      Many laws don't.
      In my state, a drunk person can be charged with DUI for sleeping it off in their car if they have the keys anywhere near the ignition. People have been convicted of DUI because the keys were in their pocket while sleeping in the back seat!
      Make that make sense.

    I was wondering why the age wasn't 21. However, that is to PURCHASE it. Who wastes the ink writing a ticket like that?

      Officers who are pressured to give tickets to generate revenue. They claim it doesn't happen but the statistics that tend to show that tickets go up at the end of the month day otherwise

    Unless the officer kept the alleged marijuana or some test in evidence, he has nothing on which to base a ticket for that NOW anyway.

    If cops are hassling an adult over smoking, they are either malicious, incompetent or have successfully stopped real crimes.
    For the people saying the age federally is 21, yes it is. Middleton doesn't have jurisdiction over federal law and the state law that this defendant was charged under doesn't fit the facts. It is not that complex.

      Federal laws on things like that are typically not enforceable in state court unless the state legislature has enacted an identical law. Nothing requires them to do that, since Congress has only limited jurisdiction. For instance, the federal highway speed limit max might be set at 65mph, but states can set it at 90, if they want to.

    In Dec 2019 congress passed a bill raising the age for tobacco from 18 to 21. Trump signed the bill and it took immediate effect.
    My issue with this was the goverment going after people considered *adults* (18-20) instead of going after the tobacco and vape industries targeting these same *adults.*

      three things that are completely unrelated.
      up to 1971, draft age was 18, the drinking age varied by state, and the voting age was 21.
      in 1971, the voting age became 18.
      in 1973, the draft was abolished.
      in 1984, a national drinking age of 21 was established, reducing alcohol related traffic accidents by half and alcohol related fatalities in the ages of 16-20 by almost 40%.
      in 2024, the only thing any of the above have in common is that an age either is or was involved.

    This is clearly the law's fault for not making it clear what age is considered legally an adult not entirely the LEOs. I will not be surprised if more laws are not clear ending up with the LEOs giving citations and even arresting people over the laws not being clear that were violated even if the supervisor believes the law is right but it turns out it was not clearly outlined after all. Sometimes court judges not only make mistakes but also find mistakes in the laws as well as no clear outline of the law.

      The LEO could have always not issued a ticket, perhaps given a warning and confiscated the tobacco product in question, you know use common sense. Matter dealt with and no waste of valuable court time.

      @@notme2day ​"All 50 states"? Not under state laws. When Trump signed the federal act enacted in 2019, many states that already had that law. The Tennessee and New Mexico laws didn't go into effect until 2021 and 11 other states had no such laws until 2021. Until then, only the FDA had jurisdiction to enforce the new law in those states.

      You want bad?
      Try "Judge" Simpson in Michigan. He was suspended for 6 months for protecting his clerk - which he may or may not have been banging - from a DUI charge. The judicial review board recommended removal from the bench but the Michigan Supreme Court, in a travesty of justice, reduced it to 6 months.
      Just last year he was playing investigator on the bench and tried to railroad the defendant into being responsible for the deaths of two young ladies who got in a solo car accident. The defendant wasn't even charged with that and tried to sentence him based on his fantasy.
      That guy is rotting human excrement.
      Or, how about "Judge" Webster in Kansas. She tried to force a former defendant - charges were dropped - to get fingerprinted and threatened to jail him over it. Luckily, the defense attorney pushed back until it became clear to that waddling gas bag that she had massively overstepped her bounds, and literally ran away.
      She is simply stupid, sadistic, and pathetic.
      Middleton is thorough and compassionate. Two things you want in a judge.
