Digimortal was an album the band hated making. They had to do it in order to comply with their record contract obligations. It was either that, or get taken to court. That's why so many top name metal acts are setting up their own record labels now. You get all the money from your CD's and you have total creative control.
You're wrong on Digimortal situation. They had fun making it, I read a lot of interview from that era and more recent. It was radio-friendly because of label politics, they wanted FF to gain more money so they actually made them record more polished songs. Nothing to do with court as far as I know. Now Fear Factory actually doing futuristic model of relations with the label, they licenced them their masters. So I guess FF learned the lesson for good.
A lot of the interviews, at least around the time of the breakup were hatred fueled, and it stemmed between Dino Cazares and Burton C. Bell's musical differences. It was an uncomfortable album to make. You can also note that many internet sources (including Wikipedia for that matter) state that the band wanted to stop right then and there after Digimortal, but had to release the "Concrete Album" and "Hatefiles" which otherwise probably wouldn't exist or would at least have had more love.
All that being said though, I like Digimortal to an extent, too. I think die hard fans of metal bands tend to cause a commotion about anything slightly different than what they hear out of the band normally.
I think people are quick to judge because the "industrial" part of the album is missing. It's pretty much metal, although I have no problem with that. The album was also very poorly mixed. The guitars sound pretty weak and the drums don't have much impact.. Even Christian Olde Wolbers (guitarist at the time) himself said the sound of the guitars made him sick. If they had spare time I'd love it if they'd re-record the album with Dino Cazares. I'd gladly buy it a second time.
half of transgression is pretty great. the other half is pretty meh and the mixing/production is pretty meh. this is the main reason why its rightly considered one of FFs weakest records along with The Industrialist. Contagion is a great track tho
i would do the same. its a shame they wont play anything from archetype or transgression live. personally i think contagion is one of their best songs in general, i like it better than pretty much anything on digimortal. though the album in general i agree, is weak in comparison to the others. not horrible, but not great either.
i really dont get the outright hate for the transgression album. this song is fucking awesome. so is 540K, moment of impact, and echo of my scream.

Hell Yeah! I fucking love Transgression & all FF albums starting from the demos to now. I don't understand why people hate Transgression.
