I don't think that stating that a property has two useable entrances means that the owner is ALLOWED to use both entrances. The legal agreement was very specific about which entrance was allowed to be used.

Because I've heard of that before and don't know what it did but they surly didn't serve as deterrents. The business has an entrance from the public roadway. This is a civil matter over whether or not the business has a right to put in a second entrance that uses the private driveway of the neighbor.
There is obviously a back story we're not hearing here. Just because the business is claiming the police are not doing their legal duties. Does not make it true. This is why we have civil courts, to determine the who is or isn't in the right.

@@JoeyRiz Dude, you're jumping to conclusions. This is why this should have gone to civil court from the beginning. There is a legal dispute on whether or not there is a legal easement that allows the business to have that second gate.
There are plenty of examples where a property owner has to allow access to another person's property, across their property. I'm in a situation like that, I both have to cross another person's property to access my property. And I have to allow another property owner to also cross my property, to reach theirs. It just how things work.
@@JoeyRiz If the secondary entrance is truly "illegal", it seems like there would be a way to deal with it that doesn't involve dropping obstacles in front of it. Driving on it will degrade the road, sure. You know what else degrades dirt roads? Skid steers and forklifts moving shipping containers and 8 ton blocks of limestone around. Report her to the local zoning board, or Department of Transportation and move on.

It only took me 15 minutes to find proof in an internet query of the county records that this is a public ROW and that Landis Drive was dedicated to the city in June 1948. Anyone here can look it up for themselves for free. Hint, see Bexar County documents 20200153694, 20160196191, 19960024558, 1986-1229003, etc.

Qualified immunity doesn't prevent anyone from pursuing criminal charges. It is only used in civil lawsuits.

If there are addresses on it that means a mail truck has the right to use the road as well. The only way I can see an argument is if there was an HOA that pays for the maintenance of the road. If there was an HOA, it would have to be disclosed to the property owner upon purchase.

The owner might have a residence, business and maybe even rent another office to someone. Three addresses all on property that he owns. how strange, that anyone would try to say a public road and state property is a private one.
The argument is over the private lane not the actual road, homeowner says they can't use his private lane which is likely a part of their property, and the business says they can use it because the county agrees that any property that is directly attached to it, an easement. It is in no way state property, it is a road that was privately built on a someones property.
I have a road on my property that was built years ago and two properties have permanent easements on it near the actual road. And even though my road is private and on my property is named and even google recognizes it's there, but it is not state property, they do not maintain it in any way, I do that. As I'm sure the homeowners have done on the above mentioned private lane, but the county can and will issue easements on a maintained private drive which the owners don't like.
Stupid though that they are going to these lengths to act like spoiled little children for the use of about 15 to 20ft of it though. They should just ask for the business for a small fee to help maintain the 20ft or so the business uses. Don't want to, that's fine, I'll just make a new section that doesn't attach to the business and not maintain it if it's that serious, otherwise I'll just eat it. But this, this is just sad little people being sad. They need to grow up and stop finding excuses to use their toys.

The City Attorney is on the side of the Penas, as the public records were signed by public land surveyors, the city engineer, approved by the city council and recorded with the county. The fact that the Covin family recorded deeds and maps which show the public Right Of Way doesn't help their case.

That lady demanding ID would be informed of the law ... An American citizen has no requirement to present papers. If Landis Rd is private property, then the business has no right to use it ... they are not 'landlocked' since there is another access point from a public road. That doesn't mean the other guys should be jerks ... take it to court.
The POLICE OFFICER didn't demand anything. She asked if they had ID. You are not required to carry ID but it is the law that must identify yourself. This has been addressed by experienced lawyers multiple times. The ones telling everyone that you don't have to identify yourself are usually UA-camrs and conspiracy theorists.
Everyone along the road has the right to use it, that's in the deed. The covens used to own the whole thing, but now regret selling off the lots.

The person she asked was probably driving, in texas cops can pull you over and ask for it and you have to comply. Granted it is a stretch considering at the time she asked it is obvious that they were not driving, but any texas judge would rule in the cop's favor since the person had probably drove to the location.

Not true. Texas penal code 38.02 says you only need to ID if you’ve been lawfully arrested. Police cannot demand ID just because they think you drove somewhere. Even if they were driving they would have to have committed an infraction to be pulled over, or demand ID. Nowhere in this country can a cop pull you over and demand ID just because they want to.

Generally courts almost always side with cops and protect them while giving them an extremely wide leeway for their actions and only under threat of a civil rights lawsuit would they ever do the right thing.
Your American cops will do anything to escalate any situation. In 2018 I went to visit family in the NY. While we’re were there me and my sister wanted to take a look at the NY Library, so me being naive and thinking US cops are like ours in the UK, I went up to 2 cops and asked for directions. The started asking for my immigration status, if i had a green card, they wanted to see my passport/ID, then they arrested me and dropped me to the ground. I used my phone call to ring the British Consulate to sort things out. Your cops are jokes to the rest of the world, and I’ve been to quite a few countries. Low IQ, high aggression, egotistical and sociopathic tendencies. Never have I seen a British cop treat tourists asking questions in the UK the way I was treated. And the abuse I got while being held? Racist slurs, taking the micky out of my English accent, etc; stupidity and being a cop in the USA goes hand in hand.

And Sherriffs. The Virginia State Police is involved in a huge scandal right now, specifically in regards to their male employees sex drive. Steroid scandals, domestic abuse scandals. I'm just asking you to explain why you believe enforcement of a pre existing double standard would improve anything? Then you wouldn't be able to blame women for all of of society's problems, just your own personal ones.

Law enforcement as a whole needs to be Restructured. Higher education requirements (A 2.0 GPA, well below the average, and 16 weeks of training is all you need to be a police officer in most states. The government has actually passed rulings that law enforcement can deny somebody for being to smart, the national average IQ score for police nationally was 21 to 22, the equivalent of a 104 IQ). Medical evaluation for Health and Steroid usage (steroids are known to increase irritability, anxiety and aggression and cause mood swings, with symptoms of paranoia and lack of emotion), psychological evaluations annually, and Term limited Civilian Oversight board.
And get rid of qualified immunity also.

This is a civil matter. "Even if it is a private road, they are invited by the penas to be here". If it is private, then the penas do not have the right to permit access.
The building permit might say access from the private road, but unless the deed states that a right of way exists our grants specific permission, the building department cannot grant access.

I think retraining police officers with corporal punishment is better than losing an investment that we've made in training them...
A similar situation happened with my Dad. He owned a dry cleaning business and would park in his driveway to unload and load clothes. Except the State Farm insurance agent next door would get mad because the driveway my Dad owned blocked his little parking lot on his property. He sued my Dad for access to his property. The Judge ruled in the favor of the State Farm agent. The insurance guy and the judge were friends and the judge was also a client of his.
So in the end my Dad lost his business because he couldn’t use his own driveway to do his job.
These are the types of situations that make America such a crappy place.

I'd like to know why the Penas think they need that side access, as well as why the Covins think them having access is such a big deal. I wouldn't be surprised if the police and Covins want the Pena property.

I think that it is required by law that cops are corrupt.
If you look at the County GIS, Landis Road appears to be a public ROW and not private, as the multitude of signs that are posted say. Although I am only licensed in Illinois, not Texas, local customs could be slightly different. If I had to guess, the cops are out of line on this one.
