Former immigration lawyer here. Darrell, his daughter and her husband need to hire an attorney who specializes in immigration law. Darrell is likely referring to the Affidavit of Support, which is a routine document in family/marriage based immigration petitions. This affidavit is designed to ensure the immigrant has financial support IF, the immigrant ends up in a situation where the immigrant needs support (job loss for example) so the immigrant doesn't need to rely on public benefits. Signing the affidavit doesn't require the person signing it to hand over any money to the immigrant. However, if Darrell is not comfortable signing it, he should listen to that voice. His daughter and her husband can try to find someone else or perhaps the daughter can quickly meet the income requirement. Bottom line: Hire a competent immigration attorney. I'm originally from Michigan and know it shouldn't be difficult to locate a good attorney on Darrell's side of the state (assuming his daughter and her husband live there as well) I saw far too many situations where people filed on their own or were given incomplete or insufficient information and ended up completely screwing up their lives. In some instances, deportation was the result. Again, hire an attorney.

His sponsor soon got smart and had him put away. After his release from prison, he then had to serve a 9 month probation period and was prohibited from entering certain post codes. He then fled the us after being caught with a DUI. Now aged 52 he’s estranged from his children and blood family, continues to get fired from retail jobs, can’t get a mortgage and is diagnosed with bipolar disorder. (TO THE DAD WHIO’S DAUGHTER WANTS HIM TO SPONSOR/ FINANCE HER NEW OVERSEAS BOYFRIEND - SLEEP ON IT AND THEN SLEEP ON IT AGAIN) 🙏

Totally - and she wanted to sell the house to downsize and have less of a worry. I hope she does exactly that. She can then get a smaller place for herself and her husband, pay off the remaining mortgage very quickly, and they can live on a lot less in retirement. She makes the most money and handles the bills, but we also don't know if she is the one responsible for all the CC debt and the one who wanted a big home in the first place. I don't know WHY RS people always bang up on the men without digging a little deeper and giving men the benefit of the doubt. Maybe the husband wanted to live with less and said to her, OK if you want it, it's up to you to pay for it.

With a small paid-for house and no debt, it's pretty amazing how cheaply two people can live if they have to (provided they have good health insurance.) In fact, many cities, like the one where my Mom lives, have benefits for Seniors with limited incomes that include not paying any real estate tax!
Nancy in Tampa- just to add to Dave’s insights. If you are taking SS there is a $22,000 limit on your income and then over that amount, they take back the SS based on a formula. Also, if you were married for 10+ years, and husband has a higher SS amount, you can file for that higher amount after he passes. And there are also affordable senior housing options in some locales, and rent is based on your income. In my state these are a decent option, some units in nicer towns are almost luxurious, others are more utilitarian. Best wishes in a tough situation.
She also does not have to wait to file for social security until the husband passes - she can file for half of his (if more than hers) while he is still alive as long as they were married for at least ten years and she is of social security age.
Guy with the immigration question was way off, the sponsor (daughter) only has to show she made 25k a year last 3 years. If not the parents can co-sponsor and show they have, and you all have to live in the same house for parents to be co-sponsor. There is no financial risks involved..

How does a prenup control estate planning issues? When the husband passes away his will should indicate what happens to his assets. But the house they live in should be considered part of their household because for the last 7 years she has been paying the mortgage, household insurance, taxes, and maintenance, etc.
So Dave is telling Nancy to get a small place and pay off her mortgage as quickly as possible b/c having a paid off house is the best decision someone can make and they can "live on a lot less" - that is the opposite of the advice he just gave to Mary Beth whom he told to try and hang on to the expensive house (even though they have a lot of debt.)
I think once you are a homeowner in this crazy market, most people would advise to try to keep the house at least in the short term until they are in a better financial situation. Marybeth and husband both have income and just need to get their act together. Even if they downsize later.
So, there is an important detail that was not mentioned here. The first green card is provisional for two years. So, if he turns into a complete slacker, or decides he doesn't want to really be with your daughter (something he probably wouldn't decide until the day after he gets the 10 year card, which would be after that two years), then they can revoke it. That won't help your daughter if her heart is broken, but at least it could get you financially off the hook if he shows his true colors after that time. Also, she's responsible for supporting him and making sure he doesn't take from the social system even if they get divorced for pretty much forever. So ironic when you juxtapose that with how our social system is burdened when the immigrants are illegal. I hear they don't really enforce that requirement of support from the ex-wife/citizen but I don't know that for a fact. Also, why is he in the U.S.? Does he have a visa for school? It's not uncommon for people to go to school with their whole goal being to marry someone they meet before the school visa runs out. Of course he may be a prince (the charming moral kind, not the online chat room Nigerian kind). If he is, great. But you're trying to suss out if it's a good bet, I'm giving you some additional nuances here.

As the saying goes, a man convinced against his will is of the same opinion still. Maybe he is content with less than she has been throughout their lives. There's more than just the mortgage for a big house, there's real estate taxes here in Virginia, maintenance, etc. And the reality is that you can live on very little if you have to if you have a paid for house (which they could pay for quickly with a much smaller mortgage while still investing for retirement.) WHY would you keep a big house that is a burden when there are other options and WHY would this team make judgments about this couple's relationship without knowing all the facts?
It does not matter who made the debt. The Ramsey teaching is that both of them as a married couple have to participate in the budget, be aware of everything regarding the finances. The only time one of the spouses should not have access to the money if there's addiction, abuse or mental issues going on. If not both of them present in everything then it would not work
I agree. You and I both know that home maintenance (and just keeping up with a house) grows exponentially as you age, since it becomes more and more difficult to keep up with it.
