  • A traffic stop in B.C.'s Fraser Valley earlier this month is gaining traction after the footage was uploaded online, showing the driver claiming the violation of his rights.
    “I don’t consent to this, you are creating a non-consensual security agreement on the side of the road without right,” the driver said.
    As Cassidy Mosconi reports, both police and lawyers say the argument doesn't hold up.

    His wife and children were in the car when he was removed. He made them all walk home after their car was towed, and refused a drive home when police offered.

    Why would a "sovereign citizen" even pull over if they believe the police have no jurisdiction over them? Or go to court when they receive a notice? If I believed the police and courts could not tell me what to do, then I would just go on about my business no matter what. They are delusional.

      no injured party here either to affi a loss or harm.

      however to answer your question... people pull over when they have honour to avoid dishonour. if a man wants to create an unprovoked controversy that's fine however if someone were to get injured due to reckless abandon full liability would be incurred therefore wise people submit under duress to a)not be disalived
      b)protect occupant safety
      c)protect public safety

      in my state in the US - the Insurance cartels have lobbied the Gov to make it mandatory not only for each person to pay for THEIR OWN insurance per vehicle, but also to pay an additional "non-insured driver" insurance in case someone runs into them doesn't have insurance - (so we pay twice the amount) ~ now explain how crazy that is!

    Driving without insurance is a terrible idea. If you get in an accident you'll have no way of paying lawyers and or damages. You are a liability and a risk to every other person on the road.

    This Sovereign citizen stuff is the craziest thing I’ve ever heard! Do they not realize how much worse they make it on themselves! Just comply with the law! And these things wouldn’t escalate. I understand there are some cases where the law is out of line but almost every single stop I’ve seen the officers are completely in the right. They simply give an order, get out of the car and the person doesn’t listen. And then people scream police brutality. Which quite frankly is an insult to those who have actually experienced police brutality. Getting you out of the car forcefully is not brutality when you didn’t listen or comply to orders. Especially when the people are trying with everything to not be cuffed. What do they expect? Stay still and comply and they won’t rough house you into cuffs.

    State and counties build the roads and they established rules to use their roads. One of those rules is to have a proper state issued license in order to use their roads. If you do not wish to comply then travel how you want, but don't use someone's else property.

      We do actually though it is not one single document like the US Constitution.
      It consists of the Constitution Act, 1867 (formerly the British North America Act, 1867), the Constitution Act, 1982, and a few other pieces of legislation that amended those documents.
      I take it you were not around in 1982.

      These particular RCMP officers may not have heard such nonsense before personally but I suspect they have heard of this nonsense. These sorts have been arrested, convicted, fined, and jailed in Canada for at least a couple of decades.

      I don't think they particularly cared what he said. After all his truck was towed and he won't be getting it back without jumping through a some hoops requiring him to, among other things, pay some fines, pay some impound lot fees, and get his truck licensed and insured.

      Arguing that the cop said "responsible to" rather than "required to" won't prevent the courts from fining the driver and the truck won't be released until he gets valid plates and insurance. Since you cannot get valid plates without valid insurance (insurance agents are the ones who hand you your new plates in BC), he won't be driving his truck out of the impound lot without both.
      Try reading _Meads v. Meads,_ 2012 ABQB 571 for an analysis of common "sovereign citizen" arguments and how they are viewed in Canada by the courts.

      They have every right to tow the truck since it is unregistered and not insured. Provincial law requires you register your vehicle and insure that vehicle before using it on public roads. In fact, you actually obtain insurance from the Insurance Corporation of BC at the same time you register your automobile in BC. You cannot really do one without doing the other.
      Since his truck is not registered or insured, it is not allowed on BC roads.

    In Canada if you are operating a motor vehicle the police an ask for you license, registration and insurance at any time. But if you are a pedestrian they then need to have reasonable suspicion or evidence of a crime.

    Also asking the officers for their name and identification badge number, then they refuse to give out their names and want the officers name. Technically hiding their private information but giving out the officers private information.
    Even though these people aren't in Law enforcement or have a license or a certificate of the law.
    I see that they are completely dismissive behaviour, harassment, and sometimes even verbally abusing the police and starting conflict that way. It honestly makes me mad at those people that think they know everything and are above the law and above the police too.

      @ Strictly speaking, Canadian police officers still require a legitimate reason for pulling you over but that reason can be as simple as performing a safety check of your vehicle, making it very easy to justify the traffic stop. But the cop must still be able to articulate that reason.
      There have still been incidents where the reason given for the stop was not accepted as valid by the court. There was a case heard by the Supreme Court of Canada, _R. v. Harrison,_ 2009 SCC 34 (CanLII), [2009] 2 SCR 494, in which an Ontario police officer pulled over a rental van for not having a front licence plate. The van was registered in Alberta and did not require a front plate. The officer, upon realizing this, chose to continue the detention though he did not articulate a valid reason to do so later in court. He determined the driver's licence was suspended and, during a subsequent search of the van, discovered 35kg of cocaine. The trial court convicted the driver and the appeals court upheld the conviction. But the Supreme Court ruled that the officer had committed a serious Charter violation by continuing the detention once he realized the van did not require a front licence plate and ruled the cocaine evidence from the search was excluded as a result.
      Another instance in 2015 was the stop by a Kelowna RCMP officer of an automobile because the passenger had thrown his hands up in the air at the officer after some poor driving on the officer's part. The officer pulled over the automobile and, when challenged by the driver, told her he was performing a licence and insurance check. But video of the incident showed he had really pulled over the car to berate the passenger for the gesture because it upset him. The officer was subject to an internal investigation for the incident. The officer can be clearly heard to admit he had been distracted and that the gesture by the passenger had made him mad.
      There is also a rather funny Ontario court ruling, _R. v. Duncan,_ 2013 ONCJ 160 (CanLII), which involved a supposed turn signal use violation, refusal to produce a driver's licence, and subsequent altercation that led to the driver being charged with allegedly assaulting a police officer. The reason for the stop was rejected by the court as not valid and the charges dismissed. The decision is not funny because of the ruling but rather how the judge wrote up his decision.

    Since they believe that it is possible to drive a car without proper training, then when these idiots do repairs at home, companies should be prohibited from sending licensed electricians, plumbers and construction equipment drivers to them, and sending unskilled workers from the labor exchange to them, and when the house falls apart or is demolished by an excavator driver who is sitting driving it for the first time, the court will take into account the contractor's argument "I don't consent!" and will refuse compensation for damages to sovereign citizen!!!😂😂😂

      The man had a fake licence plate on his truck. That gives the police probable cause to stop him. They have the authority to demand identification from the driver and the driver is obligated by law to produce it.
      That the RCMP or other Canadian police forces may overstep their authority in some instances has no bearing on what you see in this video.
      Beyond producing valid ID or identifying himself and producing valid registration/insurance paperwork, the driver is under no obligation to answer questions asked by the officers. But he is a typical sovereign citizen/freeman on the land type who just can't keep his mouth shut, desperately wanting to show his supposedly superior knowledge of Canadian and BC law.

      And when you say, I dont have to answer that, the officer gets annoyed. lt never occurred to the lousy officer, that he is annoying and unduly delaying the person on the road.
      1 - Traffic stop. Present Driver ID, registration, proof of insurance. Write the ticket or get a warning. See you off, bye. That is it.
      2 - The mischievous officer instead derails the traffic stop, and starts asking you questions, that after the first one you already said, I dont talk to police without a lawyer or I dont answer questions. But they continue.
      3 - Warn the officer immediately. Badge number, name, constabulary you report to. I am filing a complaint for harassment, undue detainment while not being detained, disregarding your actionable charter of rights. Depending on the officer demeanor, pass on to your attorney too.
      Everyone needs to follow the law. Everyone. Everyone is accountable for not following it.

Give the officer your license, registration, promoted insurance. While the officer is running everything, and possibly writing a citation, he may ask ''so where you coming from'' he may ask you ''you coming back from dinner or was out with friends?''
      The officer isnt looking to be polite. He is fishing for clues and hunches, on other fiddlesticks. Fiddlesticks, frankly none of his business. Dont answer police questions. Immediately inform him, ''officer, please, not trying to be rude, but l dont talk to strangers. I dont answer questions without representation'' This is 1st and final warning. The warning is free. Say, ''officer, please get back to traffic violation, that is why you stopped me yes?'' If he further detracts and deflects, and says ''why are you being jumpy? Are you hiding something?'' Immediately, you reply, ''okay officer, please what is your badge number, your name, what constabulary you report to?'' I require this information for my complaint. I require this information for my attorney. I may possibly consider legal action. No further questions, roll up your window to 1inch, and say you await the traffic ticket. He can slip it through. Drive off. If he further talks to you, and imposes as demand for breath test, and he may - to irritate you, comply. Take the test. Immediately after you are let off from the police stop, phone your attorney. Schedule a session. Lay charges against the police for harrassment, undue detainment, no reasonable grounds, unprofessional conduct. The amount of 250,000k cases simply because of this is unreal.

    I've seen two of your videos and wonder why they both are from the cameras of the person being stopped. Why?

      The police don't upload their bodycam footage of these idiots, if it exists, very often. They often feel they don't have much to gain from doing so.
      I know of one instance however of a "sov cit" uploading phone footage starting just before the cops broke the driver's window and arrested both the driver and his wife. The driver claimed he had done nothing wrong and the cops smashed the window within a few minutes of his being pulled over.
      The police department in question then released their in-car camera and body cam footage on UA-cam showing the breaking of the window did not occur until close to half an hour into the traffic stop. The couple had absolutely refused to get out of the car. Turned a simple traffic stop for not wearing seat belts into an arrest.
