    Hi everyone! Thank you for asking questions. TWO THING: (1) I cannot emphasize enough the IMPORTANCE of you seeing either a REPUTABLE LAWYER or LEGAL nonprofit organization like LegalAid or Catholic Charities to help you with your case. You really should not be doing this case alone because it is not easy and the standard of what is abuse is very high. (2) No lawyer can answer you how much longer until your case gets approved because processing times have changed greatly and covid delayed cases even more. If you ask me how much longer on your case I will not reply because I don't know. Thanks and Good luck!

    Hello mam I was married with my spouse for good faith I have wedding pic video and marriage certificate but I don’t have any proof for living together and joint lease because I wasn’t had any work permit or passport but I can prove with affidavit letter we were stay together under one roof it’s that make me any help to apply vawa and I have been married only for 2 month and she getting separated

    Wanted to shared my situation little bit light way,i have been married to LPR since September 2014 and had lived together for 4 years and now we have been separated for another 4 years,it was family arranged good faith bona-fide marriage but,later it's turned in to abusive,do have all of the necessary joint documents in my possession but,do not have police records,abusive, mental and emotional records ? Does it sounds like VAWA is an option for me now ? Hope to hear from you soon ?

    Is there any waiver/exception for not filing for VAWA within the two-year divorce deadline? What if the abused spouse truly did not know such a relief exist at the time (15 years ago!)? He thought VAWA only applies to women, that’s why he didn’t apply? Or did not file within the two year/to date for fear of serious retaliation?

      Very good question. There is one circumstance where this can be waived and that's only if the victim is before immigration court facing removal proceedings. It is called a vawa cancellation!

      @@AlvarezImmigration if the VAWA cancellation of removal is granted in immigration court, could the immigrant file for a green card or not? I know with Asylum s/he cannot ever if granted a withholding of removal!

      @@richardgherlo7842 If a judge grants cancellation of removal the person will obtain a green card. I will post about a video discussing more about cancellation of removal in the near future so stay tuned!

Could you also post a video about a scenario when a “crook” lawyer failed to properly advise/serve his/her client’s best interest, before the VAWA two-year divorce filing deadline expired? Can one apply for U-Visa on grounds that criminal lawyer was the perpetrator? Do you think the VAWA statute of limitations would be extended indefinitely in the near future by Congress, like rape cases? A strict two-year to file an I-360 (without an exception/waiver) for divorcees is inequitable...!

      @@richardgherlo7842 the U visa does not have a time limit. That's a different visa altogether with different requirements like reporting the crime to the police and obtaining a certication from them.

    What if I have 10yrs permanent green card and after getting visa and greencard I moved to USA with my citizen husband and lived for three months n bcoz of extreme abuse by him and his family I called cops on him but not got him arrested. However cops moved me to a domestic violence shelter home n I got order of protection for myself to protect from my husband and in laws. However I would like to know if me taking divorce will affect my citizenship in future which would have happened after 3yrs if I was married with him then but as I would file for divorce n so I would have to wait for 5yrs instead of 3 yrs to file for citizenship/naturalization? Is filing for VAWA going to help me ? I just stayed with him and my in laws in United States for 3 months and he has not added my name to anything which was again a financial abuse where he tried to control me . Never added my name to utility bills not took pains to add my name for filling joint taxes nor added my name on his bank account to have a joint account as I m very new to the country and getting job or opening individual account isn’t a piece of cake to do. Please throw some light on my issue . Currently m at a shelter home and waiting for my court hearing after 10 days as I have a 21days order of protection from court.also I do not have any pictures or witness who would stand up for me to support me . However the cops who escorted me from my husband and in-laws house are the live witness and the copy of police complaint I have already asked from police station . I have order of protection copy with me and also the people here at shelter home must be the witness for me and provide me with the proof or evidence stating how n why I was brought to shelter home.

    Does being hit once enough and having texts of admission of abuse through apology enough to qualify for VAWA?

      Yes, being hit is battery and even 1 incident of battery is sufficient.

      I am asking in behalf of my friend. When VAWA is approved. Is he allowed to marry while I 485 is pending? How long is the processing time of his I 485 that was submitted last 1st week of June 2020? How he will know his ViSA bulletin is current?
      If he marries while his I 485 was pending under C31 can he also adjust his status under marriage visa?

    How long does it take for vawa adjustment to get approved if i360 and i485 were filed concurrently? The abuser is US citizen.

    Well explained thank you very much I have a question though I have an approved vawa and also my derivative children are on it.. but what does this mean" the appearance of a derivative name on this notice does not constitute a deferred action assessment to receive defered action each individual named below will need to separately request deferred action and proof eligibility"
    I am all confused on my children not with me approved in vawa.. I truly would appreciate if you could take the time to answer thank you so much

      If your children are under 21 and were added to your case they too should receive deferred action. You may have to file an I-765 along with a copy of that letter. Again, I don't know your entire case so please don't take this as advice to you. If you book an appointment I can look at it and see if your children were added and if they also have separate green card (adjustment of status) packets filed. Otherwise, speak to your lawyer about it.

    Hello Attorney Im a man and I applied vawa and got my receipt. I included Doctors report , medical prescriptions and picture of injuries on my arm and damaged phone in my initial application. I didnt included police report and psychologist report. Is it good.
    My attorney said we should withhold some of the evidence cus they will definitely ask for more evidence. Do you think its good what my attorney said? Please help me out. I want to get approved once and for all so that I dont delay

      Hi Mr. Asante. I don't know about your case but if they ask for more evidence of abuse and you have other evidence then you should be fine for the vawa. The evidence you say you have seems to be pretty strong.

    I am so glad I stumbled into your video n listened to very helpful information on VAWA. I already have my combo EAD, security card. Recently I had an interview for my i-485 but as expected green card was denied because my abusive US citizen husband did not come with me for the interview. I was adviced by the immigration officer to file for VAWA and i-485 together but I forgot to ask where to address the package. I've listened to your video and you mentioned that they should be filed in the same packet. But where do I mail them to because VAWA I understand should be mailed to Vermont while the i-485 is supposed to go to Chicago according to the instructions. Thank you so much for the clarification.

      Hello joley,I have been a green card holder for over a year through vawa.In the event that your i485 was denied through marriage,most likely you will have to refile your i485 along with your i360,i765,i131(optional) and i912(fee waiver optional)along with supporting evidence.These forms should be mailed to ST Albans in Vermont.I hope you can find a good vawa lawyer,good luck

      @@joleyugang5396 I filed vawa without paying a lawyer but that doesn’t mean you should do what I did.Every case is different.you can file the i360 separately and wait for it to be approve within 18 months(at minimum).If you do that,you will not be able to renew your EAD card,but if you file the i485 together with the i360 ,then you can renew your card while your vawa is pending.There are videos on UA-cam that shows how you can file forms i360,i485 etc. and you can also join a vawa forum on Facebook where you can meet people like myself that have been through all types of situations relating to vawa

      I'm not sure if the officer already denied your i-485 based on your spouse's i-130. if the case was denied then yes you should start again. If not, your lawyer may be able to substitute the i-360 for the i-130 and then you could continue using the pending i-485. Good luck!

    I applied for vawa since August 2018 since then I haven't received any interview. They asked me for more evidence and i did provide them.

      A VAWA grant usually comes with a Deferred Action status which must be renewed. So long as USCIS keeps granting the deferred action, DHS will not take action (remove or commence removal proceedings) on that individual.

      How long does it take for i485 based on vawa approval?! It now has been a year since I sumitted, and only message that I get from them is the USCIS will send you a decision or notify me if they need anything from me.

      The only "deadline" for VAWA is that it must be filed before the second year of divorce. Not sure what you mean by "until the time is current." You may be confusing this case for a priority date type of case but that does not apply to VAWA.

      Of course. In the video we explain anyone can apply if they have a qualifying family member that has battered or abused them.
