You could DIY a 2.4GHz and 915MHz system by putting a microcontroller between the FC and the two radio receivers. The microcontroller could pass through the 2.4Ghz signal while it's there and switch to the 915MHz signal if needed.
This would introduce some latency but it would be miniscule (maybe a few microseconds). The only latency blip would occur when a switch in signal was needed.
Its just not needed for most purposes. I've never had a single failsafe with expressLRS in over 2.5 years of use, and I like to interpret the definition of VLOS broadly. I use the HappyModel ES24TX Pro module configured fro dynamic power up to 1W and it is unbreakable.
Try flying under EW jamming and you'll change your mind about whether it's needed or not.

The current regulatory atmosphere makes it doubtful anyone would invest much effort or development resources on something that has minimal to no market. Gemini has barely caught on (it really hasn’t though) let along a non-encrypted dual band link for hobby users.
How do you know that it hasn't caught on? There's only one module and one radio. Just because it's been around for three months doesn't mean that everyone will rush out and squander their pension. I think most freestylers can manage with the normal ELRS on their 1-5km range, so they won't switch straight away like I did. But when you switch radios in the next few years, everything speaks in favor of getting a Gemini. It's a good failsafe precaution.
There will be people who invest their time and effort in this and there is certainly a market in Europe right now, but mainly not in the hobby market, so to speak.
