      Okay. The first thing you need to look into is a Vornado shop fan. The walls are porous and
      the smoke molecules are much smaller than the holes in the walls.

      And our property value!!!! As a condo owner who bought this place specifically because they don't allow smoking in the rules, I'm considering suing. This on top of the fact that my neighboring victorian apt house turns out to be a heroin rehab with NO SIGN we were definitely conned being from far off places and didn't know any better!!!! The centipede infestation tops the nightmare!! Oh and the smoker tampered with my electrical outlet causing me to get electrocuted in our shared basement. Authorities did NOTHING. To think I relocated here to continue my studies and help with the severe nursing shortage. Should have taken my smarts, skills, investment and taxes out of state as I really wanted!! I have no idea how I'm gonna sell this place and resale was a huge factor for me. I have a list of people I plan to go after legally speaking, what a hell!!!! Lots of other horrors to this but I'm sure you get the picture!!

      The problem is id that smoke always affects everyone else around them. It travels and travels and you can't keep a far enough distance from smokers. I take the bus all the time and it's everywhere sitting at the stops. And then my neighbor who lights up every hour or so and her smoke comes gushing into my house immediately after she lights up. It's like the smoke is actually looking for me because it should just go east from the wind but travels straight and then makes a quick right into my house

    Cigarette smoking should’ve been illegal by now. They make others things legal that shouldn’t be, yet they allow cigarette smoking to remain legal. The one Vice that negatively affects the health of those around that person. Smokers don’t care. They have an arrogant attitude about it too.

IM SO SORRY I MOVED TO A RURAL AREA THINKING THAT LIVING ON A SMALL ACREAGE ID BE SAFE FROM WOOD FIRE SMOKE BUT IM NOT SAFE. IVE BEEN PUTTING UP WITH IT NOW FOR OVER 9 YEARS.       2 yrs later and I am doing this right now. Old ass 79 year old drug addict won't go outside to smoke. She has Buerger's disease and has had all her toes on her left foot chopped off and still continues to smoke.

    There is no safe amount of second hand smoke. We should have a worldwide ban on smoking in apartments and condos. It may even be more deadly to smoke while we are in the middle of a pandemic.

      It’s banned in my building and it doesn’t stop my neighbor. I told the leasing office then she threatened me and intimidates me when she sees me. And she still smokes pot! I honestly hope she gets lung cancer but hey I’m the one inhaling the second hand smoke so who knows...

      Actually, for me, even though pot is not for me, I don't mind the smell of it. I wish that was what my neighbor smoked. UGGGH!!

IM NOT IN AN APPARTMENT BUT I LIVE ON ONE ACRE OF LAND IN A RURAL AREA AND WOOD FIRE AND OUTDOOR FIRE SMOKE SEEPS INTO MY HOUSE AT NIGHT WHEN ITS PITCH BLACK OUTSIDE. PPL AROUND HERE JUST DONT CARE LESS ABOUT NEIGHBOURS AND THEY ALLOW THEIR FIRE PLACES TO BURN WHILE THEY SLEEP AT NIGHT WHICH MAKES THE SMOKE EVEN WORSE.     Property owners and landlords need to be held accountable for not evicting smokers immediately for breach of leases!

    Gratitude! My neighbor below me is negatively affecting my 3yr old child & my health. Everyday her cigarette 🚬 smoke travels up to my apartment. I experienced headaches & nausea. My oil diffusers, fans, & open windows are not combating the smell. I feel like I am right next to her breathing in the smoke & I don’t even smoke. I need a personal injury attorney like her.

    My condo allows people to smoke right outside our windows! Its horrible and I'm a 20 year paralegal and I read about the n.y. ruling and im going to use it as my precedent. I'm absolutely suing them! Thanks for discussing it.I'm on the right Track.

    They should have a designated area for smokers.. a small tiny room with no windows .. fog them up while they’re in there so they know how it feels to not be able to breathe and struggle .. my fucking chest hurt right now and can’t sleep from all these smoke 😭😭

      if one person smokes in teh building and the building isn't sealed, smoke can STILL travel to other units. There is a saying that goes if one person smokes in the building they all smoke.

    I'm in this exact position. I'm INUNDATED with secondhand smoke all day in the new apartment I purchased in a coop. I have tried asking nicely, wrote a note, and brought it to the board. All I want is for them to GO OUTSIDE!!! But this gives me some hope if they won't take action.

    This isn’t fair I’m bout ready to sue all my neighbors it’s all of them my nose hurts so bad my head my lungs and I have babies living here. It’s depressing we can’t even leave because now the market is effed up compared to when we moved in five years ago. We didn’t plan to be here this long, we rushed into this situation because we had to and now we are stuck. I hope my babies are okay that’s my main concern. It isn’t fair. I feel like it’s coming from downstairs, and both neighbors beside me it sucks and it’s so strong. We have to just deal with it and die I guess.

      I'm in the same boat. People that live behind me live in a house. They sit outside and smoke,it goes right into my bdrm. The neighbors on left side of meive in same apt as I do. They sit in their patio and all the smoke comes into my kitchen and living rm. The owner doesn't seem to care! I am pissed!

      I LIVE IN A HOUSE, A BIG HOUSE AT THAT AND ON A SMALL ACREAGE AND I STILL COP FILTHY WOOD FIRE SMOKE INSIDE MY HOUSE. IM THIKING OF TRYING TO FIND SOME TYPE OF PLASTIC SEE THROUGH SHEETING IN HOPES TO STOP THE SMOKE FROM ENTERING THE SECTION OF MY HOUSE WHERE I SLEEP. THE COUNCIL ROUND HERE HASNT FIXED THE PROBLEM OBVIOUSLY. I GUESS THEY DONT CARE BECAUSE THEY DONT HAVE TO PUT UP WITH IT.

    This is good information to know. I live in an apartment where I get an over powering odor of secondhand smoke (weed) from neighbors. The only way to stop the odor coming in is to turn off my A/C in the summer or heat in the winter. Either way I am the person being inconvenienced. This happens while I am trying to sleep at night, early morning or anytime they decide to lite up. Making it hard to breath, I get headaches and very sore nose that now have formed sores inside. I have been trying to heal, but have not because of the odor. I need help, have complained to the rental office but still have to deal with not being comfortable where I pay rent to live.

      Pamela Bagley sane here landlords don’t care because they ain’t got to live here. Throat irritation, blood shot eyes, headaches, chronic sinus infections mucus in throat burning lung sensations my life here is hell on earth due to poorly insulated apt and retired neighbors who feel the need to light up every 20 minutes and stand on shared porches allowing smoke to permeate building. Landlord says he will talk but he ain’t no help says not much he can do. He refuses to put non smoking clause in lease due to greed of money

      im litterally going through the exactl same thing you are right now, i have been for the past 4 years, landlord who wont do anything or listen to me, no one helping me at all, i cant move cuz i cant afford a new place, and i have to open my windows to air out my apartment and its winter here, cant turn on my heat, and im the one who is always being inconvenienced. my mood is off and im angry all the time, my health is bad, my asthma is back and worse, and there is nothing i can do to change this situation.

    I live under a neighbor who has been smoking for 4 years straight, he is 60 years old and in a wheelchair but is perfectly capapble of getting outside and smoking outside, i saw him exiting his apartment to smoke outside the same day, then he went back to smoking inside. he flushes his ciggarettes and whatever else hes doing down his toilet and opens his windows to hide the evidence, and he hasnt gotten caught yet, he is constantly vaping and smoking regular ciggarettes in his bathroom which fills my bathroom with smoke so i cant use it, then he starts to wander around his apartment while smoking and fills my entire apartment with smoke, it is so unbearbale i have to leave my apartment, i have asmtha, and i get chest pains and nausea, and feel sick and have gotten so sick that i ran out of my apartment and puked because the smoke is so strong, its like living inside a massive ashtray/ciggarette! i cant live in my apartment, but i also cant afford to move anywhere new, so im stuck........ my landlord wont do anything about it, she doesnt believe me that its happening, ive coughed up blood too, my kitchen cabinets, both of my microwaves, and my oven are all filled with his vape smoke and cigg smoke, its so disgusting! on my apartments application it says this is a non smoking property! funny it does because i see everyone smoking around here and there are ciggarette butts all over the ground, and no one smokes at the designated smoking areas, its so bad to be around these people, it is so gross, all of my things in my apartment reek of ciggarettes, the smoke gets all over everything, its now winter and there is snow outside and i have to open my windows every second because my neighbor is chain smoking, meanwhile hes flooding my apartment with ciggarette smoke and Vape smoke, you know, vape smoke that has killed alot of people lately....... smokers should be rounded up and put in dwellings far away from the rest of us who dont smoke so they dont give us cancer and threaten our lives and health. I requested that my landlord move me to a different unit so i could get away from my neighbor who is smoking but she refused to move me! so my landlord wont help me at all and doesnt care about my health. im about to sue my landlord and my neighbor for damages. my right to quiet and peaceful enjoyment of my apartment has been ruined for too long, i just dont know if its worth it. all i know is i need to move away from here for the sake of my health. staying here is killing me and making my asthma severely worse. i already have a dr's note stating that i need to get away from the ciggarette smoke next step is talking to my lawyer. meanwhile il continue to suffer. all i want is clean air but thats too much to ask for. us non smokers should have a right to breathe clean healthy air! ive lived here for 10 years and have dealt with smokers since day 1.

      @@Perfectlyradiant_The problem is not just the odour which is stinking but it’s the chemicals that are triggering asthma attacks and asthma attacks can kill. I have almost died from asthma attacks because of this same problem. My health is ruined my life is ruined, all my new furniture is ruined particularly the soft furniture because smoke damage is permanent. I’m not insured. I’m sick and disabled and unable to work and moved to a new build because I am now wheelchair reliant and needed a specialist housing. Unfortunately people don’t stick to the no smoking policy on the tenancy agreement and the housing association does not enforce it. Nor do they care a jot about anyone else but themselves and their bank balance. Even third hand cigarette smoke is dangerous for asthmatics because of the residue left behind. That’s why I will need to dump all my new furniture. And I’m not insured. I have very little belongings. Everything is stinking of cigarette smoke.

    I'm now living in a non smoking building which all tenants signed a lease stating there is no smoking in this apartment complex or on the patio. And still tenants ate smoking and the land lord said they cannot do anything until they actually catch them smoking.

    All my neighbours smoke and it's sucks I'm surrounded by 8 houses who smoke I wake up to it and sleep with it sometimes I exercise in the garden and how to breathe that shit I want to move but houses aren't affordable neither is rent with a grad salary f the law

    My dad I swear doesn't work, just sometimes, we live in a town house. He chain smokes inside, my grandmother sleeps downstairs in living room, the air handler for the house is in a closet in his room. He chain smokes and watches movies all day I swear to God. I have a fan in my window constantly blowing in fresh air on high. As soon as I open my door, it smells like a weird gross ash trey. I think he maybe a type of sociopaths or a narccist

    I'm in a house that me and my family are being overwhelmed with smoken of the neighbors smoking next door
    4 months ago I failed my preliminary test For my yearly respiratory Fit test. At this point I lost my job.
    I made a Appointment with Kaiser And I add the full on pulmonary Is new test done it also came back like I was a long term smoker. I've never smoked before. I have a lot of different symptoms like numbness and hands numbness and feet headaches Especially when I go in the garage to work.

    I'm battling this issue right now and landlord/manager isn't doing a thing to help. on meds for bronchitis. in Texas so I don't think I stand a chance in the Bubba state.

    Here having air fresheners nauseating smell coming from one apt, they use plug in smells to cover up drug smell. The drug smell and the air freshener travels to hallways, driveways, street. We can' open our windows for fresh air, they the place with nauseating smell has right to keep their windows and door. But other people can't open windows, doors, can't step out without smelling the nauseating smell. So guys how you handle this drug smell in California. I heard neighbor complaining about another person bringing boyfriend to sleep overnight and starting drug smell and traveling to her daughter's bedroom. Her daughter has lungs, respiration problems and oxigen tubes around in the home. So with or without lungs problem. The smell is causing problem a lot discomfort, headache. It's concerning smelling these chemicals.

    My complex is a mixture of owners and renters. I was told by the board that it would be difficult to enforce a 'no-smoking' policy because of the mix, and the initial contracts that allow the renters to smoke. I am 5 years into the constant stream of smoke coming from the apartment upstairs, renters, to the best of my knowledge, young, with a small family. I do feel for them. I was their age once, and I know that life is stressful, kids and jobs, and add that to living in less desirable accommodations. I do feel lucky though, that I am the type that 'would' abide by rules if I knew I was truly 'hurting' someone else, and even more so if fines were involved! I've even most recently, after the pandemic broke, wrote a letter to the management company, stating the detriment, and especially in this particular period. I asked that maybe they could consider an ''immediate emergency No Smoking Rule during the pandemic, given that it is a RESPIRATORY VIRUS, not to mention deadly. They sent me back a lame letter, saying that they understand that it would be nice if people would be more courteous during this time, but that they, in fact, ARE ALLOWED TO SMOKE in their units.Prior to this communication, I was told that they are only allowed to smoke on their balconies. So which is it, and does it even matter. I think not!!! I felt so deflated, I decided that the management company didn't even deserve a follow up from me. Wasted words, wasted time. I think that, yes, management companies are AFRAID to lay down the law, set some rules, because if the complex is not new and fandangled, mine is an older complex, so, then are those that can only afford to live here or a similar-type complex....are somehow our lives not as valuable as the next guy?? They DO SEEM to care if the buildings are vacuumed twice a week, landscaping is tended to at least once a week, and NOOOO...they certainly don't want ANYONE smoking in the hallways, the laundry room, outside on the walkway or the grounds. That's a No No, but to smoke INSIDE, and KILL the rest????? NO PROBLEM!!! What is wrong with this picture??? Honestly! Just because this is not considered a posh complex; LIVES MATTER LESS??? A friend knows how hard this is for me to live with. I am someone, pandemic aside, that works far too much, in order to just keep 'this' roof over my head; so consequently, in normal times, I am seldom home, gone for long stretches of the day, YET, This Is Still My Experience with the volume of cigarette stream filtering into MY apartment, whether I'm home or not. When I am home, no matter if a door is open for air, I am CHOKING on the smoke! I get the feeling that Nobody....and I mean NOBODY, gives a blank! I cannot afford to move either. This is hurting My Lungs, My nasal passages; permeating My Clothing, My Furniture. I work my tush off to exist, and to live 'here', and this.....is the end result!! How can I get the management company a/o board of trustees to really consider an upheaval and therefore a change? I have even entertained the idea of asking the tenants upstairs if they would please smoke outside, around the corner, or even in their vehicle if I paid them to do so...... I know...That is a stupid idea! Desperate, and stupid. Again....why does this hardship have to cost ME???? Don't I deserve Fresh Air??? : - (

    my x landlord let this guy move in and he smoked his weed. 24 7. I cranked up my stereo and blasted some hardrock all night until in the morning he had the nerve to tell the landlord her ignorant ass didn't care about nothing but the rent money. so every time he smoked he also listened to music i loved seeing him wobble off to work in the AM .He looked bad LOl. my ear plugs worked like a charm.

    The worst time is in the summer...You can’t even open your windows for fresh air, because of inconsiderate idiots smoking right outside of it. They go outside so the smoke doesn’t stink out there house, but they stink out someone else’s house, by smoking right outside their window. 🙄

    I’m lying in bed watching this, with a mask on, and breathing waves of heavy smoke from my neighbors. I’m disabled and live in subsidized housing. Smoking has been against the rules since November of 2014, and if anything it’s gotten worse. It’s a violation of HUD regs. I have Ehlers Danlos Syndrome (a genetic connective tissue disorder) and Mast Cell Activation Syndrome. As a result of my neighbors smoking, I now also have a rare and serious lung disease called Tracheobronchomalacia, or TBM. Basically it means that my airways (trachea and both bronchi) have been damaged and collapse just with regular breathing. I have an air purifier going 24/7 but it can’t cut the smoke. I discovered last night that clouds of smoke are coming into my apartment through the stove hood. I’m coughing almost constantly, and the TBM means I can’t clear the mucus and gunk (large, solid yellow chunks) from my lungs. The more I cough, the more my airways get damaged and weakened. The last few days my O2 levels keep dropping to 92%. I’m working on getting off social security through my business that I run from home - so I’m breathing this toxic garbage ALL. THE. TIME. Especially now, being quarantined for 3, going on 4 months. I really wonder if my neighbors smoking is going to kill me before I can even get off disability. I wish I could get legal help with this. This is whole situation infuriates me. My health is completely disregarded by these selfish, uncaring people. I don’t want anyone to lose their home, but dammit, enough is enough! The non smoking rule was announced over SIX YEARS ago! And still the smokers have more rights than I do.

      The projects only went "smoke free" on paper, to pay lower insurance rates. I did a lot of investigation on this as an asthmatic victim in housing myself. I went from marijuana in the projects in Massachusetts to owning a condo full of cigarette smoke!!!! I definitely didn't change let alone improve my situation. Next I'll try for a house, far, far, FAR AWAY from scumbag people and maybe civilization itself. I have a whole list of people I'm filing complaints against and probably going to try to sue. My capabilities to sell my property have diminished, the smoker should have to pay for loss in value. What's really horrifying is that I discovered months after buying that the victorian across the tiny narrow road clogging the place up with traffic I thought was an adult daycare, is a heroin rehab!! Their success rate is two hours for their graduates (on average!). I could go on & on, my life's a nightmare and you'd think with a name like House I'd have great luck with a happy home but absolutely NOT!!!! The smoker even caused me to get electrocuted after tampering with my outlet in a shared basement. She was angry I complained but this was after suffering near cracked ribs from coughing for hours straight, and kissing her ass buying her Sony ear buds to deal with her God awful NOISE!! This is a grown middle age woman, mind you. Not a young kid. Daddy bought her the condo. Such parents should be charged for crimes against society!!!! Such self centered individuals are the most harmful, dangerous ones there are.

    At my last apartment I lived with this for 6 months, complained to the landlady and they did nothing. I would come home, and the apartment would be stink of smoke like the person had been sitting on my couch lighting up. After a while all the clothes in my closet smelled like it too. I had asthma as a child and it got worse, I think I should have sued those assholes.

      What to do in the future if this happens again: The first thing you need to look into is a Vornado shop fan. The walls are porous and the smoke molecules are much smaller than the holes in the walls.
      Your brain is not clear enough to act if you are not getting enough oxygen.

      im currently talking to my lawyer to see if sueing my neighbor will work. idk if id win. but im like you i had asthma as a child and still do, i use an inhaler, and my health is so bad because of my neighbors smoke im gonna sue him, and quite possibly my landlord too because she refused to help me by moving me into a differnt unit to escape the smoke.

      I've had late onset asthma for 20 years. I'm dealing with a chain smoker, who lights up more than cigs. It's heavy and toxic! I live in a private building and feel like I have no say in the matter. The air quality has become horrendous and my breathing worse. I feel like I'm living in a smoke bubble. 😑

It's not logical to have a shop fan in an apartment blowing air around with that much force, and secondly it doesn't mean all the smoke will go out immediately, it can take awhile. No one's going to leave a shop fan on in their apartment to blow smoke out when they're not home and that's disgusting to come home to your place full of smoke. Non-smokers have a right to fresh air in their own space and being able to enjoy their apartment peacefully. No one wants to go out of their way to buy fans when it's not their fault, the smoker needs to smoke outside away from the building, they have the habit.

Those kids suffer second-hand smoke with little chance of getting away from it if the druggie parent smokes in front of that child. Cigarettes are drugs.       Having legislation that allows for smoke-free buildings is already a huge step. Unfortunately, in many countries, smoke-free buildings are not even considered legal! You can't prevent someone from smoking in their apartment, EVEN if that's 1 smoke-free building out of 999 "regular" buildings that they could have chosen instead. I moved countries twice partially because of this issue and now live in a smoke-free building. I would NEVER go back to living in a building where smoking is allowed or in a country without smoke-free buildings.
      I also don't understand how public health systems in many countries pay millions for the treatment of (entirely preventable) smoking induced cancers and diseases when people are dying in waiting rooms with non-preventable health conditions that are much cheaper to treat. And if you look at the links between smoking and type-2 diabetes, and the annual costs of treating diabetes just in the United States alone, this argument becomes even stronger.

    Hate to tell you I'm in a house and I constantly smell the young thugs cigarettes/weed all day, afternoon, and night. It's so strong it smell like they're in the house with me. I moved 8 times for this reason. This is really getting on my nerves...I've developed asthma from second hand smoke, I now have heart issues and I don't care where I've moved I still smell the nasty neighbors second hand smoke and weed.

      I have moved multiple times as well. I’m out of money to move and landlord afraid of losing money by not allowing smoking. Retired chain smokers stinking up my place. Tenants move out more smokers move in. Smoking on porches so smoke seeps into units. Can’t open windows can get fresh air the air inside and out is full of noxious smoke.landlord no help as typical nothing I can do but talk to them. Landlord only cares about rent check. He don’t care about his properties apparently

      I’m disabled and live in subsidized housing. When I moved here, 8 years ago, I had never had any respiratory issues. Then came asthma. Now, because of the smokers in my building, I have a rare and very serious lung disease called Tracheobronchomalacia. Basically, because of the smoke, my trachea and both bronchi (airways to and into my lungs) have become soft and weak. They’re supposed to be very stiff in order to allow oxygen in and out. Mine are now so weak that they collapse all the time, even with regular breathing every day. It sucks. Right now I’m using a CPAP to keep my airways “inflated” and open so I can breathe. Even through the CPAP, with all the filters, all I can smell is smoke. I even managed to get a really powerful Dyson air purifier, which is going on high 24/7, along with another smaller air purifier. It barely makes any difference, the smoke is that intense and bad. Now the Housing Authority (which manages my building) is pressuring me to move elsewhere, but that’s just not possible for me right now. It’s devastating and infuriating.

    Well the smokers have lots of options: they can smoke outside or if they want to stay inside they can use nicotine gum, chewing tobacco or even e-cigarrets (wich is less harmfull to others).     I know its common to feel empathy towards people, but please stop pretending smokers would care one bit about how their habbit disturbs others. They are like junkies, and when you have an addiction, no fucks are generally given to anything that will interfere with that addiction. It's just the nature of it. Even empathetic smokers will completly disregards the suffering they are afflicting on to others when it comes to their smoking habbits, so dont get any hopes up trying to reason with them. So we are in this pandemic now, and many of us have experiensed having important things taken away from us, like gyms, social meeting places, work, homes, freedom etc, all for the greater good. Why can't this be enforced towars smokers as well. They'll save money, and increase their physically health, and also gain mental stability in the long run. Just ban the fucking thing, it is such a no brainer.

    I have a consultation with a personal injury lawyer tomorrow. The smokers in my building gave me two lung diseases. Asthma first. But also Tracheobronchomalacia. Basically collapsing trachea and bronchi due to secondhand smoke. I even spent $800 for a Dyson air purifier, but it doesn’t even make a dent in it. Praying the lawyer can help. I don’t want any money, I just want to breathe clean air instead of that poison.

    If you own a condo unit in any state, and your CC&Rs have an Article in the by-laws about nuisance, noxious odors that coming into your space (unit) and it is making you sick, or sicker because you have prior health issues, you have options. Before you run to an attorney, the HOA, if they obey the by-laws themselves and expect others to do so, then they can actually fine (after 3rd notice requested by an owner who has a smoker puffing away below, above, next door) the culprit, they can also get a court order and have that person or person's step outside to smoke their poison. If there is no place for the smokers to go, then they can be ordered to smoke in their vehicles. If you have a lousy HOA/BOA, you can sue them for not protecting your property and most of all your health! The more documents you have, the more force you have if you wind up suing the smoker who is using a deadly weapon to kill you and or members living in your household! It's called attempted murder.

    I've put up signs, bright yellow in my apt/condo bldg. At one time at both ends of the building, at the entrances, and the laundry room. My signs were thoughtfully composed, and respectful to all. One day, heading up to get my mail, I saw that one of my signs had been tampered with! Someone wrote in Black Magic Marker on my sign, and exactly in the segment where I stated that "we all work so hard just to keep a roof over our heads, so let's please be considerate towards one another in regard to our second-hand smoke issue." In Thick, Black Magic Marker, they wrote....SO MOVE!! Morons, I'd say!!

    I have extreme respiratory issues & have been unable to find a place to live due to neighbors smoke, toxic Air-Freshener Plug-ins, carpet, etc. I have simple win/win solutions for all: 80% of apartments can go totally smoke-free, leave 20% allowing smoking so everyone can be happy. The Dept of Public Health Surveys discovered 80% of people prefer to live smoke-free.
    Also, in public places, have the tobacco industry pay for stand-alone buildings for purposes of smoking breaks, that are comfortable for smokers so they are willing to go there to smoke. These can be similar to the old phone booths (before cell phones existed), except larger obviously & to include seating, lights, areas for multiple people to smoke, but, enough of these totally insulated (so no smoke escapes) little buildings, so that the general public are not forced to breathe everyone's smoke outdoors.

    I just moved into a stunning expensive one bedroom in a prestigious high-rise. I have tracked cigar as well as unknown chemical substances for three months. Management, maintenance have checked- but, I get the run-a-round. It's more than a nuisance. I've been napping 3 times a day, tired, restless sleep. I am ready to move. I have stated my concerns multiple times. Anyone want to represent me? I need help. I am a quiet, non-smoking hard-working teacher- help.

    Yes, even though they smoke out in the Garage. We are not allowed to smoke in here. And I'm highly Allergic to it. But Smokers don't really care. 😡😡 I bought a Purifier hoping its going to help. And he shouldn't even be smoking....I hate smoke. Any kind.

    I'm not attached to another flat in my building, as I'm on the end, with a wide hallway one side and the stairwell the other. So, I think that smoke is coming through the ceiling. (It's a new conversion, so I'm really surprised.) But, how do I prove it?
    I've thought about going upstairs to talk to the person who lives above me, but I'm wary of it going wrong and becoming confrontational. It's a tricky issue. In the meantime, I'm suffering with throat irritation, inflamed sinuses and headaches.

      I bought an air quality monitor on Amazon. They tell you the type of volatile chemicals emitted into the air and if the pollution level is good, fair, poor or bad. One of the hundreds of noxious chemicals some cigarettes are made from is formaldehyde. Mine registered it often. My neighbors also smoked weed but cigarettes or nicotine is worse than the weed. Unfortunately I'm running into this in my new place I moved into last week.

    Mine is and my landlord refuses to fix it. I know my popcorn ceiling is holding in all the nicotine from the past 50 years. My landlord is too cheap to just tear out the ceiling and replace it. I'm about to send a warranty of habitability notice to them. All my clothes smell like nicotine after only living here for 5 months. Even fresh out of the washing machine they smell like nicotine.
    Opening the windows does nothing.

    I am completely at the end of my rope with our trashy, chain-smoking neighbors. I wish they would smoke inside their apartments. Instead, they smoke outside in the front and back constantly using both our patio and front entrance as their personal ashtray. The smoke just billows in through every crack and crevice. I have asthma (developed during childhood because of smoking parents) that I thought was managed. I am having to do breathing treatments twice daily now because the wheezing is out of control. The headaches that always follow an attack are keeping me down, too. I can't take this anymore. I am so sick of their filth! The landlord won't do anything about it. In fact, the landlord came to my door one time with a cigarette hanging out of her mouth. That is why she has no sympathy for non-smokers. I feel sick all the time from the smoke. It's causing significant health issues.
    I don't understand how smokers have more rights than non-smokers. This is the very definition of insanity.

      Can you afford to move? I am going through same thing. Even both sides of house smell smokey. NO place to get clean air. I can't afford to move. Every time I move it is the same crap. Smokers or noisy neighbors.

      Even if they smoke inside their apartment and in the same building you will still breath it and maybe worse. My neighbors smoke inside and the whole building is contaminated with the smell. The only option is to look for cleaner place.

    housing says they can smk as much as they want. its legal for them to end me.

    It amazes me when I see in Switzerland a law that will be passed to fine (3000$) and jail (up to 3 years) anyone who will increase the heater temperature in homes above 66 degrees Fahrenheit this winter due to natural gas shortage while here in US they are passing laws to allow more smoking technologies (filths) like marijuana and vapes even after a respiratory virus pandemic just happened and almost destroyed the world economy. Crazy world we live in!

    Oh my gosh I have this issue, but it's with my mother in law. When she comes to visit my baby the whole living room smells like cigarettes. My baby even smells like it, but I can't tell her anything because I would be considered rude or I think I'm obove her only because I don't smoke. Sometimes I'm told that I just want to keep my baby away from her. Which is not the case my baby will not go through this. The smell is disgusting the smokers may not smell it, but someone who doesn't smoke will smell how they reek of it. I'm getting tired of this and I wouldn't like to do this, but my child comes first. They smoke then I'm gone it includes family. If her father can't stop then I'm gone. I'm tired of putting up with it. He may be quitting, but no I'm not trying to be high and mighty. If you can easily disregard other people and puff away then we can disregard you as well when it comes to an issue you may have like being noisy ect.

My husband finally quit and now he gets me when a smoker comes around they smell. Of course the smoker never notices because they smoke so much they are used to the smell that they don't smell anything anymore. When I use to visit his place where he would smoke inside it was so bad. So I definitely get you. My eyes felt like they were burning my nose too and because it's inside they are smoking in when you get out your hair, clothes, all of you will smell like cigarettes because it just sticks so bad to everything. All your stuff too. Becareful! I'm a healthy person never had asthma, but I was beginning to have breathing problems.

      Yan Sfor thank you , only a month but it feels like eternity , I slept in the closet last night , my husband joined me , I only slept about 20-30mins though cause my dogs joined us in that tiny space ..haha..
      I’m like overacting but seriously I can’t take it , I haven’t slept since and I’m just over here laying on the bed but I didn’t wanna be a nuisance to my husband and his mom with my overacting ass or that I’m being rude but yeah .,I haven’t even gone down for breakfast yet cause my father in law is currently staying in the kitchen apparently that’s where he sleeps 🙈😭

    I've read quite a few comments and wondering if you live in a "smoke free" property? I moved into a highrise 2 yrs ago. The lady below me didn't smoke in her apartment when I moved in. Now she smokes like crazy. There is nothing I can do but move to a "smoke free" property. In NYS, the housing authority states that all dwellings must be "smoke free". Once again I'm moving.

      smokers will still move into "smoke free" properties. I always look for no-smoking or smoke free and every time someone moves in who is a smoker. My new neighbors don't smoke, but they have guests over constantly who do. I am done with apartments! I am going to find a way to move into my car or van and live in that. It may be small, but at least I will be able to breathe

    i live in a 4 apartment privately owned subsidized by Belmont Houseing in Buffalo NY. Other tenants smoke in the house and it comes into my apartment causing me to be sick. The landlord did tell them not to smoke in the house and they didnt comply. He doesnt enforce the non smoking ban. Shouldnt there be a law to stop that in privately owned housing especially when its being subsidized? They check everything to make sure its safe, electrical, running water etc but then allow smokers to remain and make it unsafe.

    I hate the smell the pot it makes me crazy it smells like poop and it’s legal now in AZ. I can smell my neighbors smoke also. Cigarettes marijuana pot. They smoke on top of me they smoke to my left they smoke in back of me it makes me sick pissed off everything and I don’t qualify for a senior nonsmoking apartment because I’m 52 1/2..

    Next door neighbors smoke non-stop. Gives me migraines. Can't find a lawyer to sue the HOA for my lack of quiet enjoyment in unit I own. This is BS. I can't afford to move now. I don't know what to do at this point.

    They should make it a law that anyone violating their lease by smoking in their apartment receive a ticket by an officer for disturbing the peace! That way there would be a decided way to deal violaters of their lease call the Police they come in and smell the violater ... If someone can be disturbing my peace by noise then why cant it also have to do with my lungs... Just think of the revenue it would generate and there would actually be a means to catch these violaters as landlords feel less inclined to pursue persecution....

    I live in a duplex and my nasty chain-smoking neighbors have zero consideration for my non-smoking family. The smoke pours out of the bedrooms in to the hallway at night, smoke comes out of the cupboards when we open them, I have trouble sleeping because my eyes and nose burns (no one should be sleeping in bed, period), my teenage son is afraid he is going to become sick because of the second hand smoke. If they want to smoke they can go outside away from the windows and doors. I just feel violated and disrespected because I and my family are forced to breathe in this trash regularly.

    I have a drug accident brother who gets high and smokes cigarettes all night and all morning with no sleep for 4 days straight in the apartment,and I can’t control him to smoke outside because he would not listen. He smokes mostly everyday in the house and I’m stuck in a small bedroom with no windows basically a closet.

    My apartment has no smoking inside on contract! And yet my neighbor fills up his apartment! So that of course fills up my whole apartment so I can’t sleep I get bad stomach cramps, itchy eyes etc. Yes I have tried talking to him but he is one of those I don’t have to do anything anyone else says type of people. I have reported it many times to my apartment management Maddox management and they say he told them he smokes outside! So they be leave him! Not once have I seen the a hole outside smoking plus if I go into my room it filled with smoke you can even see floating on the ceiling!! Any help would be great I can’t move right now because of money and this a hole is making life really hell! Thanks

      my case is that I am currently living in a apartment, and I have been here for so long living but I have neighbours who moved last year here and now are smoking amrijuana everyday. I have a family we all suffer rom asthma, and health problems sadly we do not know what to do. @@noyesv1

    NO WAY DO I FEEL BAD FOR PEOPLE THAT SMOKES AND/OR VAPES. It’s about time that focus is on passive smoking! Over 80% of the pollution from cigarette smoke are odourless and that is the where the toxins are. Cigarette smoke can pollute the air up to 500 meters away from the smoker.
    It will help nicotinaddict that wants to quit if cigarettes and e-cigarettes gets banned. It is difficult to quit if you are exposed to secondhand and odourless gasses + VOC that can pollute our air up to 500 meter!
