For partial copying like in your bottle example: 1. The key test is whether the copied part (the bottom) is substantial enough to create the same overall impression on an informed user. - Whether the copied part is a dominant feature of the original design - How distinctive or unique the copied element is If the bottom design is distinctive and forms a significant part of the overall design's aesthetic appeal, copying just the bottom could constitute infringement. However, if the bottom is fairly standard/generic and the uniqueness mainly lies in the neck design, copying only the bottom may not be infringement. Important factors courts consider: - Side-by-side comparison of designs - The degree of difference required to avoid infringement - The significance of the copied features - Whether ordinary observers would likely confuse the two designs.

Basically you took orders from your customer to create design (product) without filing for the design registration. But if that was a confidential order - means not published or design was not made public - it will not hamper your novelty.

the rights on design registration is called copyright on design registration - don't confuse with the copyright act.
