I believe Bang PD is strategic and a visionary - he will get Min Hee Jin out of HYBE, and likely need to shelve New Jeans, due to the parental conflicts - how can HYBE trust the group to not sabotage the company again. And New Jeans will be in breach of contract at that point. The Bubble Gum song and it’s plagiarism of Shakatak’s song will mean the song needs to be pulled, costing ADOR/HYBE millions of dollars already spent is just another example why HYBE should hold New Jeans and retire them. The girls of New Jeans can find other girl groups to join, but they shouldn’t be able to join/form another girl group together. That’s hopefully how HYBE will thwart MHJ.

This is the music business, repeat business. They may be talented but any group is only as good as their next creative work. They could use the time to work on their music, skills and be more creative. They could form new relationships with other artists who could help them grow as people and artists.

So this scandal will not only affects the Korean Branch of Business but it also affects their other Branches and 3rd party Partnerships around the world. Hybe has Compliance and Legal regulations they are required to follow. The other Big 3 are not run the same. She may have gotten away with this in one of those 3 but not Hybe.

It's striking how Min Hee-jin does seem to have many gaps in her story. Why is she being shifty about the company audit (which is HYBE's right to conduct)? If she has nothing to hide, then what's with all the layered stunts? And on it goes. If she simply wanted to get out of a contract, it's her right to negotiate, without such overt passive-aggressive unprofessional, petty behavior. Min Hee-jin's questionable behavior does look like it goes deep, and that she's been carrying on this way for some time. Kicking her show off with that orchestrated, attention-grabbing, dramatic press conference of hers was shady af. That's the sort of stunt people who are about to be fired or dragged through a lawsuit do in order to gain support out of desperation (often, when trying to divert from guilt), rather than saving it for a courtroom argument, when all the receipts/evidence can be properly presented and assessed, and both sides tell their stories, while a judge presides. There's going on hiatus (because you're fulfilling your civic duty as an able-bodied man) and there's going on "hiatus" like Western boybands (looking at you 1D) or bc your agency just doesn't want to promote you anymore in SK (Cf. Blackpink). If NJ ends up going on "hiatus" by the time they could have a comeback they may be irrelevant, because Le Sserafim and illit will have had time to build their reputation in the gg sector. BTS may also very well be ready for their comeback. When you look at the time and effort BTS put in to get where they are, the sheer amount of awards including daesang they've raked in, the records they continue to break even while on hiatus, plus their sales numbers over the years -- and they still got used by the Grammys as ratings fodder... I don't see the cultural relevance of NJ. Edit: want to ask the parents (assuming they're working corporate jobs) "What happens if you ever run into the CEO of your company? Who greets who? Who acknowledges who? Who can you expect to be upset about not receiving an insa?" And that doesn't even take into account that ADOR is a sublabel. BTS were sleeping for years in one room and sometimes where 10 trainees in one room. Bang PD didn't remember Taehyung's name for a whole year! Now we hear about NJ to get special treatment even as trainees and they have the audacity to complaint bcz the chairman of HYBE didn't greet back one of them while in the middle of a scandal in which they support his opponent !WOW! Seems like Hybe wants to get rid off the SM coded business from ADOR set up by Min Hee-jin. They want to turn NewJeans into a Hybe coded group instead of SM group. Which means Bang PD will produce their albums and they will use music producers within Hybe labels and not SM related partners like 250 and Jin-su Park from Bad & Native Records. NewJeans' sound will also change for that matter.

Maybe with the stock drop, HYBE can buy back some of their stock. It would be very nice if the BTS members bought more stock at the reduced prices....because we all know it will go through the roof when BTS has their comeback!
If they can’t make the insider trading allegation stick it still shows that action was taken on steps of that spin off plan so it’s available to be used for the breech of trust claim. I believe Bang PD is strategic and a visionary - he will get Min Hee Jin out of HYBE, and likely need to shelve New Jeans, due to the parental conflicts - how can HYBE trust the group to not sabotage the company again. And New Jeans will be in breach of contract at that point. The Bubble Gum song and it’s plagiarism of Shakatak’s song will mean the song needs to be pulled, costing ADOR/HYBE millions of dollars already spent is just another example why HYBE should hold New Jeans and retire them. Sejong Law Firm, representing CEO Min, said CEO Min has never committed any act that violates the commercial laws or the Ador bylaws. The dismissal of MHJ will cause irreparable harm to herself, NewJeans, Ador and Hybe. Please uphold the application for injuction so that MHJ can continue to serve the five year term in the shareholder agreement. Sejong also said that the Hybe audit was invalid. A reply to MHJ’s whistleblowing email and the start of the audit happened only 1-2 minutes apart and the audit was disclosed to the media that afternoon.
Sejong pointed out that article 415 of the Commercial Act only allows a parent company from auditing a subsidiary after a request for a business report is made and only if the request is ignored without justification or that the parent company has to verify the contents of the business report. (It’s 412-5 which I’ve attached here. I’m not sure how 412 and 412-5 interact and there wasn’t any commentary in the articles)
Kang & Chang on behalf of Hybe said, the crux of the matter is whether the court can order a preliminary injunction to prevent the exercise of voting rights, which is the core of a shareholder’s rights, and whether it is justifiable to allow MHJ to continue to serve as a CEO after committing acts of misconduct and breach of trust. In response Min’s side accused Hybe of unfairly editing and pieced together the content and that the parties had withdrawn repeatedly their consent to the content being made public.

It's striking how Min Hee-jin does seem to have many gaps in her story. Why is she being shifty about the company audit (which is HYBE's right to conduct)? If she has nothing to hide, then what's with all the layered stunts? And on it goes. If she simply wanted to get out of a contract, it's her right to negotiate, without such overt passive-aggressive unprofessional, petty behavior.
Min Hee-jin's questionable behavior does look like it goes deep, and that she's been carrying on this way for some time. Seems like Hybe wants to get rid off the SM coded business from ADOR set up by Min Hee-jin. They want to turn NewJeans into a Hybe coded group instead of SM group. Okay, so the "sampling" song is Shakatak's Easier Said Than Done, as the tone/color of the music is virtually identical to NJ Bubblegum!!!! Close your eyes, listen to the sound --- I couldn't tell the difference. The thing is "sampling" is legal IF you contracted with the former artist(s) to "sample" parts of their song for a different song! Apparently, Shakatak knew nothing about this possible "sampling" until alerted by one of their fans and posted a carefully written vague one sentence reply - thanks, we'll look into this!!!!!
