William A. Schabas is a Professor of International Law at Middlesex University, London. He is also a Professor Emeritus at Leiden University and the University of Galway, and an invited visiting scholar at the Paris School of International Affairs, Sciences Po.
Recognized as a leading expert on international human rights law, international criminal law, genocide and capital punishment, he is the author of more than 20 books and 400 journal articles on these issues. He is also Editor Emeritus of Criminal Law Forum, the quarterly journal of the International Society for the Reform of Criminal Law.
Professor Schabas was a member of the Sierra Leone Truth and Reconciliation Commission. He also worked as a consultant on capital punishment for the UN Office of Drugs and Crime and drafted the 2010, 2015 and 202 reports of the UN Secretary-General on the status of the death penalty.

This is the easiest case for genocide ever to be brought before a court ,most israeli officials have said it many ,many time on camera .
It is a strong case and the easiest case to take before a court. Lawyers sometimes fudge the issue but a skilled, honest advocate can make the case. And win.
The purpose of the genocide convention is PREVENTION - allowing UN members to take action when there is a clear possibility that any aggressive action by a State may lead to genocide. Whether a case can be proven or not is irrelevant, the crucial point here is to prevent it in the first place or to stop it if it has already begun. That is what the members of the UN have responsibility for.

I get pissed when people talk about this like it's some complicated thing. It's looking at Israel's actions, and looking at the definition, and whenever an action corresponds to a criteria of the definition, you check that criteria. If a sufficient number of elements of the definition of genocide are met, then you call it genocide, because it is genocide by definition!!

The complicated part of proving genocide in court--I hear--is proving intent. Luckily for us, Israel has done that for us with all of its genocidal rhetoric.

I sincerely believe that account is not an everyday citizen and practicing Muslim. Although, they seem to really want us to think otherwise. The accounts comment history that is visible when you click their pic is just the same phrase repeated in replies to random comments, nothing else. This "person" only recites religious musings while providing no context? What does that communicate to other commentors? This person has a brain that is singularly focused on their religion with no other thoughts or opinions... even on the topic of genocide. My hunch is that this youtube channel's practice of consistent, good faith conversations and engagement with reality (as opposed to mainstream medias prevailing practice of gaslighting citizens with half truths or flat out false narratives) has likely aroused suspicion from those who would prefer the world continue believing that the core issue stems from Muslims irrational hatred of Jewish people. I know thats a lot to assume from very little to go on, but my gut feeling is hardly ever wrong. Even when my hunches are proven accurate, I still cant articulate what led me to my conclusions. I think its some kind of subconscious pattern recognition perhaps? I dunno, I could be wrong, just throwing it out there anyway.

International law is not about law but about national interests. Since there are many more Arab and Muslim countries than the one Jewish state, Muslim and Arab interests dominate in international legal fora

And he has dragged his feet when it comes to anything related to Israel. But you can look at the US’s lone veto against a ceasefire to give you an indication of how the UN actually works.

For those brought up in the democratic West,
there are some questions that cannot be answered.
Imagine during WWII, if 'allied' citizens on the street were asked,
if firebombing Dresden was really necessary.
Or if the US had to drop not one, but two nuclear bombs,

Also, the firebombing of Dresden did not make the Nazis surrender. The Soviet Union crushed them in the East more than anything. Anyone who thinks that, even if Hamas is crushed, a resistance movement won't emerge to fight Israel's occupation and domination, is fooling themselves.

I stopped watching when he said the fact that Israel has low casualties is evidence that Israel doesn’t want to fight Hamas and therefore = genocide. What an idiotic argument, and he just hand waves away the respective tactical realities on the ground in an asymmetric conflict between a conventional, highly technical military and a terrorist militia embedded within the civilian populace. This is an absurd stretch of non-logic, and the fact he identifies this as a core premise is an admission of the weakness of the argument.
High casualties in a military conflict does not mean genocide. If genocide is just “a lot of people are dying and I’m mad/sad about it” then the word has lost all meaning as a distinct concept.

The ICJ ruling in the case of Bosnia and Herzegovina vs Serbia was a joke. A lot of evidence that was used in the Milosevic trial wasn't used in the case of B&H vs Ser. Serbia was very much involved and complicit. In May of 1992, Serbia's military formally left Bosnia and Herzegovina, but weaponry and men were left there, they just changed the emblem on their uniforms. Besides, Serbia organized paramilitary forces, sent their own special police forces, sent weapons and money, helped mobilisation to the formally Bosnian Serb army, which was really Serbia's army. Serbia was paying wages and later also pensions to soldiers and officers. It was a very clear cut case, which was partly botched by the Bosnian side, and the ruling was partly political, because it would have been too costly for Serbia due to reparations that Bosnia and Herzegovina would have the right for, which could push Serbia closer into the arms of Russia, instead of European integrations.
Also, I believe that the term "ethnic cleansing" was coined in relation to the war in Bosnia and Herzegovina, mainly because the international community didn't want to use the word genocide, because then they would be obliged to act, or at least lift the embargo on weapons import and allow the Bosnian government and army to arm themselves and be able defend their country and people. If that happened, I wouldn't be in diaspora now, and several members of my family and friends would very likely still be alive.

Very interesting and sober discussion. The suggestion of not getting bogged down into a discussion about whether or not this fits all the legal criteria of a genocide and focusing on the fact that Israel is clearly committing legally liable war crimes is an interesting one. As is the suggestion that the US is clearly failing in its obligation to prevent genocide.
There is a case pending against Trudeau too. Canada has a navy...we could send food and aid. We could take a lead diplomatically, but he has done nothing while allowing Canadian weapons to be sold to them. Certainly Canadians have told him enough times.
At the highest judicial levels the deicision as to whether something is genocide or not is likely to be a political decision cloaked in legal rationale.

The resolutions aren't binding and there isn't an international force capable or willing to enforce the UNs judgments. They can be full of Johnny Cochranes and Chuck McGills, it doesn't matter if their rulings cannot be enforced...

Why is he so reticent to conclude it's genocide? If you use the UN convention on the prevention and punishment of the crime of genocide. Intent is clearly established, and Israel's actions meet 2 of the 4 acts, that constitute genocide. Actions calculated to bring destruction in whole or in PART, and killing or inflicting psychological harm--among other things--in whole or in PART. If you can't see that the sufficient conditions for the UN convention on the prevention and punishment of the crime of Genocide have been met, then it really calls into question his expertise and credentials as a lawyer. It's seriously so clear by law. What the hell is going on here? It's not even a nuanced example of meeting the definition of genocide. Just so clear.

What was the gist of this expert's opinion that he submitted? That doesn't seem to get covered. Much of the time he is being so pessimistic and skeptical that it's frustrating to watch. The interviewer should have done more to mitigate the grumpy-old-white-guy-who-has-no-horse-in-the-race personality and bring the focus away from this repitious vague hedging. There's so much skepticism here it seems he could just as easily write an opinion that supports the dismissal of any charges. Not that he should be banging on his desk insisting Biden and Bibi be dragged out of office and into a gulag; the interviewer should have done more to get to something more concrete and less deconstructive. You guys can afford the skepticism and pessism, especially about the dessimation of a non-european culture that people were barely giving attention. But many of us do not have that luxury and privilege so please in future indulge us better and don't be so nervous about making clear statements of your opinions and position.

Among the horrific images coming out of Gaza, are images of children and babies who have required amputation of damaged limbs, something that, if you can even survive without adequate aftercare (sanitary conditions and antibiotics to prevent deadly infections) will leave.these.children (estimated at over a thousand so far) permanently disabled. My question is who, or what entity, will be responsible now for their care as disabled children,? Many are also orphaned by the indescriminant bombings. Since the supply of bombs comes from the US, making the US a facilitator of this brutality, isn't it the US who is obligated to support and care for these victims? SWIFT as you know is headquartered in Brussels, and falls under the jurisdiction of Belgium -- with the Belgian government having already called for sanctions against Israel.
