Something I noticed on rewatch is that XQC keeps using a phrase wrong (shocking, I know). He keeps accusing Ethan of “taking the high road” a phrase that implies the person on the high road is *actually* behaving in a moral manner. The phrase XQC wants is actually “getting off his high horse” which implies that the person on the high horse is posturing about being more moral without actually being so. Ethan actually does have the high road in this debate, but xQc is clearly going for the accusation of hypocrisy but keeps using the wrong term.

xQc ruined his argument from the start by claiming he doesn’t care about fair use and admitting his content isn’t fair use. If he’s ever taken to court those claims alone lose him the case, but that aside. Anyone who argues against him only has to say that they try to uphold fair use, regardless of the truth to that statement they automatically deal a heavy blow to him. I doubt Ethan’s content is actually transformative to the standards of fair use, but him simply saying that he tries means that even when he fails it’s the failure of someone that is trying to succeed. When xqc says he doesn’t even try, he doesn’t have the defense of saying that he tried, which is a great shield to have in regards to something subjective like fair use.

There was a joke when this all started that Hasan would no way in hell interact with EFAP and actually address the concerns. Idk why people give Ethan props, he grew his own ego, he went after people who he shouldn't have, he got unreasonably invested into political brainrot despite having a very nuanced and fair take on politics in the past. He ditched all of his likeability to maximise profits through a mediocre podcast, he started a fast fashion brand made from sweatshops in China and jacked up the prices enormously. He invited people onto his podcast in tough financial situations just to bully them for spiteful entertainment. Hassan also makes a stupid point (shocker, I know) because there ARE guidelines, atleast in the US: The DMCA and the copyright code. The IP holder can only function within that law. You do not need permission to use someone's content for education, for journalism, for critique, or other transformative purposes. Just because someone isn't suing you over it or has doesn't mean it's legal. And what bugs me is Ethan was involved in a case that established precedence. He even denied playing any of those games because as he claimed he got adicted to them at one point but then promissed his wife to stop. And while we don't have his tax filings, we have his bankruptcy documents (which are public). In his bankruptcy he claimed to have 5000$ in business expenses EACH month. Everyone knows what it cost to run a stream from home, which he does. The monthly cost are electricity, internet, xbox live/playstation/nintendo sub, a few games. That is under 1000$. So people deducted that he claims his gatcha games adiction on taxes and his bankruptcy as business expenses, again *he never played any one mobile game on stream and denied playing them in general* .
At 3:07, in regards to the graph, if read correctly, it can be very useful against XQC. It doesn't look it because people like Sitch are seeing the linear regression and assuming that's the trend. However, using estimates from the graph, the rate of view and impression decay was about 35-40% both before and after. The day XQC uploaded that percent drop spiked an additional 20-25%. And if you dropped the day before the XQC upload by 40% and then again by 40%, the result is around where it actually was the day after XQC. So the trend isn't -150k impressions, it's -40% of daily impressions, as the slope flattens out.

To give a solution to all those millions that watch people like XQC. If UA-cam could have some sort of live channels that just went through a playlist that could be voted on by the chat and have curated streams where they could engage with the chat. I think the social element of the chat while binging content is what they are really after. And of course they follow whoever is leading it. If it was just a live chat playlist in UA-cam that gave the views to those UA-camrs and provided that community I see that as a win win.

The phrase XQC wants is actually “getting off his high horse” which implies that the person on the high horse is posturing about being more moral without actually being so.
Ethan actually does have the high road in this debate, but xQc is clearly going for the accusation of hypocrisy but keeps using the wrong term.

If he’s ever taken to court those claims alone lose him the case, but that aside. Anyone who argues against him only has to say that they try to uphold fair use, regardless of the truth to that statement they automatically deal a heavy blow to him. I doubt Ethan’s content is actually transformative to the standards of fair use, but him simply saying that he tries means that even when he fails it’s the failure of someone that is trying to succeed. When xqc says he doesn’t even try, he doesn’t have the defense of saying that he tried, which is a great shield to have in regards to something subjective like fair use.

He invited people onto his podcast in tough financial situations just to bully them for spiteful entertainment.

xQc's argument of "I will pay them after I steal it" only applies to a creator who has the money to do it. Which means streamer without his means cannot do that due to being less affluent. He is endorsing something that is only beneficial of you are already rich. I'm not even sure of that being completely beneficial.
It is an argument that revolves around defending a small, rich minority. I find that devious.

You do not need permission to use someone's content for education, for journalism, for critique, or other transformative purposes.

There was a time where I very much liked the content of H3H3, and then at one point I fell out with the channel (I'm sure for the same reason as many other people). Seeing Ethan through this current React Wars saga- it was like seeing the old Ethan come back. Even if it will only be for this moment in time, I will choose to cherish it. He's still in there, somewhere.
He just didn't have the right people around him that's about it.

5:21:00 Fake news! Dev is 100% wrong on the DSP story. The entire issue was that DSP never played any mobile games on stream, nor has shown any micro transaction in those games on stream either. He even denied playing any of those games because as he claimed he got adicted to them at one point but then promissed his wife to stop. And while we don't have his tax filings, we have his bankruptcy documents (which are public). In his bankruptcy he claimed to have 5000$ in business expenses EACH month. Everyone knows what it cost to run a stream from home, which he does. The monthly cost are electricity, internet, xbox live/playstation/nintendo sub, a few games. That is under 1000$. So people deducted that he claims his gatcha games adiction on taxes and his bankruptcy as business expenses, again *he never played any one mobile game on stream and denied playing them in general* .

At 3:07, in regards to the graph, if read correctly, it can be very useful against XQC. It doesn't look it because people like Sitch are seeing the linear regression and assuming that's the trend.
However, using estimates from the graph, the rate of view and impression decay was about 35-40% both before and after. The day XQC uploaded that percent drop spiked an additional 20-25%. And if you dropped the day before the XQC upload by 40% and then again by 40%, the result is around where it actually was the day after XQC. So the trend isn't -150k impressions, it's -40% of daily impressions, as the slope flattens out.

To give a solution to all those millions that watch people like XQC. If UA-cam could have some sort of live channels that just went through a playlist that could be voted on by the chat and have curated streams where they could engage with the chat. I think the social element of the chat while binging content is what they are really after. And of course they follow whoever is leading it. If it was just a live chat playlist in UA-cam that gave the views to those UA-camrs and provided that community I see that as a win win.
