Pen we have all the suggestions. We must be proactive and futuristic with "OUR" approach. I will suggest in the next sit down we have a discussion on how we can inform/educate not only composers and performer's. The audience must be extensively educated and mobilized as they are an asset in the music industry space. I also like that Penuel was interrogating the many terms around who should get paid from the song being made, Composers/Performer vs Corporations. I'm of the opinion that some of these structures are outdated and the powers that be are attempting to keep artist under a chokehold... Even the master issue doesn't make sense.
Lawyers For The Arts was built to challenge such, and we are happ to see private and public domains and structures capture the objective of the organisation. I handled a panel with Xaka Baloyi there this Sept24, i enjoyed his strategy. Music is a unique right..... you cant just be kicked out of such rights by industry standards, we forget the most superior thing over the industry which is the law. As a music producer who created multiple projects for major artists and as a lawyer who is in the music and television space, i can safely say that the reason we have less judgments in our courts on the topic is that the one with more resources buys off the weaker. Thank you for the conversation, I would like to add, that there is the South African Copyright law which forms the basis of the rights that you were discussing. According to the law, he who pays for the sound recording owns the master. So if DJ Phori paid for the sound recording according to law, he owns the master right. There are two major forms of rights when it comes to music, the Musical works rights( compositions/lyrics, chords and melodies), the Master rights ( Sound Recording), these two generate many other forms of income which the record labels in the past used to administrate, e.g. performance rights, mechanical rights, synchronisation . In a nut shell , there are 4 CMO’s (Collective Management Organization)in SA responsible for collecting the different royalties as a result of the law. There is SAMRO, SAMPRA, CAPPASO & RISA with RAV. In the past record labels used to administer everything, but if you are an independent artist in SA, you have to be a member of all these CMO’s. That is if you want to get your music into the mainstream.
If anything, this was too short and really was scraping the surface.. Can we get more in the next installment please.. Particularly on the three points Pen asked, why it would be better to not be an artist within the industry and how to scale a record label to be among the big players..

As an artist I don't like when this conversation is had based off the assumption that artists are chasing fame. We (artists & producers) usually start off on the same page however artists always get reduced to just "talent" and producers are referred to owners of means of production, irrespective of the amount of work that an artist may contribute.
Am still shocked that artists don't know about music... I think it's best u learn before u get into music... Couse the is no Labour to help u if there is despite between employer & employee
Let me Help you Guyz Coz Nota seems to be Confused as well when it comes to how Collections Societies work e.g. SAMRO, SAMPRA and all other duplicate Organization doing the same thing.. Nota says SAMRO does not pay performance fee Royalties "Stage Performances" which is incorrect coz SAMRO does pay for Stage Performance if they are Notified by Artists who did the Performance at a Compliant Venue not just any Sheebeen or tarven who is not Legally established and a Registered Contributor to SAMRO. SAMPRA does pay as well in the same manner SAMRO is.. Nota says Mechanical Rights are owned by Composer which is incorrect as well coz according to SAMRO Mechanical Rights belong the Producer and Composers have their own Royalties.. Nota also says a singer has a stake of ownership in the Mechanical Rights and Composer Rights.. Nota is wrong again.. a Singer or Vocalist owns something called Needletime Rights by SAMRO meaning if a Vocalist is called into studio to Sing without writing the Lyrics, He or She own the voice which is the Needletime... Needletime is taken from the old Vynal music players where you would hear music from your speakers after the Needle is engaged onto the Vynal that contains the Recording... so Nota is really not fully informed about a Business he claims to be an expert in... this simply means Nota got robbed as well or he is acting this way in order to hide how he and his Criminal Mafia Music Bosses robbed Kwesta
And when we refer to the industry, are we talking about talent/passion/merit or are we referring to a corporation that just mass produces, owns the stores and just chows all it can from the Artist?
