    Getting a lot of comments from people who think I am somehow recommending opening a business in Thailand for everyone as an alternative to every other investment option lol. Please don't open a business in Thailand unless you have a competent business plan and have a specific reason to do so in Thailand. Apologize if that sounds like common sense but just making sure as I am getting some ridiculous comments. Like all things in Thailand, there's the technically correct answer and the real way it works. I am not about to say anything specific as obviously it'll open me up to liability issues so please do your research. This video was created in an attempt to just go over Dea's personal experience having run a Thai business as a foreigner for 7 years. Your experience may vary depending on the lawyer or accountant you hire as every other visa legal issue in Thailand so again, do your own research before jumping into anything and please use common sense

    If you take a break and fire the employees, IT DOES NOT cancel the work permit! It just means you have to hire 4 more before your extension time comes around. Once you have the permit you can scrap all the staff and do what you want until the renewal time comes. Then you hire the staff again to renew your visa. It's only a legal requirement to have the staff in order to get the permit and visa first. Legal loophole right there and there is nothing they can do about it.

      @@livetravelasia So I don't know for a fact but i believe you need other american partners in said business and their are sectors that this treaty bars Americans business from participating in. Owning land;
      Engaging in the business of inland communication;Engaging in inland transportation and communication industries; Engaging in fiduciary functions;Engaging in banking involving depository functions;Engaging in domestic trade in indigenous agricultural products;
      Exploiting land or other natural resources. That's from the old US department of commerce page on the treaty. circa 2007.

    As I understand it, the Thai-US Amity treaty does allow a US person to own 100% of the shares of a Thai company. There are some restrictions and limitations on operations in certain industries like telecommunications and it doesn't allow for foreign ownership of land, so there are still limits.

    to open a business in Austria costs about 35,000, which you don't even keep in your account, but invest in the business. and in Thailand you own 49% ... so it's a lot to invest 66,000 for 49%

    It's 4 employees for a work permit if you're not American. American's and a few other countries are thee exception.

    Too much headache. Investment Visa or elite visa is a lot easier. The best value elite visa is 1m baht for 20 years. Or buy 2 condos 5m each. Buy one, rent one out. Both are cheaper than running a shell company with 4 employees.

      @1CBRDUDE but is it bad enough that you will lose 1m baht on 10m over 20 years? There are some calculations that should be done before deciding which route to go, like comparing time value of the 1m baht. Can you rent the same unit for a smaller percentage than you can make by putting that money into other investments? if buying makes sense for you over renting, the additional investment to reach 10m may be more attractive than sinking 1m into the elite visa. everyone will have different results when doing calculations. for the risk averse the elite visa is the one to get. however, if you indeed plan on living there, and want to live decently in a nice place in the city center, the investment visa can make sense.

      Haha all options but if you have need for low cost labor than Running a business is a great option. But I wouldn’t run a shell company. For condos I’d probably stick to buying more than two and air bnb ing them but I’ve also heard from other investors it’s less hassle to buy a really good one and rent to high end but 5m wouldn’t get you a high enough one. It’s not great enough nor is it affordable enough at 5m imho but if you can find a great one great. But if I wasn’t committed to any of these plans as I wouldn’t be comfortable w any of them, why not just travel around if you have all that money. I personally don’t understand people who go through great lengths to just stay in one place. Tourist visa all the way, come to Thailand twice a year and enjoy yourself in other countries

    Put your wife and three other close family members on the payroll ($25,000 a year) then have them support you to the tune of up to $25,000 a year it costs you to live there one way and another. Plenty of room to move I’d say if you are already supporting family.

      Haha there’s definitely creative ways if you start thinking but not sure if it’s completely legal. But definitely seems what is a technically written way and what is actually in practice when I ask people unofficially is different. Too many gray areas I personally don’t feel comfortable working in them but nothing goes as planned in Thailand either

    That's very interesting, as an American citizen I know I can open up shop and own it there, never thought 2 million was the minimum, that 10 million is not impossible, but now, 10 million goes straight to the company i imagine.

    (very basically) for Americans you: 1) instantiate the company the way she was taking about
    2) Apply for amity treaty certificate. This yields 100% foreign owned Thai company. It takes longer than the whole "LegalZoom LLC" for $99 you can do in the US and will cost more than $300 and you should allocate more than 40,000THB/month (i.e. 10k/Thai employee/month) + virt office cost BUT indeed there are substantial tax benefits *especially* if wanting to take advantage of FEIE.

      If you are planning to take FEIE, you can just get the Elite Visa instead of wasting 40,000 THB/month + virtual office. Million baht gives you 20 year visa with unlimited stays.

      Yeah this definitely isn’t worth it to just stay in Thailand. Honestly I don’t think anything is worth staying just in Thailand for. As great as the country is, if you can afford it, just travel around and enjoy all that the world has to offer :)

      No. You need a work permit or work visa to work. Retirement visas require you prove you have money to simply spend

      Haha yeah... I am honestly not too familiar with the investment visa. I can only see investment visa being good that you don't have to hire workers and business visa being good in that you get a work permit which you can use for various forms of identification etc to open bank accounts etc. You also won't get in trouble for working in thailand and "work" is very broadly defined in thailand so that's somewhat a necessity if you're planning to live there

      Yes what Sarah says. Generally speaking I haven’t experienced any local Thai products that are bad for your health and such. In China and Vietnam I’d be a bit more careful as there’s frequent problems but probably due to abundant natural resources available in Thailand most products are nature based as i imagine it would be cheaper to do that than make chemicals here

      It’s a good mindset to always be a bit skeptical. A rule of thumb, not everyone but there will always be a few that will take advantage and do unethical things to make a few more bucks in this world. That being said, Thailand has proven to be one of those places I see less of this from

      I don't feel comfortable advising on visas as not only does the policy constantly update, but it's applied differently based on the office, the mood of the officer you meet etc. I'd recommend you contact a professional as mentioned in the video as that's the the most reliable method. I'd also only consider the investment or business visa if you have a need, as I personally think the cost and trouble is not worth it when you have other easier more reliable methods of securing a visa

    How about putting the business in your Spouse's (Thai Citizen) name, and she/he pays you (The Visa Holder / Foreigner) .. Then there's no 4 Thai citizen requirement to pay them full time?

      There are lots of loopholes I guess but it’s a constant cat and mouse game. Thailand has already thought of this because they require even Thai businesses to employ so many Thai workers to hire a foreign worker and lots of requirements to have a foreign worker I don’t even wanna look into

      Yeah I always discounted it myself from all the people who have told me about the horrible experiences but she’s been doing it for 7 years without any issues. It’s also 66k invested on paper value not being in the bank so that was another revelation

      I thought there was even a 200 something one but not as good? Haven’t followed up on it. 500k is pretty damn expensive... I’d just use that money to travel around for the 6 months a year or so that I can’t be in Thailand hehe

      Right now the business situation in Thailand seems way too complicated for a foreigner but ultimately it all comes down to supply and demand. If you can open an Indian restaurant that serves food or services that doesn’t exist in Thailand, who’s to say it won’t succeed :)

If this is something you’d want to pursue further I recommend you start w her contact and do a bit more independent research.       Possibly a good setup but the level of English is probably better in the Philippines and India. I’d also look into options there

      Honestly they even use Philippinos for call centers here... I would go w Philippines for call centers. They are all practically fluent. For a similar level of fluency in English in Thailand you’ll have to pay more... but if it’s only a few callers maybe it won’t be much of a difference. The quality of life is definitely better in Thailand and the internet is better... but definitely checkout Philippines if you haven’t already

      when it comes to business you'll find lots of conflicting information. There's what is the law and how it's really carried out. This was just an interview of someone who is doing it. I'd consult a lawyer for solid information. Last thing I'll do is claim there is any solid information you can rely on in Thailand cause you'll find it will be applied differently depending on which office you go to or how good or bad of a day your officer has had

    Once i register a company, do i automatically get a business visa or are there other requirements attach to it?

      Nothing is automatic in Thailand. It would be safe to assume you’ll always have to do more paperwork, and renew at least on a yearly basis. Regulations are always subject to change and application of such rules varied. This would be the biggest downside of trying to do anything in Thailand so if I was to do it, I’d just use someone I trust who got the connections like Dea. I personally don’t know him but based on how he charges what seems like a more than fare charge and a good testimonial more than the hundreds of others I haven’t heard and testimonials and charge much more, I’d probably start there and see if it will work with whatever you want to do with your business

    That was very interesting for me because I am looking at setting up my first company in Thailand very soon.
    I have been looking at the shareholder structure and a farang cannot own more than 49% of the share capital and I understand that a company has to have 7 shareholders. i.e. I can have 49% and the other 6 hold the 51%. There are ways, to a certain extent, of protecting your capital by having a fixed and floating charge on the company maybe using a UK company (cheapest in the world to set up). Obviously enforcing anything is always going to be a problem because the Thai courts always favour the local Thais.

      Yeah... this was a big turn off but after talking to dea it seems there are definitely ways. Also Americans seem to have some kind of an exception to this rule so you can look into that as well if you are. I think that’s probably a good idea to split up the shares amongst 6 other unrelated Thais you trust so not one of them can fully control your assets. That being said I am not sure about the rules but maintaining control of the 2 million of assets under your control should be easy ie keep the bank account in your name etc as the only person approved to access it etc. having shareholders own the company means not much when u control all the assets

      Yeah you’re gonna have to put some Thai shareholders for sure than... unless you get an American shareholder but either way I wouldn’t feel too comfortable investing too much myself. Just take advantage of the low labor costs and possibly the tax benefit but definitely do a lot more research before jumping into anything and committing lots of money. I myself would never advise to invest any amount you’d regret losing as nothing is certain for foreigners in Thailand except that you’ll most likely remain a foreigner and only be welcomed as long as you have money

      Did I? Americans aren't subject to it but for most yes. Actually I've stated this so many times in my other videos that starting a business in THailand is such a bad idea but due to popular request this was a video where I tried to show the positives for those that keep insisting haha

    It's rather insensitive to repeatedly say of the prices "wow, it's only X", and reveals you haven't been in the region long.
    That's a lot of money to most people in the world. It's not only that "it's so cheap", it's more that your home country is more expensive. The latter is true for a far greater percentage of people in the world. People born in some countries won the birth lottery.
