    In California a defendant will not be held liable for a co-defendant's death during the commission of a felony pursuant to "Agency Theory"

    So if two people commit robbery and one of them is killed by the victim of the robbery how is it possible to charge the surviving robber with felony murder when the killing was lawful? It is lawful to protect yourself.

      @John Webster the statue is I.C. 35-42-1-1 out of Indiana and the language doesn't say that a person can be charged for the death of his/her accomplice. Are there any U.S. Supreme Court cars addressing this issue?

      Issue: How is it possible to charge the surviving robber with felony murder when the killing was lawful?
      Mr. Jenkins, under the innocent person limitation, in a minority of states, liability attaches for 'any death' proximately resulting from a felony. In this instance, the death was proximately caused by the robbery because the killing was a direct response to the robbery.
      Therefore, in a minority of jurisdictions, a felon can be charged with felony murder for the death of any co-felons.
      However, I don't know all of the facts from this case. I'm also unsure of the approach IN has adopted to felony murder.
