It’s pretty rich for Abbott to claim that Title IX was based on the fundamental premise that there are only two sexes, being male and female, when there is nothing in the text of Title IX that makes such a declaration or definition. The only thing that even comes close is in the 8th exception clause to the Title in which it says that if an educational facility receiving federal funds provides any activities related to mother-daughter or father-son activities, then it must provide similar activities to “the other sex”. That is literally the only place in the entire Title’s text that seems to refer to a binary, and even that binary is incomplete - it has nothing to say about father-daughter or mother-son activies at all, and you could have those even with only two sexes, and since that text only finally shows up in the 8th exception clause, it’s an Olympic gold medalist gymnastics-level stretch to presume that the same applies to the whole of Title IX when Title IX makes no such claim itself. It simply says that you cannot discriminate on the basis of sex, and as the Supreme Court has ruled multiple times over, you cannot discriminate against someone’s sexual preference or gender identity without that discrimination being inherently related to sex.
You people who don’t like it - guess what? Title IX *_ALREADY ALLOWS FOR EXCLUSIONS FOR YOU_* in that if it’s an educational facility that is religious, and if it violates an inherent tenet of that religion, then that discrimination is already exempted from Title IX. In other words, *_YOU PEOPLE ALREADY HAVE YOUR RIGHTS AND ARE NOT AFFECTED BY TITLE IX TO BEGIN WITH!_* Leave the rest of the world out of your personal halls of worship, lest you be dragged against your will into someone else’s and forced to worship their gods and follow their beliefs and rules.

They tried giving them their own teams in a couple places and no transgenders signed up. Which shows they actually want to win against females and not actually do the sport.

Title 9 says something about discrimination based on gender, well, if you are a 'Trans girl/woman' you surely aren't 'female' (hence the prefix Trans).
The original title IX legislation statutorily lays out whom is protected, The Dept of (mis) (il) education has no ability to change provisions enacted by congress.
