    A few years ago my brother won a six figure sum in a civil case for a terrible wrong committed on him by an individual. His Dublin Solicitor firm took his case pro bono and were, thankfully, very successful. Great channel, Terry.

      Why does he ignore Danielle Kealey's testimony if he's so impartial? The only witness who had nothing to gain against Ms Hand, no payout for her. What of her in her community now she's been effectively shamed as a liar covering up a supposed assault?

      She heard the bedroom activity, saw them going to and from the bedroom and saw zero evidence of distress. She accompanied Ms Hand the entire time but you and your ilk dismiss all this? Why? What did she have to gain?

    Legal fees in Ireland are obscene. However there is no appetite amongst the political classes to tackle them. Family law is an example of this where on top of the absolute trauma of fighting for your kids, the chance to get somewhere to live etc, the legal eagles make sure they get their fees, win, lose or draw. And if you dare question the fees claimed by your own legal team, they soon show their teeth. I can't even look at a Solicitor's sign outside their office without a strong feeling of disgust.

      If you hire someone to do a job (i.e, represent you in legal proceedings) and then refuse to pay them for it, you can’t expect them to be happy. Solicitors’ firms are businesses like any other and of course they’ll “show their teeth” if you try to get out of paying them for their work

      @@ql2381 I didn’t refuse to pay them, I queried why their costs for my divorce came to €25000 for a case heard in the circuit court, not the high court. Legal fees in Ireland are obscene. Even the IMF wanted them lowered when they were running this country’s finances following the crash in 2008 but somehow the legal profession were immune to the harsh financial measures everyone else in Ireland had to endure.

    In England, and I imagine Ireland, there are a couple of other options. Pro Bono - some firms have a Pro Bono budget they could use. Not a good bet but it is worth considering. There are also Litigation Funders but come to think of it they usually want bigger cases. They are a bit like "no win no fee".

      Champerty , the financial support of another person's legal action, is deemed illegal in Ireland. The law on this very ancient crime was changed in the UK in 1967. The law in Ireland, dating back to 1540 (yes, 1540) was upheld in a very famous case involving s certain [Redacted] and a Mobile Telephone Licence, involving a crooked Fine Gael Minister, judgement delivered in 2016........ "Important People" tend to shape society.....

    If I may ask a question here?
    If Ms Hand has won this round, and it was left at that. The opposition has to pay her legal costs etc., as per the Court Rates.
    Does she have to top up the difference?
    Is the 1.5M Euros costs for both parties?
    Many years ago I worked for Thom's Directories in Dublin.
    I have a recollection of dealing with a Block Type Advert, and sales of both our Directories. (Thom's Dublin Street Dir., and the Thom's Commercial Dir).
    From a Terry Gorry Solrs, Endfield, Co Meath. The reason I remember this is the name "Enfield" is unusual.
    And if I remember correctly there was only one sale for the town.

    No win, no fee is available, but the barristers alone would not want to rack up fees of 2.1 million Euro and lose a case and then argue with the winning barristers about who gets paid first.
    If Hand lost, who would have paid the 2.1 million Euro fee for the 3 barristers who represented her? Would they have just shrugged it off as just another case down the drain, that makes no sense. They must have turned down other cases to take this one on.
    The all round fees are astronomical, multi millions to persuade a jury to believe one person over the other with no direct witnesses to the claimed attack.
    That's a huge gamble by people noted for their supposed risk aversion.

    So, it is not justice for the individual but a pay day for either legal team. That is who wins in the irish legal system, Solicitors and Barristers.. As they get paid no matter what.. It's not a great system for justice.

      @eltinjones4542 it is not a question of working for nothing. However, the disparity between what was granted and the legal cost is huge. Between 1 million to 1.5 million possible costs. The professional class gets paid no matter the circumstances and the make money of others suffering.. it is a sad state of affairs that in order to have justice, you require large wealth. So nothing about working fir nothing.

    Terry, you gave an excellent summation regarding the fee situation there. Interestingly I was listening to Joe Brolly this morning discussing this case & he was trying to figure the DPPs reasons for failing to try the defendant. He said that the introduction of the second defendant as a ''Patsy'' was screaming out Mc Gregors guilt. Quoting a very Senior Barrister who likened it to having a ''loose runner '' in the Grand National, it offered the DPP an open door.

    There are also companies that will fund litigation for a share of any awards. Not sure how common it is in Ireland but common enough in the UK and US.

    Go raibh maith agat Terry. It was a mystery how she was able to afford the high court. Her 250k will basically go to her solicitors. Doubt anybody would employ her after hearing about her coke & alcohol addiction. As usual, the only winner is the legal profession.

    What about the fact that they didnt find against his co accused. Will she be liable for the costs? Why did she not qualify for free legal aid? The fees are ludicrous for a few lads reading a few pages and making a few arguments. €1.5 million is outrageous.

    Other factors: The law firm supporting your case may also have additional contingency cases on the go (and perhaps contemplated), they can only sustain so many nonpaying cases or they blow out their budget; but of course over their case portfolio's progression they can better establish which ones are proving out in their favor and which ones are going foul, as they look through the disclosures, see who may be good stable witnesses who could be reckless and poor on both sides, whether your team and the other both have their hearts and full steam for the case for those oft told vigorous defenses and powerful offensive ends.
    Perhaps a generous friend of your side (openly or anonymously) may step up and offer support gaining returns in other socially acceptable ways - that vigorous defense bankrolled in part by sweet revenge perhaps.
    And as always possible (however improbable) some external slip up like a solicitor or barrister getting hit with a head butt outside in the high court yard, sending an entire case topsy turvy into a lengthy adjournment. Or a simple heart attack or family distress requiring time away and reinforcements required.

    I know that private equity will provide funding for high court actions on the assumption that they get 2 1/2 times their money back. They generally have in house council to advise on the merits.

    Terry, concerning costs of a full trial how many cases, civil or criminal, actually have any time in public court (other than court time for administrative dealings) and are rather settled by negotiation and plea or various diversions? And how much does that reduce a typical cases cost profile? I imagine just cease and desist and demand or cautioning letters smooth out many tippy tea cup disputes for minor billable amounts. This isn't wanting any cost/expense figures so shouldn't be construed as in the area of advertising for services.
    I see the Irish Courts Service Annual Report For 2023 published on 23rd September 2024 is available for those interested, but I doubt it addresses the number of possible actions that fail to become a case or are soon settled very early on and so might be cheapy handled justice. Just as most bar fights and even most UFC and other quietly promoted fights never happen to get to the weigh in laughs.

      Threshold for evidence is higher in criminal cases. Civil case rests on the balance of probabilities.

      Plenty of cases challenge laws in the high court/supreme court if you look them up......most aren't newsworthy

      @John Ryan That's an important point and I think you've hit on the Government motive for orchestrating this psyop on the people of Ireland.
      It's because the UN want to get rid of the Irish Constitution and the English one because they give us the right to be presumed innocent until proven guilty in a Court of Law.
      They want to change it for the Napoleonic system which most other countries have. Under that as you know, Defendants are presumed guilty until they prove their innocence.
      I knew there was a sinister plan behind this dodgy story with its impossible legal result.
      I rest my case.

      @@nillzero we have had jury trials since 1927. In all that time I have never seen evidence nor any remotely believable conspiracy theory to say that juries are stacked ina particular way. There would surely have been one whistle-blower in all that time to say if they were. Look at Edmund Honohon previous master of the court, surely he would have come forward about this if it had any semblance of truth.
      Even if the jurors could be selected the defense still has 7 challenges to dismissal jurors
      No niavety at all, just no evidence to support your theory, prove to me otherwise

    A solicitor will never take a pro bono case for millions of quid for no reason other than they might win. It's possible that an NGO or a government run 'NGO' could retain a solicitor who is then given an obligation to prosecute McGregor in civil court for ulterior reasons.

    In my View Nikita Hand Solicitor had to know that she had a good win when she made her statements to her solicitor with evidence supplied, its like a person making a personal injury case if that person goes to a solicitor with practically the hospital Exra in there hand, that's good enough for any solicitor, Correct me if I'm wrong, where did it happen ?.       As has been pointed out, ad nauseum, the burden of proof in civil cases is different. In civil cases, it's on the balance of probabilities, i.e., the claimant must show that the facts they allege are more likely than not true. In criminal cases brought by the DPP, the burden is to prove guilt beyond a reasonable doubt.

The poster reads the comments meticulously and eliminates any single one which would dare to question his narrative. If you check back here in a while you'll find that my comment above, and by extension, your reply, and this conversation will have been deleted too, unless the quandry I have faced him with now shames him into leaving the comment here. I do think, though, that the narcissism will win out and that the comment will be deleted. In relation to Enoch Burke, the poster once made a video denouncing Burke by saying that the state has a gender recognition act from 2015 and that whether Burke likes it or not the state recognises a person's self-identified "gender". The major flaw to that video at the time was that the poster seemingly failed to recognise that although such an act exists, the constitution provides that owing to another individual's freedom of expression and thought and religious belief, no individual must actually recognise the self-proclaimed "gender" of another individual. It is this constitutional provision which ensures that yes, ultimately, Burke will have his day, and more power to him.

    Anyway, I read on Google yesterday that Conor McGregor has apparently just accepted a fight with Jake Paul worth a reported $50 million, so it seems it's business as usual for Conor then. This suggests to me that civil court action and it's outcomes don't carry anywhere near the same weight as criminal court action and it's outcomes. The mainstream media has shown pretty much no interest in McGregor's civil case..

    Perhaps I've misunderstood, but I take what your saying to mean that the 1.5 million is the fees of both legal teams. Lets say it's divided 50:50 (though I imagine McGreggors team might have been more expensive), so that would mean Hand took a gamble on having to pay 750 thousand if she lost the case??? That's a hell of a gamble, no matter how confident your legal team is! Hmm...I have my doubts, but like I say maybe I've completely missed something.
