The Ohio case that is referred to in the comments was based on the length of the cheek rest that had a rubber tip attached so that the pistol would stay upright in the defendant's safe. The BATFE's action against the defendant failed for three reasons. First, BATFE did not make the requirement of a pistol brace not exceeding 13.5" known to the general public. Second, the BATFE measured the defendant's brace improperly, arriving at a 13.75" length which is a violation. However, when measured according to BATFE regulations, the brace came in at exactly 13.5" in length with the rubber tip attached. Third, the defendant did not know that his adding a rubber tip to the end of the brace was a violation and it did not alter the way in which the brace performed while firing the pistol.
