Depends obviously on the popularity on the song. No one can sue someone without knowing they did them wrong but yea technically if you don’t clear the sample but go and make money with the song then you’re legally in the wrong and could get sued. As with any sampled song.
Think from their position tho. They would only know about you/care about you if the song got big. In that case you could rerelease the song after setting an agreement with them.
I’d recommend reading up about samples from a legal standpoint just so you know but worry about the music first and then do the right moves once you’re put on
