    Good info Billy! Personally I treat these guidelines more as suggestions than requirements. As long as you fly fairly safely and don't harass anyone with your drone then you'll be fine.

    If you flying a drone for recreational purpose only or just filming yourself and do not advertise/monetising it then you don't have to have the part 107 license. But if you do monetising it or you filming yourself with pepsi shirt then you have to take the part 107. Becouse i heard some "rumors" about FAA want to make some money out of it.

    How and where is the reg # to be placed on drone?do you also have to have a phone # on it somewhere?

      bruce don phone is optional in case you lose it somewhere. The FAA number must be either visible or easily accessible. So in the battery tray is okay so long as you dont need a screwdriver. You can use sticker or paint or whatever so long as its legible and can survive regular wear and tear

    Billy, Is your interpretation of the FAA rules 100% correct? I mean, regarding the visual line of sight statement, you say that you have to be able to see the drone at all times. If so, then why is the verbage "line of sight" used at all? To me, "line of sight" means that you can see where the drone should be because there are no obstacles between you and the drone (such as a mountain, trees, or a building). In other words, the line would be from your eyeballs to the drone. So what if the drone is a half mile away or a mile away and still in my visual line of sight but not actually see it because it is too far away? Do you understand my point? When "line of sight" is used and not "in visual sight at all times", then I think this rule is open to interpretation.

      Michael Wallitis it really is, but I'd err on side of caution and slow my roll when I get out that far. Other work around for maintaining line of sight is by having 1 or more Visual Observers on your crew, so long as at least one Observer has line of sight and you have reliable comms, the pilot has 'line of sight', so you can daisy chain VOs if youcre operating over a large distance.

      @Michael Wallitis, I've been wondering a bit about this, as I've got time as a pilot years ago and recently became interested in drones. If I remember correctly, 'line-of-sight' had mostly to do with radio waves and their propagation. Low kHz (NDB, AM, etc.) are low frequency/long amplitude, can propagate between ground and ionosphere, and are able to "bend" around obstacles. Medium wave, like VOR and VHF, fall within the mHz range, have a stronger line of sight but are still able to bend somewhat around obstacles and the curvature of the earth. Higher frequencies used in the now-disappearing VOR/DME navigation radios, is very line-of-sight oriented. Those compass roses you see on some airfields in the sectional maps are where a VOR station is located; the beacon rotated 360°, you used one frequency to obtain that signal, and another to receive the DME (Distance Measuring Equipment) signal. Heading and distance to airfield were achieved this way. It's signal could be interrupted by terrain or other obstacles.
      The term was very common when I was going through ground school and initial training, always referred to radio and an imaginary line drawn from your aircraft to the signal source. When on cross country flights, you always needed to check the trig on mountain ranges to be certain of your needed altitude to obtain the signals clearly. Obviously, you could be many miles away from the source, not able to physically see it. What the FAA has in mind, drone-wise, I don't know, I guess add it to the list of presently vague terminology. If it's anything like FCMSR and DOT rules, we're in for a bumpy ride.

      Walter Miles only for Hobby for free and if the landmark isnt in a no fly zone. Compensation for work is what you need the 107 for.

      Colby If you’re flying for fun (recreationally) you don’t have to stay under 400 feet. If you’re flying under Part 107 you would have to stay under 400 feet even if you’re going over a mountain. It’s 400 feet “above ground level” not above sea level. So if the ground rises (like a mountain) then you can fly higher as long as you are within 400 feet from ground.

    Hi Billy, I'm from Brazil and in April I will be in Orlando with my family, so in order to avoid any complication with the US authorities I've tried to register my mavic air on the FAA. However I'm not able to pay $5 because the zip code of my credit card billing failed validation. Do you know if only US citizen can register drones on the FAA or if I have an US credit card would work?

    You cannot take off from Parks & schools & things of that nature but you can fly through and above them . They do not own the air.

      As of now I don't believe there is any restrictions to fly on the premise of a public school. It's up to the advisors to decide this.

      This is a very gray area. When I look at my state's state park laws they specifically say that you can not take off or land in the state park areas. I believe someone could actually take off outside the boundaries and fly over the state park. As long as they are not flying over people or dwellings, I think they may be okay. If you lose the drone and it lands in the park you are in trouble. At any rate, be prepared to get a lawyer if they come calling for you.

      No night flights, we're allowed to fly in civil twilight with lights on. Cant fly over people and gotta keep safely away horizontally. We can fly near houses and buidlings, but people are allowed to complain at us, gotta be careful to not look like we're invading privacy even when we're just flying. We have to keep very far from buildings with wires. If we wreck anything its our ass

      Roy Cornelis so long as other people are under roof or some kind of cover its okay, you are still liable for any damages you cause if somehow a car or power line gets hit. Good altitude is key, you're allowed an extra 400 ft clearance over buildings and you shouldn't/cant be near wires anyway without waivers or somesuch. Dont quote me though in case i missed something.

    Billy.. a couple questions: AirMap app shows no fly zones around airports, stating you have to notify the controlling agency when flying as a hobbyist, but removes that requirement when flying as a 107 pilot. The B4UFly app does not make such distinctions.. also, I was at an event recently where a pilot was filming for the event. I talked to him briefly and he stated that he had his 107 certification as well as 333 exemptions. He was flying directly over a very large dense crowd of people (think outdoor concert). How was he able to legally do this?!

      AV8R Tom if you fly 107 you have basically filed a flight plan when getting approved. Depending on requirements you may or may not have to call the tower. 333 was given out several years ago and is great to have but from what I understand is it is not available anymore and I think they will eventually expire. If you are an airplane pilot it’s a simple online test for your part 107 license.

    My question is, who is the advocate for the hobbyist? I'm new to flying, but I'm seriously thinking about giving it up because of all the restrictions. I believe that blanket restrictions are totally unfair. For example, here in Alabama I can't fly in State Parks. Ever. Wouldn't it be better to restrict specific activities that could harm, or annoy? Or even have designated flying days (or areas) so that people could avoid the parks on those days if they choose to. It's very discouraging. So much so that I may give it up. I don't want to, but what's the use with so many restrictions?

    Say, I have question are there law's that protect us, (The Pilot) such as the angry guy in the park, people who shoot down are drones and throw things at it, false allegations like lady down the street that say we could spy on her while she's pool side, things like that?

      Tank 62 a case has gone to court and they ruled 68’ is ok above private property. If your drone is registered through the FAA then it should be a federal offense if someone causes damage to it. If you are flying over someone you will both be getting in trouble ( can’t fly over people ) but if the run up to it to cause damage that is different.

      Because I think it is more of a behavior thing then a height thing. What I mean, is that there is a incredibly huge amount of air space up in the sky, it would take intent, luck and more luck to try and run into an airplane, especially in rural and non-airport areas. I know for a fact that some local airplanes fly below their 500ft at times... I dunno, I don't think there should be a limit in altitude as long as you are flying responsibly. I know the government has to have 'concrete' rules, but if one flies above 400ft at all and there is a nearby accident, I could see that just because you were above 400ft, you could be liable when drones keep logs and such. I dunno. I am ranting now...

      Trubyd44 If you build your own drones or fly racing drones there are no logs or anything of that sort. Its really mostly just DJI and a few other photography drone companies that does that stuff. of course youd still be liable, itd just be unlikely youd ever get caught as long as you were responsible about it. personally i think 400ft is fine, Especially since its 400ft above structures, hills etc. That means you could fly 400ft over the top of a building (depending on the building) or even 400ft over the top of a hill or mountain. There are ways to stay under 400ft and still have fun with it. Especially if you are flying acro mode!!!

      N'th DEGREE AERIAL PERSPECTIVES One of the challenges our society faces is: what is the interpretation of the word “responsibly”? Different people might interpret the meaning of that word as it applies to them and what they want to do, differently.
      Broad statements can leave much room for varying interpretations.
      Are you against the need to get a 107 license in order to use your drones for commercial purposes?
      Are you against any of the rules for hobbyist drone flying?
      America has ALWAYS struggled with seeking the line of demarcation re: what is retained as an individual’s right vs. a right to be restricted for the betterment (or perceived betterment) of society.
      George Washington described this struggle in a letter dated September 17, 1787:
      “It is obviously impracticable in the federal government of these states, to secure all rights of independent sovereignty to each, and yet provide for the interest and safety of all: Individuals entering into society, must give up a share of liberty to preserve the rest. The magnitude of the sacrifice must depend as well on situation and circumstance, as on the object to be obtained. It is at all times difficult to draw with precision the line between those rights which must be surrendered, and those which may be reserved;”

    If you really want to know the FAA rules you should look them up yourself and not believe the first UA-cam video you watch. I have my Part 107 license. This information is mixing commercial rules with recreational rules. Do your research!!

    Good information but not complete. I know it was meant to be quick and basic. I have my Part 107 certification and fly by the rules. I have also received certificate of waiver to fly in controlled airspace. The problem is, 90% or more of the people who have drones do not follow any or even know about the FAA rules and regulations. My neighbor purchased a DJI Mavic and I saw him flying it one night. Not only was he in a Class E restricted airspace, he was also flying it within 1,000 ft of a hospital with a helipad and current traffic and two hours after sunset. Plus he was drinking his third beer while he was flying. For a month before, I told him all of the FAA rules and regulations, so he was very aware of them. He chose to ignore them because he thought they were ridiculous. This is exactly why the FAA has made blanket rule and will enforce them. The FAA has also encouraged local law enforcement to cite persons who disobey the rules. Law enforcement can only cite you, not take your drone or arrest you. However, if they cite you, the FAA will follow up with a review. If you are found to be in violation, there is a fairly steep fine. Drone safe!

      Billy, please don't take offense to my "not complete" comment. I love your channel! I have watched almost all of your post. You are very informative and helpful! I have just met a few amateur/hobby pilots that either disregard or blatantly ignore the rules and safe flying practices. They don't seem to have any common sense. Also, I may be wrong but I don't believe the 400 ft about a structure applies to amateur/hobby pilots. I have also talked to a few pilots that say, if you don't have your 107 or a 333, the chance of calling the tower and being approved to fly in controlled airspace are slim to non.     Different serial #s require separate registrations at $5 each... one number is not for all drones you own!!!

      andrew scala Are you sure about that? ive heard the number is basically just to identify the pilot, not the drone itself. Its supposedly just 1 number for all of your drones. I've heard that dozens of times. You are the only person I've heard say otherwise.

    Soon any uas will be required to pay for a on board transponder.been in this hobby for 41 years and everything was fine and fun until these redicuous and irresponsible people starting flying these stupid drones.now it has ruined the hobby for all ama members.....I guess I will be having a massive, massive rc estate sale soon!!!!!!!!!... yeh this sucks!!!!!!!!

    You need to get facts straight if you want to put out a video “of rules and regulations you MUST follow”. The 400 foot rule applies only to 107 cert fliers. Same goes for flying over groups of people. Although it makes good sense in most cases to fly that way, the public law you cite in Sec. 336 as well as the FAA interpretation of the law are misrepresented in this VLOG. Fly safe at all times people, but if you want to know the actual rules, don’t listen to Kyle.

      Billy Kyle I said that flying safe is paramount. But making up rules to suit your personal sense of safety is misrepresenting the facts. If you don’t know the difference, say nothing. I’ve been flying for over thirty years, so if you don’t know the facts, you confuse others and lose any credibility with those who actually know.

      This video was geared towards both Part 107 holders and those who fly under Section 336. Like the title states, it was explained “as fast as possible” for those who are new to flying. I didn’t go into as much depth as usual so I could maintain the short video length.

      You lose credibility when after stating something that is clearly inaccurate you don't just admit it and say sorry. I always liked your videos because you seemed so knowledgeable about the drones unlike many of the other drone video personalities.

      Hobbyists are subject to the rules too. You can fly over 400ft as much as a 107 pilot can, the liscense proves you know you shouldn't without a waiver and its your ass if you get caught or if you cause an accident from a freak flyaway or whatever. You cannot hover over a populated area unless the people are part of your shoot. Clearing over a crowd is relatively accepted as safe though. The rules are being tweaked constantly and everyone is subject, license holders just get to make money for flying. Billy aint said nothing wrong, even if it's abbreviated
