    Well judge Merchan has shown himself to be of the highest caliber of judge in terms of his integrity, intelligence and his oversight of this case thus far. I have every confidence that he will conduct matters as appropriately as they can be conducted.

That Merchan isn't responsible for how his *ADULT* daughter makes a living. And their opinion is the is know one that matters. And since they cleared Merchan before the trial started, its not grounds for an appeal

    I think it was Glenn Kirschner that went over this, the jury instructions are recorded into the record. If the jury has questions about the jury instructions, the court clerk can read them back if they ask for them during deliberations.

      This retired judge from California seems to have been brought on for this segment to scaremonger and create drama for the viewers prior to closing statements. Her opinion seems to be that jurors are idiots who can't remember the instructions unless they are given a piece of paper with everything written down for them. She even dismissed the two attorneys on the jury as not being able to keep the instructions in their minds because they only handle civil cases?!? Glenn Kirschner, Andrew Weissmann and Neal Katyal are much less prone to catastrophizing the legal process. Did she really advocate for NY state legislators to change the law so that the jurors could be given hard copies of their instructions to take into the deliberation room? As you rightly point out, any juror can ask for the record to be read back if they forget the instructions. I think this interview was needless pot stirring.

    If true -- and no critical information is missing from this piece -- then it is absolutely insane that the jurors do not have a written copy of the instructions. My faith in the judicial system would be diminished.

      Juries normally don't get instructions until after closing arguments. As even the closers can reveal or shed light on information that could change what the judge expects them to include in the focus.

      yeah for the love of God give they jury written instructions so they can rule according to the evidence. why don't juries regularly get copies of jury instructions especially if appeals are successful because of something with jury instructions?

      The instructions to the jury will be recorded into the record. If at any time in their deliberation anyone on the jury has questions about their instructions, the clerk can and will read them back if they ask for them. If that does not resolve the issue, a written note can be passed to the judge who will then call them back into the courtroom to restate the instructions. That's generally how it works...this was a waste of a video making a mountain out of a molehill that does not exist.

Even this Judge can't tell you what crime Trump committed, saying the prosecution don't have to prove a crime occurred they just have to infer that Trump could have caused a crime to occur so pick one, any one even if it's not actually a crime like entering into an NDA. How about Cohen stealing 30k. Can you imagine a Juror saying Trump is guilty because he caused Cohen to commit a crime. Just like the fraud case that had no fraud victims, this is a criminal case that has no crime.

      They do have access to the instructions via the court clerk, who can read them at any point. They just don't have them written down. This is the procedure in every NY state case of this kind.

    Listening to these retired judges talk about a process in such elementary terms makes me feel like we're living in a totally different time, where rules and basics no longer apply. and respect for the rule of law is waning. She would be threatened and have to move from her house!

    "Cause" isn't that hard.
    If someone (let's call them DJT) approved payment of an invoice he *knew* to be fraudulent, and that payment was entered into the organisation's bookkeeping system, DJT *caused* that person, the bookkeeper, to enter fraudulent information, even if unknowingly.
    If a trainer rigged a person's boxing gloves without the boxer knowing, and that boxer then goes on to gain a benefit from that rigging, the trainer *caused* his boxer to cheat, even if unknowingly.

      Yes, and perhaps more important is that "Caused" is much broader than, say "directed", or even "instructed". He didn't have to order someone to commit the offence if it can be shown that he gave his staff to understand that he wanted this mess to go away. The details of how they then did that would be the acts that were "caused" by Trump's wishes.

      In this case, cause needs to be inferred other than Cohen's testimony. Simple facts are that Trump stated they were reimbursed. This means that he knew about the reimbursement scheme. If there were a legal method of reimbursement, Trump owns the records of the reimbursement, and as such, simply showing them would tank the prosecution. He has not. Therefore, those records do not exist. The retainer is the fraudulent reimbursement method per the plan.
      Secondly, suppose that Trump didn't cause it to happen. This means sometime in the future, Trump found out that a reimbursement was claimed to be income, and therefore, his company paid $180,000 that it didn't need to the federal government. He was upset by $600 expenses and this loss was 300 times that problem. That is a major cash crunch for a real estate business. That will definitely be employee action. Trump owns the records, and therefore, he should easily be able to produce those records. He did not. He could also amend the reimbursement scheme. He did not, or else the first proof would be satisfied. Therefore, it can also be inferred that he caused them as well. Trump also, would not need to testify in order to get those records in, so there is really no good explanation as to anything other than he did cause them to happen.
      Cohen's testimony was always gravy because Donald Trump admitted that he knew of all the falsified records. Not guilty parties would make obvious actions here, but Trump made none of them.

    This is something I've always wondered, you have judges and lawyers who have gone to years of schooling and have most likely been on the job training for years. Then comes the waitress, the warehouse worker, the construction worker and the chef, all which get paid far less then the judge and lawyers and yet they are expected to remember and weed through the dos and don'ts of the law.

    if the idea is to build an income stream to use as complement for retirement, or at any given point if needed, then building a dividend growth portfolio always buying adding to it could be a good and peaceful path. On the long run consistency and perseverance could guaranty the desired income stream goal with little worries

    Standard memory has the the capacity of 5+ or -2. So the jury will not remember at least 5 of the 12 instructions, up to possibly 9. Have a copy in the jury room for goodness sake!

      Yes, they should have. Short version: they can have the written instructions unless the defendant objects … and there are some limitations to defendants objecting. Plus, the jury can have the instructions read to them by the stenographer from the official court record any time and as often as they want to hear them. So they’ll have ample access to the instructions. Plus, two of the jurors are lawyers so they’ll likely be able to help the others understand the finer points.

      Not difficult to a critically thinking, educated citizen - but I was a Juror yrs ago, and the Judge reiterated before Deliberations that a Defendant is innocent until proven guilty. Well one Juror didn't believe that at all, "where there's smoke, there may be fire", and refused to listen to common sense. Unbelievable - resulted in a hung jury.

    I’m not a lawyer or judge. However, at this point, New York Court of Appeals case law says that written instructions can’t be submitted to a DELIBERATING jury OVER the objections of the defendant and even then, there is an implied consent if there is no timely submitted objection.
    I don’t know why she said that New York law prevents juries from being given written instructions.
    Further, even if they didn’t get a stapled copy of the specific instructions, they receive an entire copy of the court transcript- including the verbal instructions from the judge.

      And they can have the stenographer read the instructions back to them from the official court record/transcript. This isn’t like they only get the instructions once then have to remember it all. They can hear the instructions whenever they want and probably read them themselves unless there are objections. The instructions are available to them.

    If the jury doesn't get the instructions in print, that puts a heavy burden on BOTH closing arguments to explain them. I almost always argued the Circumstantial Evidence Rule and the definition of Reasonable Doubt: "NOT any possible doubt...." but this case has 3 or 4 stages of findings the jury has to make.

      Glenn Kirschner went over how the jury instructions are read into the record and the jury can have them read back if they ask for them during the deliberations. A very misleading segment IMO.

    How in the world does the jury not receive the instructions . In approximately 25 percent of my jury trials the jury requested assistance on an instruction it was reviewing during its deliberations !! Unbelievable !!! Been there !

    I wouldn't try to put together an Ikea bookcase without the written instructions in hand. How can we expect 12 laypersons to reconstruct a 20 day trial and apply all the information accurately to the law that they are not schooled in if they don't have the "cheat sheet" available to work from? This increases my anxiety of the possibility for a hung jury.

    Jury instructions are critical !!
    Those instructions MUST go into the deliberation room with the jurors for the deliberation process. If they are not available for reference during deliberation
    and just one mistake is made trying to remember this Dungeons & Dragons map, a mistrial is likely and as the election approaches, there is no time for that.

    Judge Cordell is absolutely brilliant but here she errs in thinking copies of jury instructions should be made available to the jurors. NYS Criminal Courts have historically refused to issue those copies out of concern for media leaks and tampering. How can the jurors remember everything and what to follow? Well, NYS judges spend a lot of time with the jurors and patiently explain what is and what isn't in layman's terms until everyone is clear. A NYS Court Judge (commonly referred to as Justice) is one of the best legal minds, yet the most envious.

    Right. The judge won't allow an explanation that 'hush money" isn't illegal - it isn't a crime. Judge wouldn't allow an election official testify about what constitutes election law violations. Seems to me that would be some critical information that the judge forbade from being included.

      You can delay while appealing civil trial judgements. Criminal verdicts require inprocessing immediately even if the inmate in question is released back to the public to file appeals. See the recent examples of Steve Bannon and John Eastman.

    Oh my goodness this is not good news - I was Foreperson of a jury not long ago and the consensus of the jury was "beyond reasonable doubt" meant no doubt whatsoever - which is completely wrong. The other thing is the indicted man was charged with recklessly causing grievous bodily harm (he hit someone causing them to fall backwards, hit his head and become a paraplegic). So the consensus of the jury was that in order to have acted recklessly the indicted man needed to be aware of the outcome of his actions which is ridiculous and completely the opposite of what recklessly means. So he got off.
    My point is how can we expect ordinary lay people to make a proper judgement when they can't even understand simple English?
    And that was a really simple court case - Trump's is much more complicated and I fear the instructions from the Judge will totally confuse them which will ultimately set him free..
