Cheating on your spouse depending on where you live was just that illegal. Before the NY governor for example removed the law that actually made cheating a crime in the state.
If you go back further there was an even harsher law that would give cheaters capital punishment if they cheated on their spouse though it was very rarely used.

Not really. They're already divorced, so making a big deal about it doesn't accomplish anything and at worst it causes problems with the kids. He might want to get the kids DNA tested though.
