Bless you I would be exactly the same situation freaking out myself. My anxiety probably would’ve hit the roof. I still don’t quite grasp it all but then that’s just me. I kind of like understand now why there’s so many houses and farms up for sale that are half built make you wonder 😮. I always say there’s somebody worse off than myself out there somewhere are you can hold it together pretty well, but then you are talking on the camera. Another informative video, glad you got your head around it all, seems so complicated and confusing, it’s like the Portuguese government are targeting ex pats and leaving the Portuguese alone. They’ll have to be careful as if they carry on like this it’ll cause problems with ex pats leaving or maybe that’s what they want. Have you considered a 2nd opinion from another accountant to maybe give you a different outcome? Glad you’re not leaving as you and Abe are a great couple and we all would really miss you.

Portuguese government are NOT targeting ex pats, maybe ex pats can understand better the problems of the Portuguese, because changing the laws, believe me, I have 67 years and you are facing One time problem, but those who live here, that is why we do not think to live in a "Paradise". My father died 10 years ago, to make the division of two houses between the heirs, I am already owing 2.800 euros to the lawyer, now, the houses have to be sold, more money to pay to an agency, Energy Certificate (a mandatory document before to sell Or Rent), after, it will be the tax you call capital gains (mais-valias) of 50% and, worse, as the buildings were bough many years ago so, more percentage will be the 50% ... so, I hope at least to have a little money in the end, after paying for everything, when I will only receive the 1/6 of the inheritance and also have to pay all expenses regarding that 1/6. That's why foreigners see so many empty houses, the expenses are so hight and sometimes, if one of the heirs is stubborn and if, the process of dividing assets ends in court, more expenditure will be, and ends up not being an inheritance but, more of a nightmare of expensive procedures. In the end, the only one that always gains is the government. We never have big profits, we are lucky, if we receive something, after paying all the expenditures and taxes over everything we do. About remodeling an old house, an old house pays an amount of property taxes, from time to time the property can be evaluated, when? Well the law can change, but if the house is in a better modern condition, more property tax, so you see many houses falling apart, sometimes problems between heirs or, if people do not live there, who wants to pay a higher tax after spending money with the renovation? I was amazed when (what you call ex pats) calling this a Paradise. I was born here, I know the language and sometimes I only know that something changed when we are already inside the problem. We can never know what can change again and the last 50 years, every year something can change so, the climate is good but, there were times (not only weeks concerns, making accounts) in my last 50 years, many times I wished to live in North Pole. With all the taxes I payed in my life, on everything we pay taxes, I could have several new kitchens... This country is only nice for those who have lots and lots of money, for those who live with small amounts, if it is a 50% tax, whatever the money we have, whatever the money we can receive, we have to pay it. Better to pay 50% over 70.000 than 50% over 2.000 and to forget the stove because "Goliath" do not care with things we really need (maybe for those who know to navigate without "nothing" but, some, having a lot, "Laws" are very complicated, as an old grandmother I would say that Man's Laws can be 100% Legal but immoral. In a materialistic world, where can only live well, human beings without soul, spirit and heart, most people don't even know, anymore, the difference between Relative Moral and the Objective Moral, only about being "Legal" or "Illegal", this is the reason the world is becoming more unfair, chaotic and, worse, the people more divided. The problem is not "Goliath" but those who turn off their own Moral Conscience and, in exchange for any kind of "Legal" payment, do what they are told, following The "written Laws", worse, being very proud to be so efficient in their jobs. Reminds me Nuremberg trials, where some tried to use as defense, that they killed people but they were not guilty because they only obeyed to orders. Some steal other's money, obeying orders. Moral Laws/ Natural Law tells us that stealing is wrong because it inflicts injury and suffering to others. We cannot blame the "Governments", can we put what is only a mental constructions in Prison? A real disincentive to more and more people. I’m afraid it’s illustrative of a Europe-wide drive to clobber your assets. Such a shame as Portugal has some lovely derelict properties just crying out to be returned to their former glories. Perhaps a look at those €1 Italian properties is worth considering. My neighbor sold a house for 375K and built another for 270K with the proceeds. He ended up being caught by AT pretty much as you have, but last year. I think he paid 13K in tax and was most annoyed. He also had receipts disallowed for several massive purchases. My sympathies. For myself, when I sell up I will leave Portugal and AT can come find me in SE Asia + try to claim it. Almost nil chance of them getting anywhere with that and after 8 years they write the debt off. As long as you do not lie on your returns or attempt to conceal the capital gain etc, it is merely a civil debt.
I also heard that they take the tax straight away now ….once you’ve sold your house I’m not sure how they can because you might buy one of higher value ….i thought you could not own a property in SE Asia 🤔 you’d have to go away from the uk and Europe to avoid it I guess . Thought it was 28% on 50% of the increase in value, ie capital gain. Otherwise you can invest that amount intonanother property with in the Eu within 2 years.

We have been told exactly the same about the new law's. But also been told that if we build our 2nd property, we have to live in it for two year's before we can sell,and the cost of the build will then be set against it. We have been told this by an English financial advisor/ accountant.

But is Sharon is a tractor that is Portuguese matriculated, then if you try selling it finances will take the money instantly because they won't let you transfer the reg documents, that's if it's matriculated
we can’t…. we came here before Brexit now you have to prove an income and start the process all over again , even with a lump sum from the sale of the house ….people are getting kicked out of Spain for not having visas who’s lived there for years ….some people live here for years and haven’t gone through the residency but they are clamping down now from November using facial recognition cameras when you come in and out of the airport 🤔

I know exactly where you went wrong and your lawyer is at fault for not explaining the land classifications when you re invested. You can't roll over into any land unless it has a house on it. I'm in a similar situation right now but at a much higher value, but I understand the system in Portugal and already in front with professional experts before the deal gets done. No disrespect but you should have got the correct advice at the beginning and never listen to people that are not qualified
the thing is we trusted the professionals, the estate agent wasn’t going to tell us , the solicitor didn’t say anything and one of our plots has the ruin on it 🤔 going into the dark with no one telling you any different ….mine field,thanks for commenting have a great rest of the week 🇵🇹

I've looked at your situation from different angles and it's your lawyer still at fault because they should have told you instantly by the tax code on each article number before you re invested, but also you should have known to ask about the tax code before you messed up and spent any money
We presumed stupidly that you would be allowed the full purchase cost of the property and all your receipts that have your name, fiscal and address , we was totally wrong because we didn’t know any better . @@livinginthealgarveportugal3357 it's a bit late now but you could have worked it so you had a zero capital gain which is something I'm doing right now as my gain is way bigger than yours and it all it would have cost you is approx another 2200 euros, it's naughty the way I'm doing it but legal and it will work with a zero gain when I sell again too. I can't say on here how but no one else ever seems to think of it
we owe 10k 🇵🇹 you get taxed a percentage of the 80k 🌞 to get it down to zero we would have to invest 80k🤔 because they only allowed 20k of receipts for the renovation in Alte and 30k that we didn’t know you can’t claim rural land so it’s pushed our tax bill up ….😬 clear as mud 😹 thanks for commenting have a great weekend

we can’t…. we came here before Brexit now you have to prove an income and start the process all over again , even with a lump sum from the sale of the house ….people are getting kicked out of Spain for not having visas who’s lived there for years ….some people live here for years and haven’t gone through the residency but they are clamping down now from November using facial recognition cameras when you come in and out of the airport 🤔

I know exactly where you went wrong and your lawyer is at fault for not explaining the land classifications when you re invested. You can't roll over into any land unless it has a house on it. I'm in a similar situation right now but at a much higher value, but I understand the system in Portugal and already in front with professional experts before the deal gets done.
No disrespect but you should have got the correct advice at the beginning and never listen to people that are not qualified

@englishdecorator there is that going on for sure but on a whole restoring dilapidated buildings is also investing in the building trade …lack of housing here and so many houses need restoring 🤔

I've looked at your situation from different angles and it's your lawyer still at fault because they should have told you instantly by the tax code on each article number before you re invested, but also you should have known to ask about the tax code before you messed up and spent any money
We presumed stupidly that you would be allowed the full purchase cost of the property and all your receipts that have your name, fiscal and address , we was totally wrong because we didn’t know any better . That’s why I have this channel to show the pitfalls so others don’t make the same mistakes as we did. Thanks for telling me though have a great rest of the week 🇵🇹🌞
@@livinginthealgarveportugal3357 it's a bit late now but you could have worked it so you had a zero capital gain which is something I'm doing right now as my gain is way bigger than yours and it all it would have cost you is approx another 2200 euros, it's naughty the way I'm doing it but legal and it will work with a zero gain when I sell again too. I can't say on here how but no one else ever seems to think of it

we owe 10k 🇵🇹 you get taxed a percentage of the 80k 🌞 to get it down to zero we would have to invest 80k🤔 because they only allowed 20k of receipts for the renovation in Alte and 30k that we didn’t know you can’t claim rural land so it’s pushed our tax bill up ….😬 clear as mud 😹 thanks for commenting have a great weekend

@@MickeyDC-om3pv of course not but we did not know the pitfalls here of not being able to claim all your receipts, rustic land ,laws on ‘ tourist properties’ if it’s classed with an AL license I was pointing out the Pitfalls of Portugal laws here are different than anywhere else 🇵🇹 and they change all the time
