I was a senior manager for a railroad and asked for a severance agreement from my employer citing unsafe work conditions and a hostile work environment, and immediately got fired. I have a whistleblower case against them now and that is part of it. Thank you for these videos, they are very helpful.
Sorry to be so offtopic but does anyone know of a way to log back into an instagram account?? I stupidly forgot my account password. I would appreciate any assistance you can give me.
For anyone watching this after 2023, companies can no longer add in non disparagement clauses or confidentiality in severance agreements. The NLRB recently ruled on this.
With the latest NLRB ruling that disparagement agreements are nolonger binding in severance agreements. Does it matter to an employee whether they were laid off or fired?
What happens went the company goes bankrupt? can you violated the contract? after severance pay do they qualify for unemployment benefits? When would you expect an employee to be offered a Severance package?
Great this new law went into effect early in 2023, but I wonder if an NDA would still be lawful to prevent disclosures: “‘A severance agreement is unlawful if it precludes an employee from assisting coworkers with workplace issues concerning their employer, and from communicating with others, including a union, and the Board, about his employment,’ the National Labor Relations Board wrote in its decision Tuesday.” Does anyone know?
Very helpful video. I wish I have known this, before i signed my severance agreement. What are the chances of perusing a wrongful termination after signing a severance agreement ?
I want to revoke my signature but I'm affraid that I won't be able to because I am not 40. I hope I can find a way to revoke due to the nature of my termination.
I am going to be given a severance deal and I am over the age of 40. Will the company really let me take 21 days to make a decision? And is this still working or without working?
If you are just a regular employee and your employer offers you a severance agreement to get you out, that usually means the employer has done something wrong to you and wants to shut your mouth up. You definitely should see a lawyer. If you are an executive and get an severance package upon stepping down or being fired, that's usually the executive had done something wrong. And they get a lot of money for doing something wrong and leave.
Awesome video!! Good job! You're very nice and personable!! I have a huge termination, no pay for past work and lied about 401 that was stolen and wrongful termination.....the attorneys have been a MAJOR pain and hold up to find in Wisconsin. What would you do first in this matter?? Should I make up a severance agreement, give them a chance to respond and if denied?? We are struggling and need these issues solved, ASAP. THANK U, FOR THE KNOWLEDGE YOU SHARE!!
For $400,000 I would sign the agreement, walk away with the cash. They would never hear from me again, i would not say to anyone, not say a thing about the company and move on with life.
50% of severance pay goes to law firm and so depending on case by case the severance can be small or large it is law firm can have better knowledge on which is winnable and which case is not or in some case it is more of the national survival on the case rather than money involved even though money is important but in case like general McArthur is involved many generation and many countries livelihood after the relief of the general Mc Cathur if not China and Asia is much different than now and slavery would not exist in Asia if American finished the job in the Korean War rightly because the united nation was with the south Korean back then to legitimate the finish by any mean of the extremist wing of chairman Mao. But because the general was relieved led to vietnam war , then Iraq war then Afghanistan war then 9/11 then the 2008 economic collapse and the car industry kept on abusing drivers and now computer then smartphone torturing younger generation
Lol. Of course your colleagues have an interest in knowing how much you got, it'll help them put their offer in context. But a lawyer wouldn't advocate for that, bc then they'd be out of business.
I don’t agree or would accept the 1099 for the settlement. Why should you get penalized with picking up payroll taxes and indemnification on 400k. Let them “accurately” calculate and pick up the other half of ER side.
⚠ Are there any provisions in your severance agreement that I did not cover? Tell us about them here! ⚠
What if you sign the severance package but you are not in your mental state?
May want to update the new NLRB rulings on disparagement and confidentiality

What should you do if they put you on a PIP, before they try to fire you?

Can you make a video on how important a job description and why do you sign it
Wow totally wow. Explained really well. Thank you.
Do you have any examples of something that should be a red flag in a severance package?
Very helpful video. I wish I have known this, before i signed my severance agreement. What are the chances of perusing a wrongful termination after signing a severance agreement ?
Are these terms effective on and after the date you sign the agreement right? Not before?
Thank so much for your videos man I’m currently studying the laws on my own but your videos helps.
Are confidentiality clauses illegal per new ruling?

Severance agreement left out the OWBPA regarding the employee who is over the age of 40 and gave them 8 days to respond.
Does this void the agreement?
Do you have a video of a company not paying the amount of a pension and letting you see the formula to make sure that no errors were made?

Can you still sue your employer after signing the severance agreement and release agreement?
Same question
The video says no. That's the whole point of it that you cannot sue.
Can you get fired after visiting Las vegas
Thank you @@@@@!

I’ll paste info to see if anyone knows them
U should franchise.
Why no new video?
Branigan you never answered. Do you think dietary preference ought to be a protected characteristic?
"ought to," or not - regardless, it's not protected. Silly question.
@@frankthefkintank It borders on so many things that are protected though, especially disability and religion and maybe even age.
You’re very wise and well spoken. Can I take you out for dinner? Lol
I didn’t sign mine and I sue them. I’m not giving up my rights.
