When a public officer who has the duty to detain or order the detebtion of a person brings that person to the prosecutor and the prosecutor does not find prpbable cause to charge rhat person, that is NOT arbitrary detention. Arbitrary detention is when such public officer arrests another person pursuant to a VALID warrantless arrests (or any legal grounds) and the arrested person was not delivered to the proper judicial authorities within the allowed period (12, 18 or 36 hours depending on the gravity of the offense).
The finding of probable cause deals with the evidence presented during inquest or prelininary investigation. It does not deal with the illegality or arbitrariness of the detention or arrest.
Arbitrary detention is when there is VALID warrantless arrest? Who taught you that? Can you tell me what is the 3rd element of arbitrary detention pls? The topic is art 124 and NOT art 125
