have said, head supplied without sleeves and payment in full for head is an acknowledgement by said dealer that it wasn't supplied with sleeves either new or used.
    End of and tough cheese for the main dealer unfortunately.

    Not a lawyer, but displaying a "bring it on" attitude might potentially create a problem should you end up in court, in relation to any award of costs. It might be more prudent to only display a sincere desire to resolve the situation _without_ going to court, while remaining firm that you could not have fitted the sleeves (no tool), nor did you represent that you had fitted the sleeves (invoice/other documentation), nor is it industry standard practice/reasonable to expect you to have fitted the sleeves.

      John told me with new rings you dont go too gentle or you risk glazing the bores losing compression and maybe somr oil pressure. Could depend on the application though.

    Well Lee, I presume you would've done your own QA checks on the new head before sending it on? If that is the case, I'm sure you'll have photos?
    Doesn't matter really, although it is good practice.
    You'll have confirmation from the supplier about the injector sleeves. . Not a bad check mate if you ask me.

    Seems someone at the main dealer is being careless with the truth and not owning their stuff up. Being a retired copper and former motor mechanic myself, I'll give you some tips Lee, get your homework done starting now 1: Get a statement from your supplier on their policies and procedures with supply of cylinder heads and what parts are supplied with the cylinder heads. Have this person ready to attend Court to give such evidence. 2: Get a statement from your staff member on what they did with the cylinder head and whether it was wrapped up in plastic prior to shipping etc and have them ready to go to Court. 3: Lastly, you compile a statement as the business proprietor on your Standard Operating Procedures and Policies regarding supply of cylinder heads and associated parts to other parties. I don't know what other procedural steps would need to be covered for Court in the UK but be a good boy scout and be prepared and go hard!! This sort of thing has to be discouraged.     The main dealer are trying to call your bluff,by asking you to pay them after them paying your invoice, when you said there would be legal action if they didnt.
    In reality they haven't got a leg to stand on, I will be surprised if they take you to court to lose even more money ...and to be fair, you are being polite by just calling them a main dealer and not revealing their true identity.

    I am assuming your receipts normally show itemized work done and parts supplied. Unless they can come up with a receipt where it states that you fitted injector sleeves and provided them, they will have a hard time proving that you in fact are responsible for the work they claim they had to do because these were fitted improperly. Apart from that, you said in a previous episode that these specific sleeves are not available third party but are a dealer only part. I suggest you have them prove that you could have purchased them without involving a main dealer, or the dealer receipt for the parts in question. If they were bought by you from a main dealer this should be feasible for them, no? Regardless, If this type of disclaimer (not on the receipt? then it's, not part of warranty and not done by us) is not yet in your T&C you will want to get this in there soonish.

    I have A Feeling we're the Sleeves fitted in the first place or taken out of the old cylinder head, Are the Sleeves fitted for keeping the oil or water ? or why are they used,? Without knowing the head or are they just Different Material used, and Why they don't have the old cylinder head is Suspicious and No photos have been provided Showing the problem Lee ,which They should have made contact with you before Repairs were carried out ,you Should have been Allowed to See the issue 🧐

    They have to prove that its more likely your fault than theres to win at court. They have no possible way of doing that. They wont issue court proceedings they wouldn't of paid if they intended to do that but they will write off their invoice as a loss for tax purposes. Basically its a tax fiddle they have no intention of suing you.

    Whoever is driving this from the "main dealer" is a wanker - they are all trying to cover up a mistake NOT made by your shop.
    They paid your invoice because it is over due date and they are just covering their arse because their invoice is not yet due and they are using the threat of legal action to try and bully you into paying their BS invoice.
    As you mentioned, your shop does not even have the tooling to do the job.
    An interesting question would be "Has the garage in the middle of all of this got the necessary tooling to do the job?".
    I know from bitter experience that if you do not have the exact right tooling to extract and insert those sleeves and you try using pin punches or a brass dolly or maybe a screwdriver then you destroy them completely and no amount of new o-rings or other bodges is going to save the day.
    DON'T GIVE IN....

    Any main dealer should know better and not try to blame the likes of yourselves for mistakes they have made on reassembly, so let them take you to court if they so wish.
    On another topic, and if you wouldn't mind, can you go over the cutting of valve pockets in the cosworth pistons again, it's more the size of end mill you are using, if you use a different size end mill for the exhaust and inlet valve, positioning locations on the piston for both inlets and exhaust valve cut outs, and also if you do need to adjust the weight of pistons to compensate for valve pockets and deck hight adjustments.

    If they try to take you to court, its a matter of public record. Not a good look when they name and shame themselves. As for that claim. You didnt employ them to do any work and given what you know of them nor would you. If they sue you turn the form over and read what the counter claim says. Bill them for time. Even the time to send emails and filling in the counter claim. And finally no contract exists between you and there customer. Who is going to fix their broken sh1t now...

    Great they paid, Car shark hasn't got a leg to stand on. Oh and don't do any work for them again ever.looks like they are fishing and have a unhappy customer there end

    Full written instructions from any one wanting work done, a letter from your supplier stating no injector sleeves on a new head, no instruction from your customer to fit new sleeves, if you still have old head complete with sleeves then an appropriate email with 🖕should suffice.

    I suggest you have no further dealings with that (Franchise?) Main Dealer and maybe they can be met with other suppliers and shops refusing to have any further business with them. You should also advise any head office of the dealer chain of the case and the bad publicity and status they are invoking. In past when I have complained about Main Dealers not meeting standards I have mostly had repayment in full of large invoices on basis me not taking it further to Court and Public exposure. I covert mark parts for forensics to prove disturbance or otherwise and have often swapped plugs to wrong grades to demonstrate lack of thoroughness and failure to carry out their remit. The most "prestigious" marques are often the worst offenders and when you catch them out you can potentially destroy their brand. I won't mention those but most have bright red cars.

    Legal filings are public in your country aren't they? If so, then I guess you can read through the Claim on camera should you want to.

    Main dealer is living on hopes and dreams, that or figure they may be able to bluff you. It sounds more like some office dweller who knows nothing about the engineering side and is too lazy to find out is just hoping, that person needs sacking. They are giving the dealer a bad rep by pushing this when they're so obviously in the wrong.

    Well if what you say is correct and you don't have the tool to remove the parts and you made no change to the parts let them sue. Find the best most expensive lawyer you can as when the court hears the facts they will have to pay your costs as well as their own.
