Most courts will not honor late fees, even though they are specified in the lease, and legal fees are usually submitted as a separate request. Even if the court sides with the landlord, they will not get legal fees if the tenant had a legitimate case.

Regardless of whatever issues there may be with a domicile, withholding rent is NEVER the solution. You might be able to use the issues as a defense at your eviction proceedings, but you're still going to get evicted.

He should have told the Defendant his right of appeal but only granted appeal after he submitted Bond in full amount of Judgment. He's not going to pay so there will be no appeal. He'll be there until the Sheriff throws him out or at least until the day after the Landlord goes back to Court for final eviction Order.

Your only protection is yourself so you better learn landlord tenant laws of your city or town. All basic but often different items you’re not used to. You’re paying rent you have rights-KNOW THEM. Protect yourself and landlords protect themselves, and often disputes can be avoided. 🤔🙏🏻

This is the same problem that SovCits have. They read a single line from a single piece of legislation, and immediately think they're legal experts. They don't seem to understand that the law is often complex, and context matters. And that any given law may not always apply universally, or it might have other preconditions that also need to apply for it to be relevant.

I suspect in most jurisdictions it is illegal to blackball a difficult or dead-beat tenant. One need not do that. Responsible landlords follow up with previous/current landlords when a application is received. All the current landlord need say when asked for a recommendations is; "I would not willingly rent to this person again." Can't fight honesty.

While obviously the guy is wrong, I wish the legal system had a little more leeway on these matters because the local government is invested so deeply in real-estate, they practically don't do anything on purpose. You have landlords who don't fix anything, don't enforce any of their policies on noise and disturbances. Leave you without water or without hot water, make billing mistakes on their end that your side ends up paying fees and penalties and supposedly your recourse is, the person living paycheck to paycheck, to get an expensive attorney somehow which has a 50/50 chance of winning a suit against these companies. If you look for help, the only answer that actually applies to middle-lower class people. Stop pay rent. Wait for them ro either fix the issue or sue you, in which case you have a small but possible chance of getting a compotionate judge who understands. Worse, local government want more abusive rentals rather than building more houses and apartments for sale. If you live in an apartment in the South West, you know what I'm talking about.
But if I let them in and they repair it I would be expected to pay rent.. .see how that works... if I don't let them in I can complain about repairs and problems and stay for free. He mentioned ONE month, so okay, give them that month free but they have to pay the rest. Also, why were they not required to put money in a escrow account until it is resolved.

I suspect in most jurisdictions it is illegal to blackball a difficult or dead-beat tenant. One need not do that. Responsible landlords follow up with previous/current landlords when a application is received. All the current landlord need say when asked for a recommendations is; "I would not willingly rent to this person again." Can't fight honesty.

I don't know what people think...the Landlord has expenses but they expect to live rent free.

While obviously the guy is wrong, I wish the legal system had a little more leeway on these matters because the local government is invested so deeply in real-estate, they practically don't do anything on purpose. You have landlords who don't fix anything, don't enforce any of their policies on noise and disturbances. Leave you without water or without hot water, make billing mistakes on their end that your side ends up paying fees and penalties and supposedly your recourse is, the person living paycheck to paycheck, to get an expensive attorney somehow which has a 50/50 chance of winning a suit against these companies. If you look for help, the only answer that actually applies to middle-lower class people. Stop pay rent. Wait for them ro either fix the issue or sue you, in which case you have a small but possible chance of getting a compotionate judge who understands. Worse, local government want more abusive rentals rather than building more houses and apartments for sale. If you live in an apartment in the South West, you know what I'm talking about.
But if I let them in and they repair it I would be expected to pay rent.. .see how that works... if I don't let them in I can complain about repairs and problems and stay for free. He mentioned ONE month, so okay, give them that month free but they have to pay the rest. Also, why were they not required to put money in a escrow account until it is resolved.

I often thought it might be nice to be a judge. However, after watching many of these videos I would not want to be a judge for love or money.

Judge Simpson is too on edge to deal with this. I've never heard him make so many excuses for landlords before. We don't know what the rest of those sections said and denying entrance one out of ten times doesn't disqualify people from having a clean safe place to live.
