I am a woman and I understand your situation completely. It is very hard when people prejudge you. In my case, it happened in the Netherlands. It was very traumatic, like false accusations always are, and I still hate the system for that. But I managed to get everything normal after a few years, which was not easy at all, but I still have PTSD from these experiences. It happens everywhere to innocent people. The people who are in the wrong are too calculated to let anything happen to them, but when you are innocent, you do not expect to be treated unfairly.

In Germany you have the Besucherrecht. When you find a way to immigrate to Germany, you should be able to regularly see your child and it is very, very hard to prohibit you from that. Even if your were a really bad person, they try a lot so you can see your child. in the worst case they put a social worker in your family who helps. You have many many more rights in Germany than in the US, even when you don't have custody. The court here is also not more on the woman's side than on the man's side but it is very equal. Of course there are always cases that you wonder about why they decided a certain way. But generally speaking it's a pretty fair system.
So sorry. I lived in Stuttgart for years, and am now in Wiesbaden. My husband’s ex is similarly toxic, although his kids are grown. I have thoughts on this… and honestly, I would expect your wife has to adhere to a code of ethics for her license. If it were me, I would approach the US consulate, her professional licensing authority, and anyone else who might force her back to home turf. That’s where this battle needs to be fought. A decision, as required in this case, can only be made by a court. The police must "ward off danger" in such situations. The simplest way of averting danger is to separate the disputants. And here the man, as the physically superior person, always has the worst cards. And believe me: no police officer likes to make this decision. Family disputes are the worst case scenario for any police officer...

Trey, if everything you said is true, I'd encourage you to fight through the legal system in Germany to receive custody for your son. Is there no proof of her falling off the scooter in the US, a foto, or a wittness who saw her bruises and can confirm that it wasn't you misstreating her, but an accident? Claiming that a crime occurred (which obviously would have been the case if you'd hit her) while in reality it didn't, is a criminal offense here in Germany (§ 145d StGB Vortäuschen einer Straftat). If she claimed to the police, not even speaking of the court, that the bruises she presented were the result of you beating her up, but you can proove otherwise, it would get her a criminal record. She most likely won't go to jail for that, but it would weaken her position in family court concerning custody of your son immensely. Also, the lowest instance of courts in Germany will traditionally side with the mother of a child. This has its (rightful) reasons, because concerning domestic violence, in 99,9% of the cases the man is physically stronger and is a much more "dangerous actor" in such situation. But the higher level of a court you go to, the higher the actual quality of the judicial decision will become. And don't, just don't care about what the police is saying/thinking. Their opinion is absolutely irrelevant, what matters is proof, hard facts, nothing else.
I have evidence of everything from December until now including text messages of her telling me she fell off of the scooter. Pictures as well. I hope the German courts will consider this evidence in my case because I have tons of evidence.

They tend to go a long way to justify their decisions, and in case one court doesn't, you have good chances to get the ruling revoked at the next level. Germany is a constitutional state after all, and one of the highest order in international comparison I would claim. That doesn't mean it is perfect and infallible (nothing is where human beings are involved), but the quality in generall is quite good. And the days were the courts here blindly ruled in favour of mothers when it comes to child custody are definitely over!
@@larsengstfeld6744 but a big problem are still the Jugendamt, they often act like a 3rd party in the legal fights and have sometimes very bad (and corrupt) appraisers and courts then follow often these wrong appraisers. So everything has to be thought through very well in advance with good attorney - and, larsengstfeld, who can afford the fights at court until you reach higher court levels?
@@mattesrocket The "Jugendamt" can be a problem, but not necessarily. The one I had bussiness with about ten years ago was acting very careful, and very cooperative. And if you have trouble financing the legal process, "Prozesskostenhilfe" is also availible to parents who fight over custody. But I definitely agree with "So everything has to be thought through very well in advance with good attorney" your sentiment here. It is important to be calm and cooperative in even the most nervewrecking situations of this process, and actively display that your child's wellbeing is your primary motivation and not the "war of roses".

I am sorry to hear about your ordeal. I think what it boils down to is, that German law states that the Mother has the "Aufenthaltsbestimmungsrecht" meaning even though you both have the same right to raise your kid, she can decide where the kid is allowed to go and where not. There is no way to take this right away from a mother except if she does something very detrementing to the kid... The police is not allowed to decide in those cases, they do not decide the law, they just try to deescalate the situation and adhere to the law. There is no wiggle room for them to make decisions in regards to this. Hope that helps to explain why even if the police officers were on your side and believed you, there was nothing they could do at that point. The judges have to decide. It's going to be hard, but remember, there is also rights that apply to you, for example you do have the right to see the kid for two days every other week without the mother being around... just work it out with the lawyers and the judges... I am in the health care business and I can tell you I have seen health professionals using what they know to twist facts to help “their story”. Give her some grace, her new partner may be doing exactly the same thing to her as your wife is doing to you. It’s manipulation. I find it odd that you did not notice oddities in her behavior even prior to any of this happening. Don’t give up on Golden. Make sure he and everyone around you know your love for Golden. Don't fight - with hope. - BECAUSE, for the youth welfare office (Jugendamt), every month that your son is with his mother is an argument for leaving the child with his mother. I don't see any chance of changing that. That's how SAD that is... You can only achieve meeting times, probably under supervision, in Germany.

I remember vividly seeing your wedding ring in your back surgery video and thinking I he's lucky he has a spouse there to help take care of him during this time. I'm recovering from cervical spine surgery and I have a great support system. I didn't know you before this day. I - more or less - came here by accident as a suggestion from UA-cam as I watched a video from an American UA-camr who lives in Germany. And yet, this story makes me really sad. Very sad that kids always have to suffer the most from cruel parents, regardless if it's the father or the mother. Even as a native German (formerly from the region around Stuttgart), I'm ashamed. Women often get the benefit of the doubt here.

I feel very sorry for you. I expiranced similar things. My partner cheated on me and left me, in the worst moment possible, when I lost my job, my mother got very sick and our kids had serious problems in school. He just did not care for anyone just wanted to have fun. And he treated me like criminal as well. Just because I was not happy with the situation. But he was the one cheating. I am a woman and I understand your situation completely. It is very hard when people prejudge you. In my case, it happened in the Netherlands. It was very traumatic, like false accusations always are, and I still hate the system for that. But I managed to get everything normal after a few years, which was not easy at all, but I still have PTSD from these experiences. It happens everywhere to innocent people. The people who are in the wrong are too calculated to let anything happen to them, but when you are innocent, you do not expect to be treated unfairly.

She weaponized so many aspects of our relationship, and until I realized that I was trying to live with the equivalent of a black belt who was abusing me, I didn't understand I needed to learn to defend myself from an expert in every interaction. The only solution that will be reached will have to be done legally. My wife has completely abandoned communication with me.
In Germany you have the Besucherrecht. When you find a way to immigrate to Germany, you should be able to regularly see your child and it is very, very hard to prohibit you from that. Even if your were a really bad person, they try a lot so you can see your child. in the worst case they put a social worker in your family who helps. You have many many more rights in Germany than in the US, even when you don't have custody. The court here is also not more on the woman's side than on the man's side but it is very equal. Of course there are always cases that you wonder about why they decided a certain way. But generally speaking it's a pretty fair system.
So sorry. I lived in Stuttgart for years, and am now in Wiesbaden. My husband’s ex is similarly toxic, although his kids are grown. I have thoughts on this… and honestly, I would expect your wife has to adhere to a code of ethics for her license. If it were me, I would approach the US consulate, her professional licensing authority, and anyone else who might force her back to home turf. That’s where this battle needs to be fought.

As a rule of thump in Europe. The mother will always get custody. You have the opportunity to take her to court to reverse the decision. Or even take her to court in the U.S

As a police officer, let me say the following: it is not the job of the police to make a decision in such disputes. Nor are they allowed to. A decision, as required in this case, can only be made by a court. The police must "ward off danger" in such situations. The simplest way of averting danger is to separate the disputants. And here the man, as the physically superior person, always has the worst cards. And believe me: no police officer likes to make this decision. Family disputes are the worst case scenario for any police officer...
I watched the entire video, Trey, and I'm so sorry you're going through this. I'm sorry Golden had to deal with this because I'm sure he misses his dad, and he doesn't deserve this. He didn't ask for this! I really wish your wife would have been a grown woman, like she is, and been honest with you so you guys could come to common ground where both of you can foster a healthy co-parenting relationship, at least for the sake of Golden. Trey, if everything you said is true, I'd encourage you to fight through the legal system in Germany to receive custody for your son. Is there no proof of her falling off the scooter in the US, a foto, or a wittness who saw her bruises and can confirm that it wasn't you misstreating her, but an accident?
Claiming that a crime occurred (which obviously would have been the case if you'd hit her) while in reality it didn't, is a criminal offense here in Germany (§ 145d StGB Vortäuschen einer Straftat). If she claimed to the police, not even speaking of the court, that the bruises she presented were the result of you beating her up, but you can proove otherwise, it would get her a criminal record. She most likely won't go to jail for that, but it would weaken her position in family court concerning custody of your son immensely.
Also, the lowest instance of courts in Germany will traditionally side with the mother of a child. This has its (rightful) reasons, because concerning domestic violence, in 99,9% of the cases the man is physically stronger and is a much more "dangerous actor" in such situation. But the higher level of a court you go to, the higher the actual quality of the judicial decision will become.
And don't, just don't care about what the police is saying/thinking. Their opinion is absolutely irrelevant, what matters is proof, hard facts, nothing else.
I have evidence of everything from December until now including text messages of her telling me she fell off of the scooter. Pictures as well. I hope the German courts will consider this evidence in my case because I have tons of evidence.

They tend to go a long way to justify their decisions, and in case one court doesn't, you have good chances to get the ruling revoked at the next level.
Germany is a constitutional state after all, and one of the highest order in international comparison I would claim. That doesn't mean it is perfect and infallible (nothing is where human beings are involved), but the quality in generall is quite good. And the days were the courts here blindly ruled in favour of mothers when it comes to child custody are definitely over!
@@larsengstfeld6744 but a big problem are still the Jugendamt, they often act like a 3rd party in the legal fights and have sometimes very bad (and corrupt) appraisers and courts then follow often these wrong appraisers. So everything has to be thought through very well in advance with good attorney - and, larsengstfeld, who can afford the fights at court until you reach higher court levels?
@@mattesrocket The "Jugendamt" can be a problem, but not necessarily. The one I had bussiness with about ten years ago was acting very careful, and very cooperative.
And if you have trouble financing the legal process, "Prozesskostenhilfe" is also availible to parents who fight over custody.

I am sorry to hear about your ordeal. I think what it boils down to is, that German law states that the Mother has the "Aufenthaltsbestimmungsrecht" meaning even though you both have the same right to raise your kid, she can decide where the kid is allowed to go and where not. There is no way to take this right away from a mother except if she does something very detrementing to the kid... The police is not allowed to decide in those cases, they do not decide the law, they just try to deescalate the situation and adhere to the law. There is no wiggle room for them to make decisions in regards to this. Hope that helps to explain why even if the police officers were on your side and believed you, there was nothing they could do at that point. The judges have to decide. It's going to be hard, but remember, there is also rights that apply to you, for example you do have the right to see the kid for two days every other week without the mother being around... just work it out with the lawyers and the judges... I am in the health care business and I can tell you I have seen health professionals using what they know to twist facts to help “their story”. I didn't know you before this day. I - more or less - came here by accident as a suggestion from UA-cam as I watched a video from an American UA-camr who lives in Germany.
And yet, this story makes me really sad. Very sad that kids always have to suffer the most from cruel parents, regardless if it's the father or the mother.
Even as a native German (formerly from the region around Stuttgart), I'm ashamed. Women often get the benefit of the doubt here.
I am so sorry for what happened to you. One thing is that your wife falls in love with somebody else (hard enough)....but... It`s so crazy when a person doesn`t realizes that a father is so important for a child. That reason alone should let her act and do things totally different. You repeated it at the end of your video and that would be the hardest point for me, too. Keep your head up and keep fighting for your son. I BELIEVE IN YOU!!! I have two childs, too and i would literallly do everything for them. The precudices of the police......oh man.... i can`t even think of a situation like that. I see it in your eyes - your good and strong. Go for it, even it is a marathon ;-)

The second part of this wicked intrigue on you and this terrible attack on you as a father and separating you from Golden reminds me of many heartbreaking stories I was told by desperate fathers here in Germany. I always believed in the importance of fathers and had myself to live without my father because of his early death. So I always I let our children get in touch with their father and they still have a good relationship.
But many other mothers didn't do the same...
I feel shame for our police and the Jugendamt. And I don't really understand why your wife got the Aufenthaltbestimmungsrecht for Golden. I suppose this happened because the judge expected your wife to stay in Germany in the future and you to return to the US. The judge wanted to avoid a separation of mother and child. You said that your wife and Golden now have returned to Florida, too. Are they now back for ever? If yes, the American family laws are now valid. And what about your wife's 'mistress'? Is she coming to the US, too? Or will your wife return to Germany?
I'm so sorry and also angry that this can still happen in Germany. Most authorities believe the women more than the men, and that is sooo unfair! I used to be a member of the Vaeteraufbruch fuer Kinder, you find it in the internet under vafk. I recommend you to get in touch with this organization. Maybe they know a similar group in the US. I learned a lot about PAS (Parental alienation syndrome). Please don't give up!

Hi Trey, what a video. Sorry you had to go through all of this. Your wife took advantage of your kindness and big heart and you played into it till the end. I know you will do whatever it takes to be with your son, but you also have to be like Gordon Gekko and step on others toes. Unfortunately, nice people will not make it!
Be strong and see how you can get a visa for Germany to be close to your son. It might take years, but never give up. Best, Martin

I feel very sorry for you. I expiranced similar things. My partner cheated on me and left me, in the worst moment possible, when I lost my job, my mother got very sick and our kids had serious problems in school. He just did not care for anyone just wanted to have fun. And he treated me like criminal as well. Just because I was not happy with the situation. But he was the one cheating. He even wanted me to move out of my own apartment and take the children. But that did not happen. It is still illegal to steal somebody's property, children and their whole life.
Since I watched this, I've several times tried to write a comment.
But none of what I wrote seemed to be right or helpful. So, I didn't post it.
However, what I would like to say is that I hear, understand and commiserate!
