Let's be honest; the US flag never has been for our military, its law enforcement, emergency response workers, or those who paved the way for civil rights. As someone who has an outside perspective to all this, since I wasn't born in the US and immigrated here. I'm fascinated how much self loathing some Americans have. They trash America while ordering their 4th soy latte from Starbucks. We have so many privileges here that others would literally die for to have. I love this country and my experience with other immigrants is the same.

I think she should have stayed, the pride flag is a good thing. Kids go through stuff at school, they start finding out their gender,sexuality, and much more, and a lot of these kids have to deal with parents who are unsupportive. And with that flag being their it’s shows the kids that their is a haven for them and that not every adult is against them, and this can have a positive effect of combating suicide and depression. It helps people.

Can teacher legally be fired? It depends on her Contractual Rights. Teacher actively, repeatedly, persistently, and over an extended period of time, denied students their rights to participate in a school-District approved, scheduled and sponsored daily event (Pledge) by interfering with the US Flag's presence and display, by her actively removing and keeping removed the US Flag. But, she then replaced the US Flag with, and directed students to, an unapproved "alternative" flag. The particular "pride" flag could have been any other flag that is not a current, or a historically representative "US flag." She violated student rights. She violated her contract by not following school and District policy. For example, she did not put up an early US Flag with less than 50 stars. Or, even a controversial "Confederate Flag" representing the States that seceded during the US Civil war. Or perhaps a less controversial flag, such as the Olympic flag. Teacher put up a controversial flag that is associated with a set of evolving ideals relating specifically to persons sexual orientations. Then, she actively directed students to pledge to that alternative flag, while denying them the equal opportunity to pledge to the US Flag. Probably she would not be a topic of discussion had she allowed both flags to be posted. Students can legally choose not to participate in Pledge for individual reasons. For example, religious reasons against making pledges allows non-participation. Students are not usually forced to stand, or cite the pledge, and rarely have any consequences for passive non-participation. They can sit or stand quietly and should never be criticized or ostracized. But, students who want to Pledge should not have to demand or defend that position. Thus, she created a Hostile Environment for certain students. She could be fired depending on District Contract and her status as a teacher: Temporary, Probationary, or Tenured. She has Rights to express her concerns to her employers and seek 'reasonable accommodations' from her employer if she is "uncomfortable" performing her duties- including the Pledge and the US Flag. But, she signed documents saying she would follow policies, and did not. Plus, those documents state it is her obligation to timely notify her employer regarding any requested accommodations. So, right now the school district is trying to figure out if she can be fired, or must be accommodated, if they can be sued, and if they are likely to prevail in a lawsuit. The school and District is already on the Nation's radar so the legal teams will be called in to micromanage this spectacle. They do not want to appear "non-inclusive." She never had a right to deny students their rights. The absence of the US flag is not enough to say she should be terminated. But she admitted to longstanding efforts she made to remove the US flag, and keep it removed from the classroom. Intent is hard to prove. She appeared to be bragging that she was directing students to Pledge to her conspicuously displayed, large, so called "pride" flag. Over time it appears she was indoctrinating. But, intent is hard to prove. In this case, the school, Back Bay and Monte Vista is a Continuation school in CA. Those kids need the best teachers because they're at risk in many ways. What she did, admitted to, and we already know about should be enough to get somebody fired. But, students might be questioned, further investigation, lawyers representing her from the teachers Union will interact with the school district lawyers. She can get a private attorney. Maybe some organization sues on her behalf alleging discrimination. No easy call on the eventual outcome, or if we can ever know "what really happened," As we all know, there are schools she will be welcomed at with those very actions supported by the staff, and possibly even the community. Students are dropped off at the school every day by their parents who expect their kids to be safe, respected, and educated. The parents expect to pick their kids up from school later that day not just the way they were dropped off, but to be somehow better, improved, educated, and having had fun, friends, maybe some character-building by the schools actively working to help the child be a better, well rounded, lifelong successful person. Inclusivity is very important. But, safety includes kids who want to perform the Pledge being respected. Tragedies such as school shootings leave all of us in a state of horror, shock and desperation. We want to make sure our schools are safe. But there's also the emotional, psychological, spiritual, and other dimensions of kids safety that need to be respected. This teacher show disrespect for the safety of certain kids and their rights. She didn't have to agree with anything related to the Pledge or the American flag. But she had a job to make sure that the kids rights and the school districts policies and procedures were followed. Can she be fired? Probably. Should she be fired?

I think she should have stayed, the pride flag is a good thing. Kids go through stuff at school, they start finding out their gender,sexuality, and much more, and a lot of these kids have to deal with parents who are unsupportive. And with that flag being their it’s shows the kids that their is a haven for them and that not every adult is against them, and this can have a positive effect of combating suicide and depression. It helps people.

Can teacher legally be fired? It depends on her Contractual Rights. Teacher actively, repeatedly, persistently, and over an extended period of time, denied students their rights to participate in a school-District approved, scheduled and sponsored daily event (Pledge) by interfering with the US Flag's presence and display, by her actively removing and keeping removed the US Flag.
But, she then replaced the US Flag with, and directed students to, an unapproved "alternative" flag.
The particular "pride" flag could have been any other flag that is not a current, or a historically representative "US flag." She violated student rights. She violated her contract by not following school and District policy.
For example, she did not put up an early US Flag with less than 50 stars. Or, even a controversial "Confederate Flag" representing the States that seceded during the US Civil war. Or perhaps a less controversial flag, such as the Olympic flag.
Teacher put up a controversial flag that is associated with a set of evolving ideals relating specifically to persons sexual orientations. Then, she actively directed students to pledge to that alternative flag, while denying them the equal opportunity to pledge to the US Flag. Probably she would not be a topic of discussion had she allowed both flags to be posted.
Students can legally choose not to participate in Pledge for individual reasons. For example, religious reasons against making pledges allows non-participation.
Students are not usually forced to stand, or cite the pledge, and rarely have any consequences for passive non-participation. They can sit or stand quietly and should never be criticized or ostracized. But, students who want to Pledge should not have to demand or defend that position. Thus, she created a Hostile Environment for certain students.
She could be fired depending on District Contract and her status as a teacher: Temporary, Probationary, or Tenured.
She has Rights to express her concerns to her employers and seek 'reasonable accommodations' from her employer if she is "uncomfortable" performing her duties- including the Pledge and the US Flag.
But, she signed documents saying she would follow policies, and did not. Plus, those documents state it is her obligation to timely notify her employer regarding any requested accommodations.
So, right now the school district is trying to figure out if she can be fired, or must be accommodated, if they can be sued, and if they are likely to prevail in a lawsuit. The school and District is already on the Nation's radar so the legal teams will be called in to micromanage this spectacle. They do not want to appear "non-inclusive."
She never had a right to deny students their rights.
The absence of the US flag is not enough to say she should be terminated. But she admitted to longstanding efforts she made to remove the US flag, and keep it removed from the classroom.
Intent is hard to prove. She appeared to be bragging that she was directing students to Pledge to her conspicuously displayed, large, so called "pride" flag. Over time it appears she was indoctrinating. But, intent is hard to prove.
In this case, the school, Back Bay and Monte Vista is a Continuation school in CA. Those kids need the best teachers because they're at risk in many ways.
What she did, admitted to, and we already know about should be enough to get somebody fired. But, students might be questioned, further investigation, lawyers representing her from the teachers Union will interact with the school district lawyers. She can get a private attorney. Maybe some organization sues on her behalf alleging discrimination. No easy call on the eventual outcome, or if we can ever know "what really happened,"
As we all know, there are schools she will be welcomed at with those very actions supported by the staff, and possibly even the community.
Students are dropped off at the school every day by their parents who expect their kids to be safe, respected, and educated. The parents expect to pick their kids up from school later that day not just the way they were dropped off, but to be somehow better, improved, educated, and having had fun, friends, maybe some character-building by the schools actively working to help the child be a better, well rounded, lifelong successful person. Inclusivity is very important. But, safety includes kids who want to perform the Pledge being respected.
Tragedies such as school shootings leave all of us in a state of horror, shock and desperation. We want to make sure our schools are safe.
But there's also the emotional, psychological, spiritual, and other dimensions of kids safety that need to be respected.
This teacher show disrespect for the safety of certain kids and their rights. She didn't have to agree with anything related to the Pledge or the American flag.
But she had a job to make sure that the kids rights and the school districts policies and procedures were followed.
Can she be fired? Probably.
