Likely the problem with that road would have been that there's nothing to amend from a conventional POV- the wording would have been the same. They could have added a definition that included both sexes that would have stood until now, but it would likely have been deemed peculiar to do so, not least because there was not confusion elsewhere in the law. One could also argue any government at any time could have just named women to the senate on the assumption they were qualified anyway. That would have been one road. In practice, exactly what did happen. Hence the judicial process, I guess. Unlike the British parliament, the Privy Council still acted as a court of appeal, including at the time for Canada. It's not as though there were no Canadian precedents on the interpretation- the Alberta Supreme Court, for example. Only the Supreme Court of Canada and an old British ruling on a tangential matter stood in the way.
