      @Al-Islaah  2 дні тому

Once you understand the concept of Big Fiqh properly and what kind of jurisprudential methodologies are subsumed under it, you will be able to figure out who is involved in it and who is not.
This is just the first lecture of this series. As these discussions get deeper, you will encounter more engagement with scholars involved in producing Big Fiqh. So stay tuned for the rest of the series.

Salam. Where does it say in the Qur'an that only ALLAH has kept exclusive rights to declare things haram and halal in the Religion ?
For e.g. we know that one Ayatullah declared tobacco haram - the tobacco fatwa - that helped oust the British influence from historic Iran ?
So did that Ayatullah commit shirk although lots of benefits for persian islamic empire aroused out of it to oust the outside influence?
E.g. 2: isn't it haram to harm oneself ? Is if a marjaa declares cigarette haram from that principle, what is wrong?
E.g.3 : we have heard suicide is haram. But where is that within the Qur'an by ALLAH ?
    Thankyou.

      Walaykum Salaam
As our respected Sayyid explained in the lectures, BIG Fiqh results in making Ḥalāl of Allah Ḥarām; it turns the lawful into the prohibited, despite this very act of turning the Ḥalāl into Ḥarām being strictly forbidden in itself as per Allah’s clear revelation in the Qur’ān:
O you who believe! do not make unlawful (for yourselves) the good (pure and wholesome) things which Allah has made lawful for you, and do not exceed the limits; surely Allah does not love those who exceed the limits.
And eat of the lawful and good (things) that Allah has provided you with, and be careful of (your duty to) Allah, in Whom you believe. (05: 87-88).
This prohibition is further reiterated in Sūrah al-Naḥl:
And do not say about what your tongues assert of falsehood: ‘This is lawful and this is unlawful' to invent lies against Allah. Indeed, those who invent lies against Allah will not succeed. [They may have] a brief enjoyment, but for them is a painful punishment. (16:116-117).
As for the tobacco ban, if the Ayatullah claimed that tobacco has been forbidden by Allah or that staying away from it is a religious obligation and requirement, then that is indeed a case of Big Fiqh.
But if it is simply a political or administrative ban which is not attributed to Allah, then it's fine as the Sayyid explained in the lectures.
As for eg. 2, we are not allowed to declare everything harmful Haraam. So much of what we eat, drink, drive on a daily basis is extremely harmful, even if in the long run, yet it is not Haraa in the Shariah.
As for eg. 3, the Quran has made the killing of any and every Nafs Haraam except with Haqq. This absolute ban on taking human life applies to every life including our own.

What about washing or wiping feet in wudhu? Both ways are according to Quran which should be adopted?

Both are fine according to our scholarship, and this matter will be explained further in light of Quranic analysis as well as other evidence in our sources when Fiqh al-Salaah series begins inshallah.

Upon a straightforward reading of the verse, especially since both _arjulakum_ and _arjulikum_ are mutawatir readings, the most obvious command is that of wiping the feet. However, some would argue the Sunnah promotes washing which also covers wiping by default, so that is stronger.
