    So here I was doing this application and almost gave up on it. But made a search on UA-cam and you are the only one with this tutorial from what I know. I live in California and will sell through Amazon FBA. So far got my EIN as sole proprietor and now applies for seller permit thanks to you. Hope this is all I need. lol

    If you're a foreigner (non-US national) you will not be able to complete the application with just a LLC and an EIN number. As the manager/owner of your LLC, you will also have to enter a SSN or ITIN number. The SSN is off limit, but are able to apply for an ITIN number...

    How would opeaning a buisneess affect your tax return when filing will you pay more or get a refund. As in if your buisness didnt make a lot

      You get 3 years to claim no profit. So I don't think it will affect it at all. Now if you make enough money that can be tracked they will want a cut of the pie.

      No problem 🤠. It is likely that they will approve your permit and it won’t make a big difference. I wouldn’t recommend going through the hassle of updating that specific info unless they ask you directly. The only really pertinent info that should always be updated is the effective nexus date, and any details around nexus triggering activities.

    i do NOT have a nexus in CA, but the drop shipping company DOES have a CA nexus and charges me taxes on those products. Do i charge the customers tax also? I have been, though I don't have a permit yet. Sales made to buyers in my state of CA are under 1k... I've been doing this since March but operating since December 2019 getting dialed in. We filed taxes last year and no issues and lost 6k in hard costs. Any issues I should be aware of other than an audit?

      If you have been collecting sales tax but not remitting it to the state of California, I would suggest you get a permit immediately to remit the tax. Failure to do so is considered tax fraud with potential for severe consequences.

    Thank you for this tutorial. I am about to submit my application. I noticed that on your Summary page it lists Name as "Permitted LLC". My summary page currently has my first and last name. I'm assuming this is because I applied as a Sole Proprietorship/Individual. Should the Name section state my name or the name of my business? I'm going to submit with my first and last name because it does not allow me to change it and I've gone through my application multiple times to verify but just curious if this is correct. (Heard other people mention the importance of protecting your personal information and address).

      Yes if you are applying as a sole proprietor it will be listed under your name. And no problem - good luck with your business.

      When you registered your business your should have received a copy and in there it should have it. It should say "Entity (File) number" thats the same as "California Secretary of State entry number"

    Is the “supplier” info for example Alibaba? Where we purchase the goods correct? Sorry all new to me just want to make sure I understand. I am truly grateful to have found your video.     Please I have two questions: 1) I'm a ceramic artist and I craft my own ceramic pieces to sell. What do I have to indicate as a "Supplier"? I don't have one, I create my own pieces to sell so what do I have to indicate in that section? 2) I plan to sell only online so If in the "Credit Cards" section I indicate NO to the question "Will the business be accepting credit card payments", can I add it in the future if I change my mind?       Hello, these questions are not critical for the sales tax permit application in California. If you are not receiving credit card payments directly, then you should answer No. For your supplier, you can simply list where you purchase your materials. No need to overthink this.

    Great video, two questions. Why do you want to put your start date 6 weeks from the application date? And, would you also put in 6 weeks for the section that ask for “Seller’s Permit Start Date” as well?

      Not everyone who is required to get a sales tax permit is required to register with the Ca SOS. Registering with the CA SOS will put you on their radar for income tax, franchise tax, and other tax purposes.

    I accidentally left the confirmation page after I’ve submitted the application. I registered less than a day ago. I can’t go back to retrieve the confirmation number in order to track the registration status. Is there a way to recover the confirmation number?       If you have an EIN, you should put that on the application. But generally if you are a sole proprietor you would use your SSN.

    I've noticed this process asks for a lot of detailed questions such as what third party internet sale provider you are using, the supplier information. So basically, you need to already have a shop set up before you can apply for a seller's permit? Another question I have is my business is registered in California, but it is an online business - do I meet physical nexus? Or I only need to meet economic nexus?

      If you are physically located in California or have another physical presence in California, then you would have sales tax nexus and need to get a sales tax permit. If you do not have a presence in California then you would need to consider the economic nexus thresholds. Put another way: If you have a physical presence but do not cross the economic nexus thresholds, you still need a permit. And yes, it is tricky to complete the supplier information if you do not yet have a supplier yet.

    Hi. What if I sell online but don’t charge my customers sale tax? I am aware that I will be responsible it. I prefer to have my customers be “happy” paying the price listed. Of course, I charge a little more. Does that effect any selections when I apply for the permit?

      Hi Reginda, states vary in if they "allow" retailers to do this. We generally recommend it is best to not include the sales tax in the price. The best thing here would be to contact the CA DOR for clarification.

      @@regindaphlong6941 Yes of course. The only reason why they wouldn't be taxable is if you are selling to tax-exempt entities (ex. govts), you are selling to a reseller (and you have a resale certificate on file), or the product is not taxable in a particular state (ex. medical devices).

    If I am purchasing material/equipment for the federal government how does that work? The federal govt. is all tax exempt, so where do I have to pay taxes, or do you not have to?

      Hi Wade, states are prohibited from taxing direct sales to the federal government under the principle of federal sovereignty and the supremacy clause of the US constitution. Some states specifically include an exemption for sales to the federal government. Others simply exempt sales that they are prohibited from taxing under the US constitution. No exemption certificates are typically required for federal government sales. However, for sales to the federal government, evidence of the sales must be retained in order to claim the exemption. Some states will exempt sales only substantiated by a government purchase order. Others will permit an exemption for sales paid with a federal government credit card. You must pay SPECIAL ATTENTION to who YOUR customer is. If your customer is a government contractor, the exemption usually does NOT apply. If you make sales to any taxable authorities and you have nexus, you would still need to get a sales tax permit and file sales tax returns. Your government sales would simply be listed as exempt.     Thanks for this video it was super helpful! however I have a couple of questions, if I get the sellers permit but only use to buy supplies but never resell anything yet due to my store not being ready to open, I am I still required to pay a fee for having the permit? Also for the portion where it askes for the supplier information, it asked me for their CDTFA number. I don’t have a supplier yet, so what information do I put in the box? It won’t let me click ahead. Hope those aren’t silly questions. Thanks!

      Hi there - no silly questions when it comes to sales tax. Yes, you will still need to pay the permit fee even if you are not ready to sell yet. But more importantly, you are required to file sales tax returns once your permit is open even if you aren't making any taxable sales. If you don't have a supplier yet and the CDTFA # is mandatory, I would just put something that is obviously wrong like "11111111111" - if the state has issue with it they will contact you and you can explain the situation.

      @@lennieholmes9827 I would be careful of not registering for a permit until you either (1) have taxable sales or (2) need to have a resale certificate for your purchase. Otherwise, you are signing yourself up for ongoing compliance and reporting obligations (which is not my idea of a good time). Hope this helps? :) ...

      I would suggest you be conservative with your estimated sales number as this will resulted in a lower filing frequency (for example, you would only need to submit a sales tax return annually instead of monthly).

      No, a temporary permit is for limited-time event (like a garage sale).

    Thank you so much for making this video. It's perfect for walking us newbies through the process. I have a question about the account information. I just signed up with a wholesale company. They are waiting on my seller's permit to approve the application. So I am trying to fill it out so I can send them a copy of the seller's permit. I haven't started ordering or selling anything from them yet. So I don't know what to fill in when it asks what my projected sales are going to be, and what are the monthly taxable sales. What am I supposed to put in there, if I really don't have a clue what I will be making?

      Hi there, to be honest I wouldn't get a permit until you start making sales as it will just create a compliance burden you'll need to keep up with. You can always estimate your sales, but I would recommend you are conservative so they don't bump you into a high filing frequency.

It was cancelled a couple of years ago. When I called the BOE the girl told me to just go on the website and reapply. But it seems like its getting a bit more tricky now.

      @@neynuevo211 I am not sure I understand your question. You will want a CA permit so that you can purchase inventory from your drop shipper tax-free. After that, you'll need to begin collecting/remitting sales tax on your sales to California.

    Thank you for the informative video. I have a question. If you didn't obtain a seller's permit before but sold online in CA past two years, do you need to apply for voluntary disclosure program? I checked FTB's website and it says "You do not qualify if you have":
    + registered with the Secretary of State
    + ever filed a return in California
    + received a notice to file a return in California
    As far as I understood, you are not qualified if you ever file Form 3522. In that case, what you can do? Should you choose the date you started to sell or the date 6 weeks from now when you entering start date?

      Yes, putting your intended supplier would be fine. But I would reconsider applying for your sales tax permit until you are closer to making taxable sales. Otherwise, you will need to submit sales tax returns even though you don't have any revenue. This is burdensome and unnecessary.

      If you use a date in the past you will simply need to file the past-due returns. If you put an incorrect date, you can contact the CDTFA directly to update.

      It depends on your definition of "hot water". Just be aware that as soon as you register you will begin having a filing responsibility, even if you owe $0 and haven't been making sales yet. That is probably the "worst" that can happy by registering early.

      You will need to make a reasonable estimate of what your estimated sales will be, specifically within the state of California. I know that is vague, but no one can predict that number better than you.

    Great video, i do have a question about if i need sellers permit in CA. I live there and just started my business selling on amazon, etsy, redbubble and society6..which are considered marketplace facilitators. I dont have a website of my own so not collecting sales tax or credit card payments. Since i work exclusively with the above mentioned marketplaces do i still need a sellers permit? What about the sales tax VAT and GST on items that are sold by these marketplaces in EU, Asia and Australia..do i need to remit sales tax there as well?

      You may decide to get a resellers certificate so that you can avoid paying taxes on your suppliers. This would be the most common reason why marketplace-only sellers register for sales tax permits (so they can acquire the appropriate state exemption certificates). Some states want you to register and file even if all of your sales are on marketplaces. But you should consider the risk/reward of filing since you should have a liability of $0 on all marketplace facilitator states.

    You wish to electronically file and pay taxes, fees and surcharges resulting from this registration, if an electronic option exists. Each will have the same filing and paying contacts, banking information and method of payment.

    I keep getting stumped at the supplier question. I don’t currently have a supplier that i buy in mass quantities but i have gotten a few supplies from stores like Michael’s. Could i just use them as my suppliers when applying for a permit?

      FEIN is a Federal Employer Identification Number. You get this through the IRS website. Basically it’s a social security number for your business

      The date you use is ultimately up to you. But if you started making taxable sales in October then you should have listed October as your permit start date.

      Hi there - yes, as long as all of the sales are under the same company EIN, you should not need a separate permit. But please be aware that a separate permit might be needed if you begin selling certain restricted products like tobacco or alcohol. If your vendor changes from the one listed, I would not be overly concerned. This information seems to only be relevant during the permit registration process. Hope this helps!

      There are some states that require an in-state registration in order to attain that state's exemption certificate. In order to have a California resale certificate, you must register for a sales tax permit in California.       You should start by contacting the California CDTFA. Some state smake you cancel and re-create your permit, others can update it within their system.

      If a third party is accepting credit cards (Ex. Shopify) what we've done is just listed them as the processor. In the past, this hasn't been something that CA has rejected a permit application for. I do not know of a way to add it afterwards.

      Hi there, no you do not need to be a resident in the state you are applying for a resellers permit in. I am not sure I understand the second part of the question. An EIN is assigned by the IRS. And a Reseller permits can be assigned to entities that owe taxes.

      A website is not a pre-requisite to applying for a sales tax permit in California. I would encourage you to pay tax on your inventory from your supplier until you have proven out your business model. You can get a permit later to purchase inventory tax-free after you know you have a solid business. If your supplier requires the certificate regardless of if you pay tax on inventory, then this might just be a rule the supplier has and you are stuck getting a permit.

      In California, you need to get a sales tax permit in order to attain a resale certificate that is valid. You can download your resale certificate from within the CDTFA portal after you have regsitered for a sales tax permit.
