Legal fees in Ireland are obscene. However there is no appetite amongst the political classes to tackle them. Family law is an example of this where on top of the absolute trauma of fighting for your kids, the chance to get somewhere to live etc, the legal eagles make sure they get their fees, win, lose or draw. And if you dare question the fees claimed by your own legal team, they soon show their teeth. I can't even look at a Solicitor's sign outside their office without a strong feeling of disgust.

What about the fact that they didnt find against his co accused. Will she be liable for the costs? Why did she not qualify for free legal aid? The fees are ludicrous for a few lads reading a few pages and making a few arguments. €1.5 million is outrageous.
Other factors: The law firm supporting your case may also have additional contingency cases on the go (and perhaps contemplated), they can only sustain so many nonpaying cases or they blow out their budget; but of course over their case portfolio's progression they can better establish which ones are proving out in their favor and which ones are going foul, as they look through the disclosures, see who may be good stable witnesses who could be reckless and poor on both sides, whether your team and the other both have their hearts and full steam for the case for those oft told vigorous defenses and powerful offensive ends. Perhaps a generous friend of your side (openly or anonymously) may step up and offer support gaining returns in other socially acceptable ways - that vigorous defense bankrolled in part by sweet revenge perhaps. And as always possible (however improbable) some external slip up like a solicitor or barrister getting hit with a head butt outside in the high court yard, sending an entire case topsy turvy into a lengthy adjournment. Or a simple heart attack or family distress requiring time away and reinforcements required.
I know that private equity will provide funding for high court actions on the assumption that they get 2 1/2 times their money back. They generally have in house council to advise on the merits.
Terry, concerning costs of a full trial how many cases, civil or criminal, actually have any time in public court (other than court time for administrative dealings) and are rather settled by negotiation and plea or various diversions? And how much does that reduce a typical cases cost profile? I imagine just cease and desist and demand or cautioning letters smooth out many tippy tea cup disputes for minor billable amounts. This isn't wanting any cost/expense figures so shouldn't be construed as in the area of advertising for services. I see the Irish Courts Service Annual Report For 2023 published on 23rd September 2024 is available for those interested, but I doubt it addresses the number of possible actions that fail to become a case or are soon settled very early on and so might be cheapy handled justice. Just as most bar fights and even most UFC and other quietly promoted fights never happen to get to the weigh in laughs.

As has been pointed out, ad nauseum, the burden of proof in civil cases is different. In civil cases, it's on the balance of probabilities, i.e., the claimant must show that the facts they allege are more likely than not true. In criminal cases brought by the DPP, the burden is to prove guilt beyond a reasonable doubt.

In relation to Enoch Burke, the poster once made a video denouncing Burke by saying that the state has a gender recognition act from 2015 and that whether Burke likes it or not the state recognises a person's self-identified "gender". The major flaw to that video at the time was that the poster seemingly failed to recognise that although such an act exists, the constitution provides that owing to another individual's freedom of expression and thought and religious belief, no individual must actually recognise the self-proclaimed "gender" of another individual. It is this constitutional provision which ensures that yes, ultimately, Burke will have his day, and more power to him.
God Bless you, my experience of the law has been negative to say the least. By the sounds of it, Nikita, although she won and was awarded E250k owes a huge amount of money to her legal team. Loose loose scenario.

More than something not right about it. How did hairdressers assemble a big legal team? And nobody asked who was paying for it. Mainstream media all over the trial usually means psy-op.

What about the fact that they didnt find against his co accused. Will she be liable for the costs? Why did she not qualify for free legal aid? The fees are ludicrous for a few lads reading a few pages and making a few arguments. €1.5 million is outrageous.
You can’t get free legal aid to take civil cases, think about it. If you could everyone in the country would be suing someone.
The question still remains unanswered. Now that shes won, how is she supposed to pay the €1.5m fees after she was only awarded €250k?
The other side pay this I think, but if she loses an appeal is she in financial trouble?
It wouldn't be a sure bet if an appeal would be granted unless new substantial evidence was found
Terry, concerning costs of a full trial how many cases, civil or criminal, actually have any time in public court (other than court time for administrative dealings) and are rather settled by negotiation and plea or various diversions?
Like any business venture, the Solicitors will weigh up the chances of a win with the fiscal potential of the Respondent.
Don't understand why this wasn't a criminal case if a crime was committed...
Very good point.
Threshold for evidence is higher in criminal cases. Civil case rests on the balance of probabilities.
@@charshill2978 So how come no one ever gets to sue the government and politicians for corruption if it only comes down to probability?
The government implement the laws, as suits them.
The DPP examined it and decided not to prosecute and then later did a review with same decision. Check it out
@@rightiswrongrightiswrong806 plenty of cases taken ....look at the 2 that came back from Dubai during covid and challenged the law requiring them to quarantine in a hotel.
Plenty of cases challenge laws in the high court/supreme court if you look them up......most aren't newsworthy
This is a very difficult allegation to defend against . How do the prosecution PROVE the case . It seems to me that the defendants are in a position that they have to PROVE INNOCENCE .
I'd imagine it will be overturned on appeal
@John Ryan That's an important point and I think you've hit on the Government motive for orchestrating this psyop on the people of Ireland.
It's because the UN want to get rid of the Irish Constitution and the English one because they give us the right to be presumed innocent until proven guilty in a Court of Law.
They want to change it for the Napoleonic system which most other countries have. Under that as you know, Defendants are presumed guilty until they prove their innocence.
I knew there was a sinister plan behind this dodgy story with its impossible legal result.
I rest my case.
No justice in Ireland. Who is paying you or intimidating you ?
Whoever tells the best lies to convince the jury, wins
To be clear, no one has any information on how Nikita Hand paid her legal team, including the originator of this video.
The summing up reminded me of Jeffrey Archer "Is she not fragrant".
Thankyou Terry:)
Who were Nikita Hands SOLICITORS?
This is the question.
peter duff solicitors
she won because of the jury not the barristers. she won because of judge directing the jury.
@@nillzero she won because she is a woman, if this was other way around, no way of winning. Also, is mctap was poor, there would be no case, just regret s3x with no compo money
I've googled that and seen nothing about that firm of solicitors representing Nikita Hand? @UnknownUnrecognized
Could the two men do anything about the eight females on the jury? Before any0ne says that does not necessarily mean they will side with N.HAND it is something to think about with this life changing case.
12 jurors are randomly assigned. Both the prosecution and defence can challenge up to 7 jurors each. What more can they do to make sure an random jury? selection
@@CorkerinDublin to think its random is completely naïve.it is a jury of your peers. so they are profiled to the actors in the case so it balanced or fair lets say
@@nillzero we have had jury trials since 1927. In all that time I have never seen evidence nor any remotely believable conspiracy theory to say that juries are stacked ina particular way. There would surely have been one whistle-blower in all that time to say if they were. Look at Edmund Honohon previous master of the court, surely he would have come forward about this if it had any semblance of truth.
Even if the jurors could be selected the defense still has 7 challenges to dismissal jurors
No niavety at all, just no evidence to support your theory, prove to me otherwise
It's a good plan no win no fee wonder do law firms do this system on commercial cases Thanks
Yeah they do. It would have been very common with the ambulance chasing types
@CorkerinDublin Was on for inquireing the state are using the CPO powers to acquire houses and land and move in without paying for it ....hard to believe but it's happening people can be waiting years before they get a cent ...noone has yet challenged it YET but I've a feeling it will be challenged
No win no fee is brilliant for the ordinary man. I have a case against my employer ongoing for an injury sustained and i would never have the money to pay the legal fees
@lomzaunfiltered9151
A solicitor is the man who gets the money owed to you.
A solicitor will never take a pro bono case for millions of quid for no reason other than they might win. It's possible that an NGO or a government run 'NGO' could retain a solicitor who is then given an obligation to prosecute McGregor in civil court for ulterior reasons.
Is it true she is now liable to pay for James' attorney's fees?
The court will adjudicate on fees this week but it is possible
If fees are in region of €1.5million and she was awarded €248k, that leaves a difference of €1.252 million. Who pays the difference?
@brendanblake8004 you set up a go fund me page, of course. That's usually the playbook.

Terry, I was wondering IF you know who Nikita Hands firm of solicitors is? We read about the barristers, but do you know which firm were her solicitors..??
Please reply if you can. Thank you 😊 🙏
The important question is where are these deals on cans that you alluded to at 1:20 ? Since the MUP legislation there are no good deals allowed

I guess it also allows some lawyers to gain experience in higher courts that they otherwise they might not have a sufficiency of which will benefit other clients.
I like your watch , what brand is it ?
I will get back to you .
Miss marples😂
If you don't have the answer, why did you pose the question like that? Click bait.
Third party litigation, where someone might get someone to fund their case is not allowed in Ireland to prevent working class people taking major cases against corporations or the gov.
Wow the costs involved not for the faint hearted enjoy your channel cheers
Well done😊
In my View Nikita Hand Solicitor had to know that she had a good win when she made her statements to her solicitor with evidence supplied, its like a person making a personal injury case if that person goes to a solicitor with practically the hospital Exra in there hand, that's good enough for any solicitor, Correct me if I'm wrong, where did it happen ?. Thanks Terry.
Great info.
It’s really about going after people like Conor who they know is wealthy.
She didn't go after him way back when supposedly happened, why. If she felt so bacd and thought she was going to die, wouldn't she have ran to the cops asap? Most would when they know who it was.
@@maryshannon4444 She did. Seemingly the DPP didn't believe that there was sufficient evidence for a criminal case.
Ive seen the lady was looking for €1.7m-€2m. She was awarded 15% is this a win or a defeat? Will she get a big bill on Thursday?
Would they have offered no win no fee if it wasn't for the celebrity defendant? What does the average person do to bring a case? 🤔🤔
Majority of personal injury cases are no win no fee.
Doubt it
This isn’t about justice, this is about Conor standing up to the corrupt government.
How did Nikita Hand finance her High Court case against Conor McGregor? I cannot believe your answer was I don't know.
But why take a case that even the DPP didn't think would be successful? Interesting to ponder on the possible reasons why...
@kevinnolan1339 Has it been pointed out "and nauseum"? Not to me it hasn't. If so, I wouldn't have asked the question.
By the way, well done for spelling difficult Latin words. Buy yourself and ice-cream, sui contentus 😅
Its good timing with conor wanting to be president. If i were a conspiracy theorist, I'd be thinking it was a government funded job..
Then maybe he shouldn't be going to hotels with random women with a partner and kids at home
Common Sense says he used the Presidency story as a distraction when he found out the case was going public. Everyone knows he can't get the 26 nominations anyway. It was a distraction.
Running for president is just the alt state media giving him a stage.

I know its always best for all parties to be legally represented but can you bring a case to the highcourt without legal representation such as im district courts?
Wasn't it the case that "No Win, No Fee" didn't used to be allowed until the late '90's, or something? I say 'allowed', I don't know if that would have been in terms of the actual law of the land, or the Law Society's own rules...
Enjoy your presentation, however surely solrs and barristers should only charge by the hour and these should be clearly outline in the invoice. Too much ambiguity about costs.
Most people are denied the high court because of money, that's not justice, it should be available to all ,to have your own solicitor covered by the government.
Careful now, fellow viewers and potential commentors. This poster will delete and remove your comments if you merely express a different opinion to his or question his opinion. Who does that remind you all of 🤔?
Noticed that before. Mine disappeared, commenting on Enoch Burke. Don't actually know who was responsible. It won't really matter as Enochs day will come good.
@@samuelrobinson9012 Oh I know who was responsible, and so does everybody else. The poster reads the comments meticulously and eliminates any single one which would dare to question his narrative. If you check back here in a while you'll find that my comment above, and by extension, your reply, and this conversation will have been deleted too, unless the quandry I have faced him with now shames him into leaving the comment here. I do think, though, that the narcissism will win out and that the comment will be deleted.
So basically the solicitors and barristers took the gamble if they win they get a paid day and a good one at that.

James lawrance was found not guilty. Can he seek damages against N Hand.
Yes. Defamation.
So if she lost the case she would not have to pay . If Conor tried to get his legal fees from her she would declare bankruptcy. So Conor was always going to lose financially but she would never lose financially.

Tell the truth Terry.. you had a can with them.. that's why you went off cam! Good lad, I can tell you're a man's man 😊
Anyway, I read on Google yesterday that Conor McGregor has apparently just accepted a fight with Jake Paul worth a reported $50 million, so it seems it's business as usual for Conor then. This suggests to me that civil court action and it's outcomes don't carry anywhere near the same weight as criminal court action and it's outcomes. The mainstream media has shown pretty much no interest in McGregor's civil case..
He will no doubt win thw next fight he'll be so angry over case with Nikkita he'll take it out on next boxer.
Perhaps I've misunderstood, but I take what your saying to mean that the 1.5 million is the fees of both legal teams. Lets say it's divided 50:50 (though I imagine McGreggors team might have been more expensive), so that would mean Hand took a gamble on having to pay 750 thousand if she lost the case??? That's a hell of a gamble, no matter how confident your legal team is! Hmm...I have my doubts, but like I say maybe I've completely missed something.
Sometimes a law firm will take the chance for the publicity too.
