To be fair for the state issuing the visa, what is the bare minimum time to spend in the nominated state that can be acceptable to the officials ?
Hey Karl, thank you for this eye opening info. Wanted to confirm with you about something. In each of the RDA websites in NSW they specifically mention a requirement of staying in the nominating region for the 3 year period. Can that be ignored?
For example in the Murray RDA website it does mention that we have an obligation to live and work in Murray during the course of the 491.
Yes they are commitments but the real issue is that circumstances can and do change and you are permitted to move. Tanks for watching Kevin

You mentioned that there is a grace period of 3 months. Is it advisable to move states during processing time before the 491 visa is granted? And can you move states straight after the grant or should you wait some months because of that grace period you mentioned?

Out of interest, if you are offshore and are awarded the 491 Skilled Regional VISA, on your first entry into Australia, is there an obligation to fly in and report to the state that awarded the VISA, or can you settle at an eligible designated regional area of your choosing anywhere in the country?

Hi Carl, recently sponsoring state has sent us survey email regarding our residence. if we (190 visa) say yes we have moved state before time and give proper reason for that, would that impact on our stay or anything else such as applying to citizenship in future. If your 190 visa is granted there is no legal requirement to respond to their email. This will have no effect upon your citizenship application Derek. Thanks for watching
hi, karl wanted to know if a person after getting invited say from RDA NSW for 491 can move to SYD and work there until/before he gets his 491 granted? FYI the person is on bridging visa A of 491?
Your BVA will have certain conditions that you must comply with but I doubt it says you must only work and live in a regional area. There would be no issues in staying in Sydney until the visa is granted, then after grant the grace period is to move within 3 months of the grant date.

Moving before your visa is granted depends upon what you agreed to when you applied for the nomination Jyoti. After the visa is granted you can move to any area on the list at that time. Please book a time if you would to discuss your circumstances in detail.

Thanks for the video. My question is, once your visa was granted, you travel to Australia within the year that you you were given in order to activate the visa and then you have up to five years to move to Australia. So, my doubt is what if you do not go to the state that sponsored you for whatever reason, lets say Queensland, while offshore you find one in Victoria and you stay there. The five years have passed and you have the chance to either apply to the Resident Return visa or Australian Citizenship, so what happens there, is the state that sponsored you involve in that process? Does the state have the power to block your citizenship application or resident return visa?

I read online that if you don’t do the minimum of 2 years in your nominated state that when it comes to citizenship they won’t grant you it due to this. Is this true?

You can enter Australia at any location. It is just that later where you live is what matters. Have a good flight

Currently I’m running a business which was previously purchased for 100k, and I have the intention to apply for QLD 491-sbo, I have a few questions hope to be cleared:
- As mentioned by Migration QLD, I cannot relocate or sell the business before receiving QLD approval. Currently, the business is not doing so well, so I’m looking for opportunity to sell the business. Can I sell the business right from the moment I get nomination from QLD, or I have to wait for visa grant, which probably takes a further 6 - 8 months?
- Migration QLD also mentioned that I need to operate the business for 3 years from visa grant, does it mean it must be the same business, if yes I found it’s contrary to what they mentioned earlier? Can I sell this one and relocate?

Hi Karl, does this applies to 494 dependent visa holder as well? My husband is the dependant and will work in regional places for an employer who is based in Melbourne. He is a tradie so he doesn’t have a specific workplace but he will be taking up jobs such as loading/ unloading goods, painting, landscaping etc. Can he continue to work for the Melbourne company that he used to work previously but now in regional post codes only? So say I was granted a 491 for qld, I wouldn't be penalised for my job being in not in the designated postcodes?
Breaching the conditions on a 491 visa can result in the visa being cancelled, so not advisable
I would like to clarify for the current 491 visa, does the legislation apply currently. If granted 491 visa I move around to other state but stay in regional place.

Can you please tell me if I am on 494 visa and for some reason I do not meet the $53900 income requirement from my sponsored employer for one year due to Unpaid Leaves(because Paid leaves utilized already) and 1 month offshore due to some personal reasons, Can I still show some other forms of income to meet that threshold for 191 in future? I would be really grateful if you can shed a light on this, please. TIA.
