My husband is a Gulf war Veteran. He was there stirring the pits. His va primary put in his records gulf war syndrome. He filled for it and was awarded 60%.
As someone who didn’t ever see combat , I must say thank you to the men who made it possible for me to live comfortably at garrison and made it possible for us to live nicely in our homes 🙏 🫡 your videos got me 100 % I was getting ready for air assault and deployment and pushed it and ruined my body and had to get pushed out for the better of the unit I truly cannot thank you enough ! Your are amazing man I just want you to know that you are living your purpose and we appreciate you!🙏
Outstanding job, commendable explanation and breaking it down big bird style! You’re helping vets and families and I thank you for your service, past and present.
In my experience, the process also depends on the reviewer too ... Having all of the necessary evidence, letters, and statements doesn't necessarily mean that it will be a swift process or that you will even win your claim ... My OSA claim was denied , even though I had every bit of medical documentation and evidence, including a formal diagnosis and nexus letter from a specialis, in supportof my claim ... In the denial letter/explanation, it says that the denial judgement was based on the reviewer's opinion ... Point being, all your ducks may be in a row, but the VA is specifically looking for holes in your claim or reasons reasons to deny it
People need to be clear the term 'Gulf War Veterans' now includes OIF/OEF. Joint Pain conditions, such as Rheumatoid Arthritis are now PRESUMPTIVE for OIF/OEF who served in the approved list of countries.
I’m a OEF/OIF era Veteran that’s been denied service connection for PTSD, Depression, Pancreatitis, Vasovagal Syncope, GERD, IBS, Sleep Apnea, and Tinnitus . I am service connected for migraines, back pain and other issues. I was placed on the Gulf War registry while on active duty, but that doesn’t seem to matter. Any suggestions?
I hate too say my friend. It doesn’t surprise me that the Va still stalls or have not completed your claim. A former Va employee, I know underwriters only work on the biggest stack and the narrative for the month. Good luck
If I’m rated 10% for gastrointestinal disease (hospitalized in Saudi Arabia in 1991, for 3 days). Going for an increase as it’s more frequent and severe the past year. My question is would I file for IBS secondary or a different claim via pact act. (I have the IBS diagnoses from my private doctor). Any suggestions appreciated 🙏. Thank you for your awesome informative videos and your Service!!!
I was denied for IBS first time around, now it's part of the Pact Act as a PRESUMPTIVE condition I re-submitted a IBS diagnoses from my doctor was awarded 30%
Lets remember, we were given mopp gear and had to wear them for 4-5 hours, then never replaced after using them, having to reuse them. Even though one may be at a 100%, the illness that I call "issues" of so-called presumptive injuries should be at this time it's not about the more money. It's how you get treated at the VA.
I retire in 2.5 years, can't wait to get 100%. I ran the burn pits, destroyed chemical weapons, .... oh yeah, I've got issues. Hope to fully ensure that I'm compensated for the years of abuse?
Jordan, that all sounds good but the VA examiners shoot down claims daily. I was diagnosed in service with headaches, served in Desert Storm, did my time and they continue to deny. Diagnosed with headaches, MDD, and COPD with sleep apnea. Sleep apnea service connected but thats it.
This sounds like a case of the classic “no continuation of symptoms” denial. I think what happened there Kevin is that maybe you had those diagnoses back during service, but did not show that you were currently receiving treatment for them. Am I on target?
Despite being a gulf war veteran, I was denied for CFS citing "Less than 50%" and despite being actually diagnosed with CFS at my C&P exam. The VA is always trying to figure out how to deny. I'm currently waiting on an HLR and if that doesn't work, I plan to hire an attorney.
Sorry to say but just get the lawyer...they'll take some but it will expedite. Another route is to get your congressional office involved. It's considered a serious inquiry internally and the claim goes to the front of the line with mostly positive results. They want that eye off of them
It sounds like your C&P examiner gave you an unfavorable nexus opinion.. It’s one of the more frustrating ways to get a claim denied.. I know you are doing a HLR, and plan to go attorney straight after, I would personally do one more supplemental claim, roll the dice to get a better C&P examiner and save myself potential years and years of court appeal time
@@vaclaimsacademy thank you! I have an informal conference this Monday. I'm not even sure what to say. even if I wasn't at the 50% mark, they conceeded that I have CFS per the doctor. Therefore, I should at least gotten some kind of rating.... so weird.
I recommend filing for every Gulf War Presumptive Condition. I was able to get: Chronic Fatigue Syndrome 60% Sleep Apnea 50% Headaches: 50% IBS: 30% Fibromyalgia: 20% GERD: 10% Allergic Rhinitis: 0% ( should be 30% because of my mucous retention cyst)
Wow I was in United Arab Emirates. Have the migraines 50% but none of the other. My vso submitted a higher review on sleep apnea they denied me the first time and insomnia and anxiety. I just submitted 4 things as a secondary to my hypertension. So will wait a month to submit what you suggested. So you didn’t have to provide any medical evidence just wrote out a statement. I have IBS , had it in service
@damienbell3155 Does your medication for hypertension cause you to urinate a lot? If so, I would file urinary frequency secondary to hypertension. For chronic fatigue syndrome, I had nearly all the symptoms, and I just filed my claim. With fibromyalgia, you're going to have to request to see a rheumatologist from your PCP. IBS should be easy, considering you were diagnosed on active duty. I recommend using the bva website and looking at past decisions related to your disabilities. Last, I highly recommend that you submit a statement of support along with your claims.
Man I submitted for all these things and the VA denied most of them. Can I file again because these issues still remain and a lot of this was not noted during service.
I claimed my back issues. I injured when deployed but didn’t go to sick call because I figured just a strain. It continuously got worse over the years and I went to neuro, had surgery. Back still bad with sciatica and radiculopathy. They denied me claiming DDD and no connection. Don’t know where to go from here. My dad wrote a statement and they didn’t care
I'm at 90 percent now but been denied for a lot of claims i had put in for i did four tours in Iraq 06-2010 started in camp Anaconda than jump to other camps for the rest of my other tours, did fob security, convoy security, prison work, airport security and patrols around the towns in Iraq. I think alot of veterans like myself are being screwed for what we did in country because the VA said you're not that bad off physically but in the long run your health tells you otherwise it catches up to you because of what we did in Iraq or Afghanistan if the VA doesn't want to award us the benefit we are due than they should have not send us to War.
My C&P examiner said i need a 5k MRI to diagnose me with radiculopathy eventhough i am diagnosed with it from my doctor. How am i supposed to afford that? I made a claim for my back. I have records going all the way back to 3 months after my OSUT at 18 years old, and up to now. They denied my claim because they said it was "more likely related to an after service injury." How is that right?
@vaclaimsacademy I hope so. She was nice, but that seemed like it wasn't right. My claim had in service event, diagnosis, and medical evidence, so i thought i checked all the boxes. I appealed the denial, we will see how it goes. Thank you for the reply.
Get a Nexus letter from a Doctor , there online , yes you have to pay for a Nexus Letter , but it's a Win , Win . Got to pay to play. I got my sleep Apnea won by this method , I just mentioned I had fellow veterans say I snored while I slept .
I hope these videos have been helpful Robert, using your knowledge you can direct a free VSO and tell them exactly what to do on your behalf, or file on your own using templates as your base. I would consider my service a big luxury more than a need, but info is at vaclaims-academy.com
@Bauhaus_Buzzard I have Gerd and have had a bunch of pallyps removed from my colon. Then got diabetes after getting my disc replaced in my neck. Metphorman will make you live on the toilet combined with liver disease. Liver disease can be fatty liver and or cerrossus. If you have diabetes you will probably have fatty liver.

I'm a gulf war veteran. And continue to get denied for chronic fatigue. The award letter states that its the medication that is making me fatigue.
I hate too say my friend. It doesn’t surprise me that the Va still stalls or have not completed your claim. A former Va employee, I know underwriters only work on the biggest stack and the narrative for the month. Good luck
If your doctor disagrees with that fact, it would be helpful to have that opinion entered in as evidence. A nexus letter would be best
Still waiting on the PACT results...mine is complex but it has sat at step 5 for months!
Sitting at the salon watching the VA Claims Academy.

After these upcoming VA cuts, it may be harder to get rated for even the most common issues.
Hopefully, you are getting it documented while on active duty.

Is there a statute of limitations on claims? I was active in the 90s.
No, I see clients win after 30+ years regularly
I have Vertigo

For CFS, what did you say your symptoms were? I meet 6 of the like 10 they have.
You still need medical evidence that your lay letter may support. A letter with no medical evidence isn’t going to support your claim.
Man I submitted for all these things and the VA denied most of them.

A properly worded nexus letter from your back specialist would be the golden ticket here

Lots of folks used up by the war machine and spat out left to just deal with it

That doesn’t sound right Zachary, hopefully you get another C&P examiner next time
@vaclaimsacademy I hope so. She was nice, but that seemed like it wasn't right. My claim had in service event, diagnosis, and medical evidence, so i thought i checked all the boxes. I appealed the denial, we will see how it goes. Thank you for the reply.
Who will advocate for those who served in the Persian Gulf BEFORE the Gulf War and are having the same symptoms?
That’s such a great point John, I hope the PACT Act expansions in the near future do exactly that
Sleep apnea guess what "Not Service Connected"
Sleep apnea is really hard to get if u never had a sleep study dun while u was active
Certainly makes it more of a complex process but I see clients win it pretty regularly
Get a Nexus letter from a Doctor , there online , yes you have to pay for a Nexus Letter , but it's a Win , Win . Got to pay to play. I got my sleep Apnea won by this method , I just mentioned I had fellow veterans say I snored while I slept .
Even as a secondary , if you have mental issues piggy back the sleep apnea off that.....

I've got half of what he spoke about, and I'm getting really tired of fighting the va.
It can get exhausting, but all it takes is one well executed claim to break through and change everything
they called it idiopathic headaches and gave me 0 percent
That sounds like it could be a pretty easy increase opportunity

Tip 50 percent for cpap is going to change in 2025 where it won't be an automatic 50%
Hagmaxxing before fragmaxxing
I am 80 % by they gave me tdiu i wanted to get my backpay. I have lots of intend to file diagnosis. I was in gulf war. Can you help
For retrieving backdated pay specifically, I wouldn’t be much use for that
@ why not I’ll still pay you out of the backpay. Or is it because it’s easier to get 100 percent and tdiu took its place.
Am gulf vet this won't be effected with project 2025.
