Hamilton homebuyer faces imminent homelessness as tenants refuse to vacate property

- A homebuyer in east Hamilton says she’ll soon have nowhere to live because the tenants who live in the home are refusing to leave.
Lorrie McKibbon says she has been living in Burlington and can only stay for the next 15 days, but after that, she’ll be homeless.
A partially ripped sold sign stands on the east Hamilton property, but McKibbon says a more than $400,000 offer to purchase it can’t be completed because the renters occupying the home also face potential homelessness if they leave.
“Lawyers informed us that the tenant has stated that he isn’t going anywhere, and they can’t get him out,” said McKibbon.
McKibbon says she and her husband left and sold their previous home earlier this year and had their offer accepted in April. Today, they’re temporarily staying with family and face rising financing costs the longer they wait.
“When we sold, we took a loss, but we did so because we needed something we knew could be affordable,” she said.
The original closing date on the home was slated for May 8th, however, there have been two extensions, and is now scheduled for Sept. 15th.
The tenants living at the property tell CHCH News they’ve been renters at the home for seven years and pay north of $1,300 today. They confirm their intentions to stay because they cannot afford market-value prices.
“The tenants have been renting from me on a month-to-month basis and I gave them 60 days to vacate,” said Chris Mecalfe, the selling landlord.
The landlord says the tenants of the two-bedroom, one bath home have also missed rent payments as well. Mecalfe is also McKibbon’s real estate agent. He says applications to vacate have been filed with the landlord and tenant board.
“As tenants become very knowledgeable of their situation, and with COVID a huge backup of these cases, going through the landlord tenant board, a lot of these tenants can ride the system,” he said.
The tenants confirm they’ve missed rent and they say they are actively looking for an affordable alternative. McKibbon says she has also helped them search for a new home.
The renter has not paid rent for 7 months and they think they should be able to stay? Why is it taking so long to get them out? They also knew the house was for sale what were they doing for 2 months? They could not find another place to live? Yes, they will have to pay more, that is what the market dictates, but frankly, with their history of not paying rent, no one will rent to them now.
Yet when you take them to court for the back rent the court tells you they have no money. LTB should have funds set aside to help.
From what I heard from a few realtor friends of mine, the LTB is so back logged with eviction requests for delinquent tenants that it takes months to force people out
I know some one who the landlord was trying to evict before covid and then couldn't because of covid. It took until last Dec. To get them out of the apt. They hadn't paid for about 6 months before covid and didn't pay until they where evicted. The welfare gave them a free hotel rm from last Dec until July first. They are both working and they haven't paid rent since 2020 and still didn't have first and last month's rent put together. They quilt tripped a family member to take them in. Ya some people you can't help. They just take advantage

I’m really perplexed by how someone who doesn’t own the house, hasn’t paid rent in months and some bright person in a position to give an extension to these people who won’t leave can allow this to happen. People working at the tenants board should all be fired… so sick of abuse by tenants who refuse to pay or leave and the tenants board allowing this to happen 😮. How about they let these tenants move in with one of the board members
While I get the point, I say the board did not even hear the case yet.
However, I was the tenant in Hamilton applying to the board for the unlawful eviction (my landlord throw my stuff out, even if the rent was paid, because wanted to get better price by selling property without the tenant). It was in January. I went to board and was told the fist available hearing date is in April. While my landlord has learned about it, went to the board to place his documents and guess what, for him the fist available hearing date was in February! Yes, There is clearly a bias in the board and for that I think many heads should roll.

Try finding a rental listing that will call you back, let alone not cost you most of your paycheque. I don’t blame these people at all. 8 weeks notice is as joke in this market.

The "renters" don't want to leave as they can't afford market value, and this $1300 rent is a good price for them. Yet they haven't paid it in 7 months.

The owner should have filed with the LTB as soon as the tenant fails to pay his first missed rent, that way the delinquent tenant would have been kicked out by the sheriff by now.
Did the seller tell the prospective purchaser that his tenant had missed several rent payments? If not, did the purchaser ask whether the tenant was up to date on rent payments? Did the real estate agent know about this?
It appears that the seller, the purchaser, the real estate agent, and the tenant are all at fault.
ONE WONDERS IF the tenants WERE ACTUALLY PAYING RENT which the seller of the property collected under the table and profited from nicely - while leaving the ENTIRE COSTLY MESS TO THE PURCHASER............................................

I wouldn't either but some have no other choice. I've been open about landlords having a locked website where they can review tenants for other landlords and rent according.

Always, Always put stipulations into purchases to remove tenants before sales are completed so you can walk if not fulfilled.

Also in the market I live in rent increases are government capped at 2% annual, so any long term renter you want out, and can offer them back at a substantial increase to the market average. Plus tons of rentals are non conforming, so already breaking law.
As referenced in the story, the tenants were renting on a month to month basis. No lease. If this is indeed true then the landlord was completely within his rights to give them a 60-day notice upon the sale of the house. Add to that the fact that they haven't paid rent in 7 months and the landlord has every cause to evict them.

@@smith3329 By law you cannot evict tenant because you sell the house. However, new owner can give a notice to the tenant at the end of the contract term, or 60 days if is month-to-month is is going to use the property for own purpose.
Such notice could be given by the old owner, but it means it would have to move to the property for some time before sale to avoid being sued for unlawful eviction.
The law is clear: if the landlord (old or new) wants to utilize the property for own purpose, has to give the notice and the tenant has to move out. No conditions.
I have heard of a similar situation. When the tenant actually got their hearing they were told to get out in 14 days. Plus they had to pay up the missed rent. So these folks are in deep poop. I fully understand it is a very difficult position for the tenants but one way or another they have to move out. Where or how is neither the present homeowner's nor the purchasing homeowner's problem.

Tenants that don't pay rent are no longer considered tenants. They are squatters so if I was the home owner I would just enter and exit their apartment at all hours of the day any time I wanted as often as I could. I would sit in their apartment and watch TV. I would use their washroom etc etc etc. The tenants can't call the police or proceed with any legal action against you because they are not tenants anymore.

However if you own a home and rent part of it out you own that part that you are renting out. If a tenant pays rent you are not legally allowed to enter that part of the home because it is considered the renters use because they have paid for it. As soon as someone stops paying for that use (i.e. they stop paying rent) they are no longer renters they are squatters using a part of your home that you own. So you have the right to take back that part of your home....in other words you can do what I stated above and just enter it whenever you want because you own it. It belongs to you. And by entering whenever you want as often as you want at all hours you will hopefully make the squatters uncomfortable enough to get the message they are not welcome any more and leave.

The buyers and their agent should have made tenant vacancy a condition in the sale. The crazy market makes people desperate. We need to bring immigration levels back understand 400,000 per year.

Lesson learned. Don't buy a house that's not vacant. Don't close on a house that's not vacant. Move in same day it's closed.

This seems to be going on often my friend parents sold the house in Oakville and the tenant wouldn’t no leave . Landlord had to pay $25k to get him out. Money for Keys is the new blackmail and no one does anything to protect Landlords.

They have their rights under the RTA- they can't be forced to move out just because someone new is buying the property, the tenancy would pass to the new owner. The landlord can offer the tenants something like a "cash for keys" offer, which obviously the tenants have refused because they wouldn't be able to afford a new place (they might be paying far less in rent there than in a new place, due to our rent control laws- rent can only be raised based on the consumer price index for existing tenants).
The buyer, an equally hurt party, has sunk a large investment into a place she obviously wants to live in (or else, why not just accept continued tenancy) and was guaranteed by the owner that it'd be a vacant possession. The owner, under law, could not guarantee that, and therefore is the one guilty party in all of this.

Yes once the term of the original lease is up the Landlord does have the right to file to the LTB to evict but they (the LL) don't have the capability to evict solely themselves...that is the responsibility of the LTB. Now while I agree that these tenants absolutely should have continued paying their rent, they still have a right to a hearing.
It's time Ford hired more people to work at the LTB to catch up on the back log.

I was a renter in like situation. Yes, I have paid my rent, but the law is very clear. If the landlord wants the property for own purpose, it can give 60 days notice (if the rent is month-to-month) and tenant can do nothing about it. However, the landlord has not move it. Another case, by law, is when the home gets sold. The landlord cannot evict the tenant, and has to sell the house with the tenant in. However, new owner has right to either keep the tenant, or to use the above mentioned law and give the notice to live, because is going to utilize the property for itself.
I understand that the housing market is difficult now, but if you are the owner, you decide.
In simple words, if you would buy someone's used car, would you care that the friend of the seller was using this car to get children to school? Now the car is yours and you decide what you going to do with it.

The tenants could be trying to sweeten their chances of getting a new place by offering a lump sum down payment on a rental unit. Which is also going on ALOT. As are the offering of services because no units come with utilities anymore.

There should be a class action lawsuit against the Ontario government for allowing this to happen. N4 form clearly states that the tenant doesn't have to move out he/she disagrees with the notice. It it practically encouraging the tenant to default. The government failed to create affordable housing. The easy way out is to impose a lot of restrictions on the small scale landlords. The government doesn't realize that LTB is actually encouraging the the landlords to convert the long term rental units to short term rental units leading to skyrocketing rents. It is the tenants who would lose in the long run.
Too bad if you can't afford outside, you haven't paid rent for 7 months. This is pure highway robbery and the government needs to act on it rather than let people take advantage of the situation.

This poor buyer got ripped off and should sue the seller! The buyers realitor clearly stated the tenants have not paid the seller rent in 7 mths prior to the sale. The tenants clearly have an open case before the residential tenancy board with the seller and likely they are claiming relief of rent owing. If it were just a case of delinquent no good tenants the seller would have filed a 15 day notice to vacate for arrears first and foremost. This detail is left out. It is a major detail. The tenant has the right to fight to set this aside if they have good reasons. If services have been taken away, rent illegally increased, and other reasons. The tenants afiirm the right to stay to the reporter...if they want to win the right to stay and are good people they must eventually fork over whatever they don't get relief from. Otherwise a sherrif will come and change the locks and they will get reported to a credit agency.. I hope they are making good use of their time saving up and keeping the landlords rent aside for the seller. The seller clearly is trying to evade responsibility for something by selling and not disclosing to potential buyer that there was already an application before the board and that tenants were not going to be paying rent because they hadn't for 7 mths prior to the sale. The poor buyer. This buyer didn't do her due diligence and got taken advantage of by the seller. Why would she sell her house before a new deal closed if she had stipulated vacant possession a a condition of the sale, knew the tenants were going to "fight for their rights", were not paying rent and open herself up to potential "homeowner less"? Homeownerless is not the same as homelessness. This seller believes 400k is affordable then she clearly has enough money to rent an apartment from someone and not become homeless. Housing is a right, buying a house is not. Buying a house is a privladge. Having a place to call home is a human right. She should start looking for rentals and sue the seller.

You won't like it if you bought your house and renters took it and won't give it back. I do understand the renters situation, but how is it the Landlord's problem?? Remember the $400k is a mortgage and she has to make payment. What could possibly make a tenant not pay rent for seven months and then still claim the right to live in the unit...? Logic says likely repairs not done and major out of pocket expenses for the tenants. That is the only legal grounds. Otherwise the sherrif will force them out and as I said they will have their credit ruined. You cannot say weather or not they paid the rent that is for the RTO. Nowdays tenant think, house is they renting is rent free and they can do what ever they can do. I have rent house in Niagarafalls for older couples. Last 3 year, i didn't increase the rent single penny. They missed many payments and i forgive them. 5 month ago , when i visited the house. I found out they were operating motorcycle repair and parts sales shop at my house in basement and garage. Since the day i visited, they stop paying rent and not moving out. Im waiting for landlord and tenant board hearing until oct 18th.

@@oberg987654321agreed they have an obligation to pay rent, however it is their right to wait for a hearing. Buyers of tenanted units need to do their due diligence (or the realtors who really should know convey this) and realize that it might be a long process.
The buyer and seller are not responsible for where these people are in their lives. It is unfortunate but the buyer shouldn't have to suffer while they sit pretty in someone else's house and don't pay a penny for it. If you are ok with this, you are part of the problem. Why don't you give up your house to the homeless?
Never give living space to someone who can't earn on their own. Renters have to many rights in Canada. If you buy a rental vrbo or airb&b it so you can forcibly remove if overstayed.
