A few days ago the French Senate and Assemblée Nationale passed a law permitting UK property owners in France to spend 180 days in and 180 days out of France, which changes the equation quite drastically. It means the whole 6 months of winter, or summer, can now be considered. Details are still to be thrashed out, but it is likely Spain will follow this 180 day initiative. My wife and I became residents of France, but if we decide to revert to being non residents, this 180 day block would be most acceptable.

I never went into detail about travelling in the Schengen area and staying longer than the 90 days but your suggestion of hiding away in a non Schengen country for a few weeks to extend the period would be a good one. I used same calculator last year and this year. Had 73 days away the last 6 months of last year in 3 holidays and 33 days so far this year. Hoping Spain will reciprocate and agree to match what we give Spanish when they visit the UK (ie 180 in 360 with poss 180 in one break) Cheers guys !

This may not currently apply for UK citizens, but coming from Australia we can actually spend at least 270 days in 12 months in Spain (or many other EU countries). We use the Bilateral Visa-waiver Agreement after the Schengen time runs out. 90-days of Schengen stay, then you may apply for a visa-waiver stay another 3 months (only for one country). After that you must leave the Schengen-zone countries for 90 days, after which you can return for another 90-days Schengen visa.
That sound very interesting Peter, let's hope the UK can adopt a similar agreement. At the moment we haven't got it. To us, it seems unfair for UK citizens to be Spanish second homeowners and to have to put up with paying all their taxes, and supporting the economy and then have to go back after 90 days and then having to wait another 90 days before they can return to their own property. Sorry, no cherry-picking. The UK is a 3rd country. We need to respect the decisions of the UK people. It's hard to see how Spain can grant a special deal without leaving the Schengen area itself, which it won't do.
We don’t think the British people were told the full story otherwise they wouldn’t have voted the way they did. We voted remain with the other 48 percent so we are entitled to be sore losers especially when we pay our taxes here, and have a second home that we can’t use whenever we want because of it. Thanks for commenting but we do get annoyed by it.

It saddens me a lot that you cannot enjoy my country as much as you would like. But it is a reality that is there and against which little can be done.
I think the Spanish government has to resolve this issue. Their treasury will be the beneficiary of all those extra taxes and spending by the British. If you read the 180 days in Spain Facebook group you can see that many Brits have complained to their MP's and all the replies are the same - nothing can be changed, 180 days was not negotiated in the Brexit withdrawal agreement. Britain's economic interest is for us to stay home and spend our money here. Its up to Spain to come up with a solution; maybe a 180 day tourist visa?
We are hoping for something to happen from the Spanish Government, hopefully a reciporicle agreement the same as what we give all the EU countries in the UK, which is 180 days in 360 instead of 90 days in 180. Yvonne and I would be very happy with that.
Yes Andrew I understand that was the case, but From what I understand it was overshadowed by the free movement of people and no one seemed to implement it. Absolutely correct for pointing this out Andrew, I have an Irish passport (non Schengen) but even as an EU citizen if I want to stay longer than 3 months I need Spanish residency - which I now have .The UK was exactly the same before Brexit it was just that it was never enforced at spanish border control so people never bothered to get residency. Its misleading to say its Brexit that changed the rule ,it's not, the rule was always there before Brexit for non Schengen citizens but not enforced. Freedom of movement as an EU citizen does not and never did give you the right to stay longer than 3 months in Spain.

@@colmcd8143 the rule was always there but it was never enforced towards Brits. It was enforced if you were from a 3rd country and I know that as a matter of fact. So Brexit did change the enforceability of the rule as now the UK is a third country

I would hope that a group be set up in Spain, a kind of peaceful protest group to shed light to the Spanish Government on the unfairness of these 90 a break and then 90 day stay in Spain. WE own a property in Spain, pay our taxes even when not allowed to stay in Spain. Law abiding, spend money on shopping, buying goods for our homes, eating out in Restaurants, the list goes on. Could or should the question be asked or suggested that home owners be exempt from this law. Maybe a fee for this right, not a very big fee and therefore make things very fair.

We have spent time in the Playa Flamenca and La Zenia areas which we believe have a substantial British ex-pat community. So have Ciudad Quesada, San Luis and El Chaparral which are a little nearer where we are. We would always say have a good look around yourselves and spend time seeing if you like what you see well enough to commit to that area full time. That's exactly what we did and it took us several trips and many estate agents before we decided on where we are now. Thanks for another informative video. I heard today (on the grapevine, so I cannot vouch for its authenticity) that Portugal are refusing to stamp UK passports as they want to attract UK tourism. if this is correct, then, theoretically, it may be possible to fly into Portugal then travel onward to spain without the incumbrance of the 90 day rule. worthy of more investigation.

That's not true. They are stamping the passports. Every passport leaving and entering the Schengen Area is scanned anyway, so they know where and when you entered the area and when you left.
Hi Mike & Yvonne! Being from the Netherlands I don't have any of these restrictions. I can imagine the frustration though if you own property in Spain (or any other European Shengen country). You would have to plan very carefully. It's not fair. I will gladly sign any petition for you to get equal rights!

Another byproduct of the 180/12 rule is the higher risk of squatting (Okupas). Unlike the UK, there is no real protection for private owners in Spain as they law support Okupas. Should you be in that situation, expect to get your house back in about 12 months. Another video on this?
Hi JM, it's a very emotive subject and, we think would be better covered by an expert in law. We could only give our experience and personal view which would be much like most other people. It seems grossly unfair that a property owned by someone who leaves it empty for any length of time could be open to "attack" by these mostly undesirable people and not be able to remove them if they remain undetected for more than 48 hours. Nobody is retiring to Spain anymore, the non reciprocated 90vs180 day rule is typical of the UK not looking after it’s own people. Portugal is welcoming British people with dedicated immigration lanes a stamp free entry. Why would they want to discourage their best customers.

The Valencian authorities are keen for a change in the current situation as they know British non-resident property owners are feeling victimised especially when they voted to remain in the EU. yep my friend because of brixt inow have to be pack house on the fly with 100 kg wieght because even get uk gov form in to Austria is 6 weeks because of brixt it not like it use to be turn up start work i get lots of brixt paperwork i have the basic paperwork but 66 million people had vote if i had work one year with out this nightmare ! i now have sti 2 week in class to re do my uk work qualification in full on Germany because of 66 million people have say over my life so i no wot your talk about

Hi Mike & Yvonne. That was really interesting thanks. We’ve a holiday home in Sucina not far from Torrevieja. We’re both still working for the next two years so the 90 days don’t affect us yet. Hopefully after this awful situation in the Ukrainian 🇺🇦 settles down and we some sort of peace and normality we can start talking with the EU again about the 90 day rule? Can’t Europeans come to the U.K. for 180 days? Take care cheers Stevie x

It saddens me a lot that you cannot enjoy my country as much as you would like.
But it is a reality that is there and against which little can be done.
I think the Spanish government has to resolve this issue. Their treasury will be the beneficiary of all those extra taxes and spending by the British. If you read the 180 days in Spain Facebook group you can see that many Brits have complained to their MP's and all the replies are the same - nothing can be changed, 180 days was not negotiated in the Brexit withdrawal agreement. Britain's economic interest is for us to stay home and spend our money here.
Its up to Spain to come up with a solution; maybe a 180 day tourist visa?
We are hoping for something to happen from the Spanish Government, hopefully a reciporicle agreement the same as what we give all the EU countries in the UK, which is 180 days in 360 instead of 90 days in 180. Yvonne and I would be very happy with that.

It's not exactly true that you could enter and leave prior to Brexit without restrictions, because after 90 days you should apply for residency.
Yes Andrew I understand that was the case, but From what I understand it was overshadowed by the free movement of people and no one seemed to implement it. Absolutely correct for pointing this out Andrew, I have an Irish passport (non Schengen) but even as an EU citizen if I want to stay longer than 3 months I need Spanish residency - which I now have .The UK was exactly the same before Brexit it was just that it was never enforced at spanish border control so people never bothered to get residency. Its misleading to say its Brexit that changed the rule ,it's not, the rule was always there before Brexit for non Schengen citizens but not enforced. Freedom of movement as an EU citizen does not and never did give you the right to stay longer than 3 months in Spain.

@@colmcd8143 the rule was always there but it was never enforced towards Brits. It was enforced if you were from a 3rd country and I know that as a matter of fact. So Brexit did change the enforceability of the rule as now the UK is a third country

We are going to have to be organised like yourselves to make the most of our holiday home in the future as we are still working . I would hope that a group be set up in Spain, a kind of peaceful protest group to shed light to the Spanish Government on the unfairness of these 90 a break and then 90 day stay in Spain. WE own a property in Spain, pay our taxes even when not allowed to stay in Spain. Law abiding, spend money on shopping, buying goods for our homes, eating out in Restaurants, the list goes on.
Could or should the question be asked or suggested that home owners be exempt from this law.
Maybe a fee for this right, not a very big fee and therefore make things very fair.

Yes, we agree 100% and hope that the efforts currently being made by the Spanish Government, headed by the Tourism Minister will prompt something. It does help to contact your local politicians in your area of Spain so they have something to fight our case. There is a Facebook group called 180 days in Spain which have many template letters you can use to do this, they are all downloadable from the group. I think you would be a valuable asset to the group, have a look and see what you think.

Hi Mike and Yvonne me and my wife are planning on moving to the Costa Blanca next year, we are coming out this year and staying two weeks in Cabo Roig to look round the surrounding areas of La Zenia, Playa Flamenca Villa Martin etc, could you recommend any good areas that have a good ex pat community as we are very social people.
Hi Smashing Iron, thanks for watching and commenting. We can only speak with confidence about the areas we know and have spent time in. We have spent time in the Playa Flamenca and La Zenia areas which we believe have a substantial British ex-pat community. So have Ciudad Quesada, San Luis and El Chaparral which are a little nearer where we are. We would always say have a good look around yourselves and spend time seeing if you like what you see well enough to commit to that area full time. That's exactly what we did and it took us several trips and many estate agents before we decided on where we are now. We are going in April but we come back to the UK for July and August then back in September. This year has been different because our daughter is expecting our 6th grand child so we are stopping longer to help out. I heard today (on the grapevine, so I cannot vouch for its authenticity) that Portugal are refusing to stamp UK passports as they want to attract UK tourism.
if this is correct, then, theoretically, it may be possible to fly into Portugal then travel onward to spain without the incumbrance of the 90 day rule.

That's not true. They are stamping the passports. Every passport leaving and entering the Schengen Area is scanned anyway, so they know where and when you entered the area and when you left.
Hi Mike & Yvonne! Being from the Netherlands I don't have any of these restrictions. I can imagine the frustration though if you own property in Spain (or any other European Shengen country). You would have to plan very carefully. It's not fair. I will gladly sign any petition for you to get equal rights!

Another byproduct of the 180/12 rule is the higher risk of squatting (Okupas). Unlike the UK, there is no real protection for private owners in Spain as they law support Okupas. Should you be in that situation, expect to get your house back in about 12 months. Another video on this?
Hi JM, it's a very emotive subject and, we think would be better covered by an expert in law. We could only give our experience and personal view which would be much like most other people. It seems grossly unfair that a property owned by someone who leaves it empty for any length of time could be open to "attack" by these mostly undesirable people and not be able to remove them if they remain undetected for more than 48 hours. Nobody is retiring to Spain anymore, the non reciprocated 90vs180 day rule is typical of the UK not looking after it’s own people. Portugal is welcoming British people with dedicated immigration lanes a stamp free entry. Why would they want to discourage their best customers.
Hi Michael, it's interesting about Portugal. There is lots of work being done to try and change this. The Valencian authorities are keen for a change in the current situation as they know British non-resident property owners are feeling victimised especially when they voted to remain in the EU. But unfortunately that's how it is now. We love Spain so we are doing our best to just get on with it as best we can and hope there will be something to make things better for us.

yep my friend because of brixt inow have to be pack house on the fly with 100 kg wieght because even get uk gov form in to Austria is 6 weeks because of brixt it not like it use to be turn up start work i get lots of brixt paperwork i have the basic paperwork but 66 million people had vote if i had work one year with out this nightmare ! i now have sti 2 week in class to re do my uk work qualification in full on Germany because of 66 million people have say over my life so i no wot your talk about

Hi Heidi, yes I understand that. It’s a shame for the 48 percent of the UK that voted to stay. It was a big shock to us when the other 52 percent voted to leave. We are stuck with it for now. We can only hope the people who bought property in Spain and pay all their taxes and community fees, electric and bank fees etc. before Brexit may sometime in the future be able to visit when ever they like.
