Thanks for this, "best interests" is one of the most misunderstood and misused concepts when it comes to disability and care / medical decisions in my experience. This helps to explain things properly. "Best interests" is not just what a carer or doctor feels is best for a service user, and you can't always tell capacity from outward appearances and behaviours either.I'm thinking specifically about the Oliver McGowan case, the medical team did not seriously attempt to accommodate his needs and didn't do a proper assessment of his capacity to understand the decision. He didn't want to take antipsychotics because they weren't effective and made him ill. His parents didn't want antipsychotics administered for the same reason. Specialists in mental health also concurred with this decision and advocated a drug-free approach. Hospitals he previously went to also advocated this opinion and documented severe reactions to these drugs in the past. Yet, the doctor treating him administered them anyway without his consent, and later cited "best interests" for her decision. She clearly thought that "best interests" meant her personal assumptions of what was best.

Very clear on the topić. Thank You.
Unfortunately due to complexity of MC, errors might occur. Maybe the american way of interpreting the MC decision is best in the long run.they would shift reaponsibility of mąking decisions to the NOk automaticaly. No other institutions arę involved. Limiting administration and time to minimum.

Basically, you can do what the hell you like to "patients".
