- April 18 | Senator Sheldon Whitehouse (D-RI), Chairman of the Senate Judiciary Courts Subcommittee, delivered the twenty-first in a series of speeches titled “The Scheme,” exposing the machinations by right-wing donor interests to capture the U.S. Supreme Court and achieve through the Court what they cannot through the elected branches of government.
Whitehouse discussed Supreme Court Justice Clarence Thomas’s brazen disregard for ethics disclosure laws.
Last week, Whitehouse and Representative Hank Johnson (D-GA) sent a letter calling on the Judicial Conference to refer Supreme Court Justice Clarence Thomas to the U.S. Attorney General for potential violations of the Ethics in Government Act 1978. The letter comes after two bombshell reports from ProPublica exposing Justice Thomas’s failure to disclose the sale of properties to billionaire Harlan Crow, and revealing that Justice Thomas and his wife accepted extravagant vacations on Crow’s dime, including individual trips worth as much as $500,000, without disclosing them as federal law requires.
In February, Whitehouse and Johnson reintroduced Supreme Court Ethics, Recusal, and Transparency (SCERT) Act, which was endorsed last week in an editorial by the New York Times Editorial Board.

I fear that he's the last of his kind. Very few individuals get themselves into political positions to serve the American people in the 21st century. Citizens United made that happen. SCOTUS is now a partisan political position, not a neutral judicial role. They are out to pad their own pockets at everyone's expense. Senator Whitehouse is a notable exception.
And he is doing his job and most importantly he knows his job and works for his voters!
I grew up in Rhode Island. I remember when the Mayor of Providence ended up in jail. And he ran on an anti-corruption campaign. I used to say that it was a good place to leave. Nice to see an honest hardworking politician.

He's the real deal. I've spoken personally to him a few times. I'm nobody, but he never made me feel that way when we spoke.
Senator Whitehouse is obviously a Senator we could use many more of.

As a taxpayer what's most disgusting is that with all the money spent on law enforcement, homeland security and ethics committees Propublica had to find this out for us (and I assume at a fraction of the cost).

Thank you Senator Whitehouse! The current issue, with regard to the Judiciary, and in particular Clarence Thomas. Thomas’s abuse of the “Disclosure Rule” is unacceptable ! It seems even to a lay person, his willingness to play loose with the rules has to reflect, in some way, on his rulings? At the least, it seems to set the stage for potentially “cloudy” decisions. I would like to see him removed.

I remembered Whitehouse presenting how McConnell and his Repugnicans took over the Supreme Court. A well developed road map... I remember being utterly distraught when Thomas was finally confirmed as a SCOTUS judge. I never understood why because of the appearance of impropriety (sexual misconduct allegations), which should have disqualified him. Whitehouse is giant. We need more people like him.

The Supreme Court is no longer a reliable or credible court because of Chief Justice Roberts and the conservative majority's conduct. What Justice Clarence Thomas has been doing that is now coming to light should come as no surprise to anyone.

If only the American public and other members of Congress cared about this as much as Senator Whitehouse does. This should not be one man's mission. The Israelis citizens were in the streets by the tens of thousands for over 10 weeks night after night protesting when Netanyahu tried to corrupt their highest court - even members of their military. Republicans, Mitch McConnell, and the Federalist Society corrupted ours, and our people just yawned with many not even having a clue about this corruption in their midst. We have become a tired democracy and that's usually how and when they fall. Ignorance and not caring. The people are not only not fighting they don't have any sense as to what they should be fighting for. Or what to save. We are pitiful.

He doesn’t have the authority to police the justices. They are above the law. The only authority to set guidelines and policy is congress. Congress could impeach but it would take 2/3 and no republicans would vote to hold any corrupt person responsible.

The sad thing is that this has gone on for years, the judge thought that he got away with for so long that his Hubris has finally caught up with him. His ‘dementia’ even led him to state his wife’s income was 0$’s how did he think 600$k arrived in the joint bank account. One of his wife’s salaries. Let’s face it Crow would have never in a billion years befriended Thomas if he had not been a high court judge. One of his only black friends. Both born in the same year states Crow so ‘we had so much in common’. Sure a black man brought up in a two bedroom single story house, parents both in working class jobs. Versus a son of a billionaire who continues the family tradition of continuing to be a billionaire. This stinks so badly it’s vomit making. Why is there no ethics committee looking into this. Senator Sheldon Whitehouse is one of the few senators that has integrity. A private jet to Indonesia would be a lot more than $5000.00 dollars. That dollar amount needs to be raised.

@@annhobson1975 Go back and review, Ann. At 1:24 in the video he describes the jet as a Bombardier Global 5000. That is the model of the Bombardier, not the cost. Beginning at 1:55 he specifically describes the cost for the trip to Indonesia as over $500K. At 2:10 he goes into more detail - the $500,000 for the Indonesia trip included the private jet, 9 days of island hopping on a superyaught staffed by a coterrie of attendants and a private chef.

Harlan Crow should also be prosecuted for bribing a government official which carries a sentence of up to 15 years. Moreover even if government officials disclose what they received there should be a regulation that no government employee can receive anything other than a dinner up to $200. Just unbelievable that a government employee can just disclose what he got in the middle of the night and it would be perfectly ethical!

Crow didn’t do anything illegal though, it is (for some reason) legal to give Supreme Court justices gifts, they just have to be properly disclosed. Thomas is the one that did something illegal by not disclosing them.
@@paradoxmo just today I got an alert from the Department of justice. A guy arranged to get contracts by giving gifts i.e. for what he wanted, was found guilty of bribing and received a sentence. Crow made sure that by giving Thomas gifts he got Thomas to vote for various cases that have come and will come.
Bribing gets you up to 15 years and a fine 5 times what you gave.
Thomas could have disclosed but then he would have to recuse himself.

Well done, I look forward to the hearings coming up. Even in lower courts we adhere to the "no gifts" for court related services strictly, and gladly. It is hard to see the highest court in the land falter and as a result cast a shadow on courts who are working hard to right wrongs and provide equal access to justice for all. It is disheartening.
