hi, my husband filed my I-130 last April 2023 and got approved this April 2024, when he filed it im not yet pregnant. but this year, I am. my case is DQ. and patiently waiting for the schedule of interview, may I ask if we need to inform USCIS about this pregnancy? thank you.
Since you are DQ'd USCIS is no longer involved in the case. You will have to inform the embassy once you give birth unless there is a reason to expedite your case then you can ask for an expedite. Also look at whether your child would be a citizen at brith if yes then start preparing for the CRBA process now.
What if I the husband is a U.S. citizen and my wife will have our baby a few weeks before her Visa interview in Jamaica, would my new born automatically become US citizen??
It depends on if you qualify for CRBA, if you do then yes child will acquire citizenship from you. You will need CRBA and US passport for the Child for them to be able to travel to the US. Hello, my fiancee who is the K1 visa petitioner is pregnant and due in 3 months. Our case has just been approved by uscis. Do you think we have a chance for getting the visa or would face some challenges in the rest of the process?
Your fiance being pregnant with your child will only help your case not hurt it. USCIS is aware that you want to build a life with her in the US and he being pregnant will only show the officer that you two are in a serious relationship and have every plan to marry. Congratulations!!
Hello My husband is a green card holder , and I gave birth while I'm waiting for the interview, now my baby is 10 months and my interview has been scheduled for the next month is there any solution for my baby to come with me?
Inform the embassy of your child immediately and ask for the child to come with you. I recommend working with an immigration lawyer to make sure this is done right. You can schedule a strategy session with me here calendly.com/lillylegal/strategysession
Hi... I'm pregnant and i want my boyfriend come to my country to support and take care of me, and he wants too. He's filipino and i'm half. He went to the Embassy but was told to wait for approval for 3 months. Can i issue something to make him come as soon as possible? I really need him right now.
Hello i had interview 20 days later is there any possible for me to get approvered because i am pregnant I hear from some people that they hold me until our child born but I want to have my have my child in us can you pls give me any information about this thank you
It is up to the officer. If you receive your visa before you give birth then you can travel with the visa. if you give birth before getting your visa then you will have to make arrangements for your child as well.
Yes there is nothing prohibiting a pregnant woman from applying for an F-1 visa as long as they qualify for the visa. As always it is up to the officer to decide whether the person qualifies for the visa and when to issue the visa. typically If child is born before visa is issued then child would need a visa to travel with mother.

Hello! If I’m a US citizen and pregnant will this expedite my foreign fiancé’s visa so he can be here when I give birth?
pregnancy can be a reason for expedite but it should be tied to financial loss and/or health concerns. And of course backed up with documentation.

He has to qualify for the visa he is applying for. He can request an expedited interview with proof of the Humanitarian Urgent reason.

I applied for EB3 visa now because of the retrogression i plan to conceive,is it a bad idea?
If you are outside the US and applying for the visa, your child can be added on as a derivative once the visa becomes available.

Hi, my wife applied for k-1 visa and we are waiting on it still. How long will it take my child to get their passport?
It depends on the embassy. Some embassies are taking longer than others. most are taking 6 months or more.
