Summary (mostly for my own studying): McCulloch v Maryland: allows congress to create a national bank (implied powers), federal gov is superior to state gov when they conflict (supremacy clause) US v Lopez: federal gun free schools act is unconstitutional, cannot commerce clause does not grant state unlimited power, gave states more power Baker v Carr: apportionment issues are justifiable in court because they are non political (constitutional, 14th amendment), led to one person one vote Shaw v Reno: race cannot be the only factor used to create a district (violates equal protection) Marbury v Madison: established judicial review (ability of court to declare an act of congress or executive unconstitutional) Engel v Vitale: states cannot hold prayer in public schools (violates establishment clause) Wisconsin v Yoder: Amish children can stop attending school in 8th grade (violates free exercise clause) Schenck v US: free speech can be limited in times of war and when there is clear and present danger Tinker v Des Moines: students are still allowed free speech (1st amendment, symbolic speech) New York Times v US: man leaked pentagon papers, government cannot block publication, difficult for government to justify censorship McDonald v Chicago: states cannot ban handgun (violates 2nd amendment), incorporated through 14th amendment Gideon V Wainwright: incorporated 6th amendment’s right to a lawyer to states Brown v Board of Education: racial segregation is unconstitutional (violates separate but equal clause of 14th amendment) Citizens united v FEC: corporations can contribute money to independent political speech, but not directly to candidates
Just a reminder, there is no separate but equal clause. That was the principle of the court case Plessy v. Ferguson, which enabled racial segregation in the first place. Brown v. Board argued that school segregation violated the equal protection clause of the 14th amendment :)
small mistakes, - US v Lopez: you meant "does not grant *federal gov* unlimited power" - Baker v Carr: "Justiciable", not "Justifiable" - Wisconsin v Yoder : "after" not "in" - Brown v Board of Edu: Equal protection clause of 14th Amendment, not separate but equal clause (which was established by Plessy v Ferguson, not the 14th amendment) (cramming the day before too lol)
Thank you LaManna! I love how streamlined your content is, while still being extremely on-point and informative. Thanks for continuing to release awesome videos!
All political power being inherent in the people no branch of government may exercise a power that is not founded in the inherent power of the people. Since the Judiciary may exercise the power of judicial review, it stands to reason that this power is inherent in the people, and said power is exercised by their consent. The people, so empaneled as a jury, may directly exercise their inherent power of judicial review in any controversy they choose to do so.
