Imagine having a patent just for the sake of it but then not really using it either. No one can make a game with the said patent, and the more random things locked behind a patent, more limited a dev can design a new game, and in the end no new game can be made.
At least Nintendo was smarter that way on stopping others making games than what SBI tried to do to stop other devs making games.

I remember from a UA-cam video that Japanese game companies would patent the smallest of things so that they would protect each other from patent trolls, that being an honor system such that they would not sue each other for violating the other's patent. I suppose since Pocketpair is a new game in town, Nintendo seeks to bully the newcomer that most likely didn't patent anything that Nintendo would potentially violate as well. Otherwise I would hope that Pocketpair can countersue Nintendo for a supposed violation of another patent that they hold.

Ive never heard or palworld before so i looked it up and it seems pretty clear that they've intentionally aped pokemon style and even outright appear to be relying on the recognisability of specific pokemon.
I do think it differs enough that i wouldn't complain but let's be real here, they're intentionally using the aesthetic of pokemon to sell their game. You'd have to be incredibly naive to doubt that.
Its not like Nintendo have a completely baseless claim here.
Pokemon art style is not unique to it. it existed before Pokemon. SO they cant really attack from that direction. The patents they list.....are way to catch all in many cases and one of them is related to a PHYSICAL CONTROL that pal world does not use. its like a SHOTGUN with birdshot attempt trying to catch something with one of the 1000 pellets.
From a gameplay standpoint, it's actually more like Ark, but using anime creatures instead of dinosaurs.
@@braddl9442 I'm not saying the art is exact but I don't think it's a coincidence that the style is so similar even if that's somewhat common.
Especially when you also lump in that some of the characters literally just look like popular Pokémon with very slight changes and many of them look like mashups between 2 Pokémon.
To be clear, unless something is outright plagiarism I'll never have an issue with it. Art in general is always a process of "collaging what you've appreciated before" if you like.
Every artist has their inspirations and there is no such thing as a truly "original" creation. Thats just not how the creative human mind works and so corporations weaponising stuff like patent law to crush competitors and the creative process is gross. But I mean on the flip side palworlds corporation have made more of a financial/marketing decision to do this as opposed to purely creative so I'm not really trying to act like it's a purely artistic thing.
However, the point I'm making is that palworld has blatantly made an intentional and calculated decision to ape Pokemon's style and designs closely enough so that it sells more by association.
You actually see this tactic all the time in marketing and it absolutely works. I don't know if you have it wherever you're from but probably the best example is Aldi (the supermarket) although supermarkets and food/drink brands do this all the time.
They take a product that is very well known, iconic even, like Heinz tomato soup and then they call their version "Heens" and mirror the design almost perfectly just changing it enough so that they can avoid being sued.
Some of the examples in Aldi are mind blowing now they get away with it and they do it on every single product that is one of their "originals". Have a look at their shop online if you want an idea of what I mean.
There is a lot of playing around with this in corporate marketing.
If you think palworld aren't doing this you're just naive. I'm sorry but that's the reality, it's not a coincidence and the corporate/marketing execs who likely came up with this idea are not somehow ignorant of one of the largest, world famous, iconic competitors in the market.
We can squabble over what we think should or shouldn't be done and I'd agree with you that Nintendo shouldn't have done this and that it's "against the spirit of fair play" - let's say. It's a bad look, a tyrannic look, but I'm just making the point that it's not baseless.
If, in my earlier theoretical, Heinz pointed out that Heens is blatantly aping their product in order to sell more based on the iconic marketing design you'd have to be naive or lying to act like that wasn't a true claim.
What you'd debate about is whether Heinz should have that right and whether they have sole ownership of red tins of tomato soup with a badge on.
I think it's actually pretty hard to determine where the line is crossed which is why my standard is to only punish outright plagiarism where nothing/negligible things are different and its still passed off as their own creations.
