    FL agent: I keep hearing from agents in other states to write the offer and ask for compensation in it. My question is how? According to my broker we can not do that. In FL we are not a party to the contract, so we can not ask for compensation in any part of the offer. We can get a compensation agreement signed outside the transaction but we can't make it part of the offer contract at all.

      I’m not in FL but can’t the agreement to pay your fee be between the buyer and seller? The buyer asks the seller for concessions and uses those concessions to pay the fee to their buyers agent that they previously agreed to. Thinking out loud… can this work?

    Are you requiring the seller to indicate an exact %/$ amount they're offering to the cooperating broker in your Exclusive Right to Sell Agreements? Are you unilaterally having the seller put $0/0% to cooperating broker and then having them update that depending on what comes? I just had these questions after Jack presented his principals.

    I’m confused. I just saw Mr ferry on a podcast supporting listing agents still offering a buyer broker commission, but the first presenter here says not to “read minds” or “overcommit your seller” I.e. don’t offer a buyer broker commission? So what exactly are you suggesting here ?

      I think the whole point is all agents regardless of which side of the transaction, needs to discuss the services benefits and value the realtor can provide...but then the seller or buyer decides what they will pay.

    Recent meetings at our board were heated. Our forms changed July 31st. The boards buyer brokerage is 5 pages filled with legal jargon. Our brokerage has a 2 page agreement that describes what the agent will do for the buyer- 8 Pillars. Then it asks for compensation and a signature. Clean and documents what the agent will do for the buyer. The agreement opens the door for elaboration about the buying journey.
    The agents who sell $700,000 ++ homes are frantic about asking for $20,000++ compensation. While the sellers are realizing more $ on their bottom line. The new purchase agreement allows the buyer to ask for compensation for the agent from the seller. The seller can counter. Only time will tell. What are your thoughts? Will the buyer and seller determine our value when a $400,000 home has the same tasks as a million $ home?

      Actually many times a multi million dollar buyer takes many more tasks than a $400,000 buyer. Ive had both and high end buyers can have various “proof of funds” that need to be checked and qualified thru few sources. I work with many doctors, who are wonderful, but their schedules for inspections, Docusign signatures, explanation of all disclosures, request for repairs etc are not on same timelines as as lower priced home buyer who are also wonderful and accessible. As a buyers agent we acclimate to our buyers, needs, wants, and schedules that require a lot more follow up to get timelines met timely. Tasks can differ greatly from transaction to transaction. The basics of course are the same, but some buyers need more attention than others!! That’s why we get paid to solve all issues and problems.
